Can You Settle Your Loan Through OTS While DRT Proceedings Are Ongoing?
YES. An OTS can be negotiated even after bank has filed action in Debt Recovery Tribunal (DRT). Even after your bank files recovery case against you, it can’t say that we will not consider any settlement. Whether or not it agrees to consider your proposal will depend on its policies and your profile like the amount of liability, security you have provided, your repayment capacity etc., and needs approval from the competent authority.
If you get a notice from Debt Recovery Tribunal (DRT), you would naturally be worried about it. Particularly if the asset in question is your residence or your office/ practice premises, or if you have taken a very big loan. Most borrowers think that they cannot settle with the bank after it has gone to DRT to recover its dues.
But did you know that the bank can even agree to accept a compromise settlement when a recovery proceeding is pending in DRT. However, it is important to note that even if the borrower requests the bank to settle the matter, he is not entitled to get the settlement as of right.
If the bank has initiated proceedings against the borrower in DRT, the borrower would probably need professional assistance. This is because, while you negotiate a settlement with the bank, the DRT proceedings can continue simultaneously. An out of court settlement would not automatically imply stay of proceedings before the Tribunal, or stay of recovery or sale by auction.
If you have got a notice from DRT and wish to explore the possibilities of OTS from your bank, speak to Advocate BK Singh. He will make sure you understand your legal position, discuss the settlement terms being offered to you and guide you on the implications of signing such a settlement approved by the bank and how would it affect the recovery proceedings going on in DRT.
Why Does an OTS Matter After DRT Proceedings Begin in 2026?
As Borrowers struggle with defaults on business loans, secured credit lines and unpaid obligations to banks in Delhi NCR, Noida, Ghaziabad, Gurugram,Mumbai,Pune,Lucknow,Bengaluru and other cities across India, they find themselves in litigation with the bank. A DRT case only adds on to your financial stress by burdening you with legal fees and ambiguity.
You might worry about your mortgaged business property. Your family might worry about your home which you have mortgaged as collateral. As a guarantor you might find yourself facing the reality that you are still liable for the debt even though the borrower has run into financial difficulties.
If only there was something you can do about these worries sooner…
Settling up with the bank through an option to settle (OTS) after the DRT proceedings have started may allow the borrower to fulfill the bank’s monetary demand, provided the bank agrees and it is done correctly.
But the borrower shouldn’t think that just because he files for an OTS application his property will be safe from attachments or recovery actions will be stopped. There is a lot that can be done.

What Is an OTS After DRT Proceedings?
OTS stands for One-Time Settlement. When a borrower negotiates with bank and bank accepts terms to settle a loan liability on mutually agreed terms of payment. Terms can be negotiated which can include a discount on claimed amount if bank permits. One time doesn't mean one day payments should be completed.
Once negotiated terms are accepted, payment can be done by instalments over a period of time mutually agreed. Asking a bank for OTS consideration is different from DRT proceedings. DRT is for judgments/recoveries of debt. OTS is a bank's commercial decision to allow you to settle by negotiated terms. Talk to Advocate BK Singh and know the difference before you agree to pay. Can a Bank Legally Accept an OTS While a DRT Case Is Pending?
Yes . Law allows for lawful compromise to be recognised
19(20A). Recovery of Debts and Bankruptcy Act, 1993. "Notwithstanding anything contained in this section, if it is proved to the satisfaction of the Tribunal that the parties have entered into any lawful agreement or compromise in writing signed by the parties, the Tribunal shall pass such orders as may be necessary to record the agreement, compromise or satisfaction of the claim."
This section would apply where the settlement has to be evidenced in the recovery proceedings pending before the Tribunal.
Bank also has to comply with requirements of RBI, if any and its board approved policy on compromise settlements.
OTS proposal would therefore be considered by lender in accordance with their approval process. Bank may consider recoverability, value of security, facts of the account and amount offered. etc.
Pending DRT case does not give you any automatic right to settlement or discount.
You may speak to Advocate BK Singh to find out if/how an approved settlement would get treated in the proceedings. For matters involving recovery proceedings, review the relevant DRT and loan recovery legal services.
Who Should Consider Hiring a Lawyer for OTS During DRT Proceedings?
Legal counsel could be advantageous particularly if you (as a borrower) have substantial exposure or if you don’t fully understand what you’re agreeing to.
If you are a borrower who:
- Operates a business which is facing recovery proceedings for term loans, cash-credit/flexible loans or overdrafts.
- Own immovable property which is mortgaged and has been secured against loans, which are also facing parallel SARFAESI recovery.
- Are a guarantor and are concerned about your continuing liability.
- Have been sent a certificate of recovery or any other notice pertaining to enforcement action.
- Own a borrowing entity yourself and wish to settle, but there are other creditors/parties involved/recovery proceedings ongoing.
- Are part of a joint family and want to know more about inherited/jointly held assets which are secured.
Considering a One Time Settlement? Know that it could impact more than just the amount you pay back.
If you are proposing a compromise with a major borrower, for instance, the terms you negotiate may not automatically discharge all guarantors from their obligations, unless the compromise deed and the governing law intend the same.
You could consult Advocate BK Singh, if you want someone to look over the terms/legal documentation before you accept terms and conditions that will impact your finances in the long-run. You can also explore the site's loan settlement and recovery assistance for related issues.
Why Should You Hire a Lawyer Instead of Negotiating Directly With the Bank?
You are not necessarily required to have an attorney to ask for an OTS. Most borrowers negotiate with bank officers directly.
Legal intervention could become necessary if the recovery has already started.
Interest, expenses, arrears, security, guarantees (and withdrawals/disposal of proceedings) are examples of topics that may be included in a bank settlement letter.
You should understand what those provisions imply.
You might assume that once you pay the agreed amount, all your obligations will disappear. But there can be exceptions or conditions in the written settlement that need to be resolved elsewhere.
A lawyer can point out those issues.
Advocate BK Singh can advise borrowers whether the settlement offered is reasonable enough to adequately address the DRT case, enforcement proceedings and the bank's other demands.
Can a Lawyer Help When the Bank Has Already Issued a Recovery Certificate?
Settlement negotiations can still continue even after a recovery certificate has been issued.
It becomes a sensitive issue at that stage since recovery proceedings may already have been initiated before the Recovery Officer.
Negotiations do not automatically constitute suspension of the certificate's execution.
Any settlement would be viewed depending on the stage of recovery process underway and orders passed.
Different treatment would be available depending on whether the case is pending before the Tribunal as compared to recovery-certificate stage.
Borrowers should get clarification instead of assuming that negotiations with the bank to make payment means that enforcement action has been stayed.
BK Singh can examine the order passed and advise on the implications of any proposed settlement.
Can OTS Negotiations Stop Property Auction or Possession Action?
OTS proposal does not give automatic stay/reverse on bank auction or possession notice or any other type of recovery proceedings.
Please note this point carefully if your loan is against property.
Bank can initiate SARFAESI Act, 2002 proceedings against the borrower(s) wherever applicable along with the pending debt recovery suits.
Just because your settlement request is being processed or considered does not mean a legal/stay order enforceable by law/authority in writing.
Even if your proposal has been accepted by bank, terms of the proposal & any specific court orders must be complied with.
Do not wait for bank officials' verbal clarification if there is an immediate / specific auction / possession drive against your property. Contact an attorney at law immediately and fight such specific drives.
BK Singh can advise you on your rights against such pending recovery proceedings taking into consideration the bank settlement correspondence. For further information, see borrower protection and rights.
What Should Borrowers Expect From Professional OTS Legal Assistance?
You should expect your attorney to clearly explain to you what liability exists, what the offer is and what the consequences are if you accept the settlement. This might entail double-checking what the bank says is owed, going over tribunal notices and orders, analysing the paperwork for the offer and suggesting the best way to finalise any outstanding proceedings.
You're not looking to get the cheapest deal possible.
As has been said, for instance, a great discount might be worthless if the settlement does not eliminate the chance of the bank coming after you in the future, does not release any guarantees or does not remove any secured assets. Your lawyer should also be able to explain why the bank may have rejected your settlement offer, why they want payment terms different to what you want or why they need more sign-offs from within their organisation.

How Much Time Is Available to Negotiate an OTS After DRT Proceedings Start?
There is no universal statutory timeline that gives all borrowers the same number of days to work out an OTS once a DRT proceeding has been initiated.
It will depend on the type of proceeding, the bank's policies, any outstanding orders or pending enforcement action.
There can even be multiple deadlines applying at the same time.
The tribunal may schedule a date by which a legal response must be filed within a certain number of days. The auction notice may contain a different timeline. The bank may even set a deadline for accepting a settlement offer.
Don't confuse these deadlines with each other.
The filing of a Statement of Defense under Section 19 of the Recovery of Debts and Bankruptcy Act allows very little discretion in extending statutory timelines.
Don't miss a court deadline waiting for the bank to respond to a settlement offer.
Feel free to contact Advocate BK Singh at any time if there is an upcoming hearing date, recovery order or settlement expiration date that needs to be handled.

Final Thoughts
OTT is still a viable route for borrowers even after DRT proceedings have been initiated to clear outstanding bank dues. Initiation of recovery suits do not necessarily mean that the lender will not agree to a settlement.
That being said the bank is under no compulsion to accept such a request and the pending proceedings will have to be continued independently. Borrowers should quiz the bank regarding the specific terms of the settlement, repayment timeframe, liability on guarantors, release of securities and status of claim (would the account be closed/satisfied etc. ).
