Blocking of Bank Account can create lot of problem in your life. Imagine one day everything is working fine, next day your payment gets rejected or you were not able to make a payment because your account got blocked or salary was not credited in your account. When you ask bank about the reason, they might give you some vague answer about pending dues/recovery or tell you that they got instruction to block your account from some other agency.

If you are a borrower and facing such situation then you might think of filing a writ petition for blocking of bank account. But high court is not going to entertain every dispute you have with bank against bank recovery.

High Court has power under Article 226 to issue any conpurtenant writ, direction and order. But whether High Court will use its power in your matter or not depends on various factors like Who blocked your account, was there any legal justification to block account, what was bank’s duty towards you and was there any other efficacious remedy available.

Let’s understand with an example

Mr.X (hypothetical person) is a small businessman from Ghaziabad and had his current account blocked due to some dispute regarding pending installment of business loan. Now he is unable to make payment to his employees, buy raw material or to fulfill his contractual obligations. Though borrower is liable to pay the money, but can bank just block your account?

Similar type of situation can arise when your account is blocked. Problem are multiplied when you are an individual. Your children’s education, rent, medical needs or household expenses depend upon the bank account. There are various situations related to bank account being blocked.

If you are a borrower and want to know more about bank initiating recovery proceedings against you, illegally blocking your account and where to file a complaint then you can consult BK Singh Advocate from DRT Lawyer.

Can you knock on the doors of high court if your bank account is blocked? Well it depends on reasons for which your bank account got blocked and whether any legality was there to block the account.

In this article, we will let you know in which situations you can file writ petition in high court, Difference between DRT and Article 226, what documents you should have etc. and also when you can ask for urgent intervention by high court.

Why Does a Bank Account Freeze During Loan Recovery Matter in India in 2026?

Every Individual Requires An Operating Account Today. For online banking, credits to salary from employers or to make payments to vendors electronically. You must have your account active to manage your money.

If your account has been attached in Delhi, New Delhi, Noida, Greater Noida, Ghaziabad, Gurugram, Faridabad because of any dispute you could be losing money. Especially if you own a small business and rely on the daily deposits to run your business. This applies to all cities across India like Mumbai, Pune Bangalore, Hyderabad, Chennai, Ahmedabad.

Someone can attach your funds any time.

You have enough money in your account to pay your employees but you can’t. You could be a professional that needs access to your money to feed your family. Maybe you took a loan and are trying to repay the loan but you cannot access the funds to run your business.

None of this means that your money was unlawfully attached.

There could be provisions under which the bank can attach your account. Maybe they are required to under the Act or a different order was issued. What the bank can’t do is attach your funds without cause just because they are trying to recover a debt.

At BK Singh Advocate we can help you figure out if they had the legal right to attach the account. Was it under an Act or Rule. Or was your account attached unlawfully.

This is where it becomes fun with multiple proceedings pending against the borrower for the recovery dispute.

The borrower could have been served a notice under SARFAESI. And maybe CIDCO wants a freeze order to be placed on the account. Fight the SARFAESI proceeding, but the freeze order will remain because its a separate issue.

Quick Facts:

  • Article 226 provides power to high courts to grant writs, orders and directions. Not only for enforcement of Fundamental rights but also for any other purpose which is provided by law.
  • Loan defaults: A defaulted loan will not justify all kinds of restrictions on your bank accounts.
  • As per section 13(4) of SARFAESI Act most of the steps taken can be appealed before the Debt recovery tribunal as per section 17.
  • Section 17 can be filed within a period of 45 days of such step taken u/s 13(4).
  • If its a private bank it all depends on what kind of public duty they are doing which could attract writ jurisdiction.
  • Can ask for immediate relief of unblocking of your bank account or part of it so it can work.
  • Your liability towards the amount which you owe does not come to an end just because you were able to remove your account from being frozen.

What Does a Bank Account Freeze Legally Mean?

A bank freeze usually means that your bank has restricted some type of transaction from going through on your account.

It can restrict funds from being withdrawn or sent out electronically or any debit activity. Some orders will only allow certain amounts to be frozen.

There are different ways that your bank account can be restricted.

Bank-Imposed Restrictions and Contractual Rights

The bank can claim right over any lien or set off or combination of account if they exist.

Depends on type of account held with them and what law permits.

The bank claiming they have a right to set off there funds from your liability is different then them deciding they want to block all transactions.

They can't claim to have a contract and set off every account that you may hold.

BK Singh Advocate will look into what contract if any exists to support there reasoning.

Freezes Ordered by Courts or Investigating Authorities

An account can be frozen due to any order passed under criminal law, court order or any other act.

If its being frozen by a police then you would have to look at the BNS 2023 and how the order was passed.

Loan Recovery and Police case are two different things.

Just because your account is in loan recovery doesnt mean the account freeze is normal course of recovery by police.

You would have to approach the Criminal court or some other forum to get this restriction lifted.

Can a Writ Petition Challenge a Bank Account Freeze in the High Court?

An Account can be challenged through writ petition under article 226 if the circumstances of the case reveal that it was done in excess of their powers or contravening any duty imposed upon them which they owe to the public at large. Maintainability should be viewed distinct from whether the petitioner would be entitled for such relief or not.

When deciding whether to entertain the case High courts take into consideration what act has been impugned, the public law obligation that exists and if any other remedy is available to the petitioner.

It is important to distinguish between exercising public law functions and mere contractual disagreements.

If the borrower only wants to challenge the quantum of interest or settlement or the terms on which loan was repaid then he may not approach court through writ petition.

However if the restriction has been placed on an account without due authority it may attract public law questions.

Can a Writ Petition Be Filed Against a Private Bank?

Private Bank will not be beyond the scope of Writ Jurisdiction per se. However all commercial disputes may not fall within the realm of article 226 on account of it being a Regulated Entity.

The Allahabad High Court in Proview Constructions Limited vs Union Of India And Ors 13th Feb 2025 considered the case where Private Bank had imposed restriction on operating the Current Account of a Company based on their unilateral action on request made on account of Personal Dispute.

The Hon'ble Court noted that no order of Freeze was passed by any Court or Investigation agency. Thus, in such situation it is open for the High Court to entertain such matter under Writ Jurisdiction and allowed the operation of account subject to any bar as applicable by law.

This judgment can be relied upon when Private Banks restrict customers on their deposits as they have certain obligations towards them which is akin to Public Law.

However this doesn't mean that you can approach the High Court against all disputes with a Private Bank. BK Singh Advocate can look into your case if there is any such aspect.

Does the High Court Have to Entertain Every Writ Petition?

No. Article 226 allows discretionary Constitutional jurisdiction.

Availability of proper statutory remedy is one of the factors to be considered.

As held by the Hon'ble Supreme court in South Indian Bank Ltd. vs Naveen Mathew Philip decided on 17th April 2023 there can't be regular intervention by way of writ petition in private banking transaction or where alternative remedies exist.

So one cannot rely on article 226 when it comes to Bank recoveries..

Can a Bank Freeze an Account Simply Because an EMI Is Overdue?

If a customer fails to make his EMI payments the bank can take steps as per the contract. However just because an EMI is overdue does not give the bank the right to restrict anything.

What are the rights the bank has? That depends on what type of loan you have and the banking facilities you have with them.

If it's a secured business loan then the bank may have rights over your money in certain accounts or even assets. But if you have a deposit account with them they may have other rights.

There could be various accounts you have with one bank so you need to check what kind of relation ship you have with the bank.

Also know whether the bank has put a temporary restriction on your funds or has already set off against your funds or frozen your funds completely.

As each scenario would have different impacts.

BK Singh Advocate can help you figure out these scenarios before you challenge the banks actions.

What Evidence Matters in an Unlawful Bank Account Freeze Dispute?

Proper proof is required to show that your account has been frozen by whom and what has happened due to this.

Simply stating that the bank is acting unjustly towards you may not be enough.

Important document Why it matters
Bank freeze communication May identify the restriction and its stated basis
Loan sanction letter Establishes the lending facility and key terms
Loan agreement Helps identify contractual banking rights
Bank account statements Show available funds and restricted transactions
Recovery and SARFAESI notices Clarify the stage of debt recovery
Court or authority orders Identify any independent lawful restraint
Written bank correspondence Records explanations, objections and responses
Salary or business payment records May demonstrate the effect of the restriction
Settlement correspondence Helps establish any relevant repayment discussions

A bank might not be able to provide all of the information that is asked for from the customer if there is legitimate confidentially in place.

If there are insufficient records available then you should make a judgement as to what can be confirmed.

If its a company you may need to look at who is authorised to sign and any letter of authority that allows someone to operate the account.

When Is Urgent Legal Assistance Necessary?

When urgency comes into play especially if you have to make important payments or are doing business with your account.

If you cannot pay your employees your business will come to a halt. If you rely on your salary to make ends meet then a hold on that account could create some problems for you.

Also when the hold is continued without proper explanation or the banks stated reasons don't seem to align with what is apparent on record.

Just because you have an urgent need for the money doesn't mean that you will get an interim stay.

There are various things to look at when applying for an interim stay such as prima facie case, balance of convenience etc.

BK Singh Advocate can assist you in situations where you need to deal with holds on accounts.

You should also find out if there is any auction taking place or notice of possession etc. There may be other deadlines that you need to be aware of when it comes to recovery of loan.

Can a Borrower Request Partial Account Operation Instead of Complete Unfreezing?

Complete removal of the restriction is not the only possible form of relief.

In appropriate cases, a court or competent authority may consider limited access to funds, operation subject to conditions or modification of an existing restraint.

For example, a manufacturing company may seek permission to meet unavoidable salary obligations or essential business expenditure. A salaried individual may explain the effect of a restriction on necessary family expenses.

Whether such relief is legally available depends on the authority imposing the freeze, the purpose of the restriction and the nature of the funds.

A court may decline relief where releasing money could undermine a lawful attachment, investigation or enforcement process.

BK Singh Advocate can assess whether the circumstances support a request for complete release, limited operation or another form of lawful protection.

Does Filing a Writ Petition Automatically Stop Loan Recovery Proceedings?

No. When you file for a writ it will not stop banks from recovering.

Banks can carry out any lawful recoveries if there is no order to stop them.

So if you have filed a case before the DRT that also will not stay any action of possession or sale of property.

In situations where your bank account has been frozen and property which is being recovered under security is about to be sold.

There may be a favorable order to operate on your bank account but will not affect the recovery process.

The apex court in the case of Phoenix ARC Private Limited vs Vishwa Bharati Vidya Mandir on 12th January 2022 made this very clear while staying the approach of taking up a writ petition to avoid the process of SARFAESI Act.

So it becomes important to look at both issues separately i.e. your bank account being stayed and recovery proceedings going on.

Can Loan Settlement or OTS Help Resolve a Frozen Bank Account Dispute?

One Time Settlement can help you to settle your dues if you fall in the above mentioned criteria.

The bank may allow you to pay certain amount subject to terms of settlement.

But this will not mean that your account block will be treated illegal.

You can't consider that by giving an OTS your account will be deblocked or SARFAESI proceedings will be halted.

If there is an account block against you because of Bank Recovery. You can negotiate a settlement which can alter the scenario. Subject to terms of settlement.

If your account is blocked due to some Police/Court order. You will have to seek remedy from the source. An OTS may not release your blocked account.

BK Singh Advocate can help you find out if there is a connection between your outstanding loan and the dispute regarding your blocked account.

If you are unable to reach your funds then one should take care while negotiating a settlement.

It would be wise to put down the settlement amount, condition of payment and effect on the ongoing proceedings in writing.
