Delhi High Court Forms Committee Led by Former CJI Sanjiv Khanna to Oversee Greenopolis Homebuyers’ Claims
“A committee headed by former Chief Justice of India (CJI) Sanjiv Khanna shall verify genuine homebuyers, assess competing claims over properties attached by the Enforcement Directorate (ED) and facilitate restitution of properties to eligible claimants,” Justice Bhambhani ordered while allowing Delhi High Court Bail Application (DHCBA)’s plea.
The Delhi HC on Tuesday set up a monitoring committee headed by former Chief Justice of India (CJI) Sanjiv Khanna to monitor and smoothen the claims of hundreds of homebuyers duped by real estate firms in the case related to the Greenopolis housing project in Gurugram.
The committee will have former Delhi Higher Judicial Service (DHJS) officers HS Sharma and Ajay Kumar Kuhar as its members to assist Justice Khanna. Justice Khanna will carry out the duties assigned to the committee without charging any fee.
Justice Anup Jairam Bhambhani added that “The Committee will verify genuine home buyers, sort out the competing claims of home buyers over properties attached by ED and help restitution of properties to eligible homebuyers.”
The bench also asked the committee to try and finish the work within eight months of its first meeting. It will give reports to the court after every three months.
The order was passed by the single-judge bench while hearing pleas filed by the Enforcement Directorate (ED), Greenopolis Welfare Association (GWA), and Greenopolis Welfare Confederation (GWC) against the order passed by the PMLA Court on November 27, 2025.
The case is about the Greenopolis project in Gurugram developed by Three C Shelters and Orris Infrastructure. Out of 1,862 units of the project, 1,650 units were allotted prior to the project being left off. Three C shelters allegedly received ₹776.60 crore from home buyers while Orris received ₹383.06 crore. Enforcement Directorate (ED) alleged that ₹214.09 crore was diverted to connected parties.
The Special Court, in its order, had ordered restitution and disposal of attached properties by ED. The Enforcement Directorate approached Delhi High Court challenging the order of Special Court. Enforcement Directorate had argued that the Special Court had not identified the beneficiaries properly while disposing of the matter. They also argued that the orders were passed without adhering to the statutory framework.
“The Court heard the parties and took note of the complicated facts and issues involved in the case. After considering the parties’ arguments, the Court decided that it was necessary to form a monitoring committee,” the High Court said while allowing Delhi HC Bail Application’s plea.
The bench clarified that the order will not impact the ongoing Corporate Insolvency Resolution Process (CIRP) proceedings initiated under Insolvency and Bankruptcy Code, 2016 (IBC). Nor will it affect the rights of home buyers as parties to the CIRP proceedings.
