Can a Bank Proceed With Property Auction During a Pending OTS Request?
You lodge your OTS request with the bank. Your branch would accept it. Maybe they have even started discussions with the recovery cell. Out of nowhere you receive an auction notice for your house/shop/factory or any other mortgage property.
"Will bank be able to auction me off if I have applied for OTS?"
Probably yes. Sending out an OTS request alone wont prevent recovery or SARFAESI from happening. The OTS is just your proposal to workout your debt. As long as the proposal has not been accepted unconditionally or you have not gotten a assurance from the lender to not proceed with recovery they can carry on with their present course of recovery. Even the Supreme court has held that there is no vested right of the debtor to ask bank to accept his OTS.
People generally assume that as soon as I send in my OTS the bank will hold it till they come back with an answer. This line of thought can cost you dearly when your security is undergoing SARFAESI process.
However if your bank has given you an unconditional approval for your settlement and communicated the same to you in writing or have received good portion of the settlement amount or if a competent forum has granted an Interim Order. All of this will depend on what documentation you have in hand.
Once you receive the auction notice you need to approach a Loan Settlement Lawyer who can go through your OTS document along with the SARFAESI procedure. Keeping both as different issues will lead you to ignore what is happening before your eyes.
Why Does a Pending OTS Matter for Borrowers Across India in 2026?
The situation could be that your property is being contested after a few months as well. There could be a scenario where you have gone through cash flow crunches in your business. You could have not paid your home loan EMIs when you were made redundant. Or maybe you are a MSME borrower trying to arrange money from your investor or family while your lender is moving ahead with his recovery steps.
You have OTS to help you out as a borrower with the issue at hand. However just because you are trying to negotiate with the lender does not mean you have immunity from being auctioned.
RBI allows borrowers to enter into compromise settlements. All regulated entities have been instructed to create board approved policies on compromise settlements. The RBI framework does not make any entitle ment that forces acceptance of OTS offers.
If you own properties which are on the verge of being auctioned off in Delhi Noida Ghaziabad Gurugram Faridabad Mumbai Bengaluru Hyderabad Chennai Kolkata or Lucknow its important to understand this. There could still be chances that your property gets sold if you are just negotiating with your secured lender.
So if BK Singh suggests that the borrower should be aware of how far their recovery has progressed. Instead of assuming your OTS application has paused everything.
Quick Facts

- Once you get your OTS approved please read it through. All conditions written will be applicable on you.
Can a Bank Continue a SARFAESI Auction During OTS Negotiations?
Yes. As a rule if an OTS proposal is pending you should continue with your legal recovery steps. There should be no stand still order on a proposal pending. It can also be said about letters and negotiations as well.
A secured loan which may have gone through sarfaesi process does not loose it's legal rights of recovery. If there is any proposal pending it does not come under any stand still order.
As per section 13 of sarfaesi act a secured creditor has the right to recover his secured dues if the borrower defaults. Provided all the conditions are met and due process is followed. You can even issue demand notice to discharge within a period of 60 days as provided under section 13(2). Further action can be taken under section 13(4) of the sarfaesi act once you meet all the conditions.
Has the bank given you a clear cut stand that they will hold off the auction process or the sarfaesi action?
If not it is always advisable to take risk with negotiations while the auction is around the corner. Check out this One Time Settlement Lawyer page for more info on the difference between an ots offer, negotiation and a written stand.
What Happens If the Bank Has Already Approved the OTS?
Sanctioned OTS is better than awaiting for one. But again it has to be read. Suppose Bank issues written sanction for settlement wherein it states that ?30 Lacs are to be deposited on different dates. Sanction letter may say about pendency of recovery proceedings, what will happen if you default and if auction will be stayed until you complete payments.
This becomes very crucial. Borrower cannot always rely on all OTS that has been sanctioned will lead to stay of auction. Likewise bank also cannot be said to act against if no settlement papers are available when settlement has been done and borrower is discharging its obligation expressly. There can also be scenario when OTS comes to an end due to non compliance by borrower. OTS's have always been viewed as conditional agreements by courts and they have refused to accept that each borrower would get an absolute right to claim settlement/rescheduling.
This is why BK Singh Advocate checks through the sanction letter and receipt copy along with notice from bank regarding default before suggesting that you will be able to stop the next bid in auction.
What SARFAESI Procedure Must a Bank Follow Before Auction?
The above mentioned statutory obligations cannot be defeated by OTS.
For instance with regard to immovable secured property, Security Interest (Enforcement) Rules 2002 are very elaborate with respect to taking possession, getting valued, fixing of reserve price and sale of secured property.
Under Rule 8 talks about sale of immovable secured property. It states that before sale you need to get value estimate from an authorised officer / certified valuer and fix a reserve price after discussion with secured creditor. Rule 8(6) stipulates giving notice to borrower by way of serving a notice as per format provided in rules. As per rule 9(1) if sale is happening for the first time then the sale shall not take place until completion of stipulated period which is 30 days from the date of sale notice/ publication of sale.
So borrowers cannot avoid their liability through OTS in case of improper sale/auction.
They would not be able to show proof that they mailed OTS to bank to prove invalidity of an auction in most cases.
However they can check our Verified Complaint For SARFAESI Act Legal Defence if there is any issue related to possession, value estimation, fixing of reserve price, service of notice, manner in which sale was done or any other issue pertaining to SARFAESI.
Can a Borrower Approach the DRT Before the Property Is Sold?
Under section 17 of the SARFAESI Act the aggrieved person which could be the debtor can approach the concerned Debt Recovery Tribunal with an application. Usually such application will be made within 45 days of the said step against which relief has been sought.
Whether or not you'll get an interim stay from the proposed auction is entirely dependent on the facts and circumstances of the case. The state of play of the petition and grounds as well as past orders will also determine this. Its not wise to assume you will definitely receive a DRT Stay.
Typically you would have to establish some sort of defect/grounds which will allow you to take it up with the Debt Recovery Tribunal. Make sure you have all your documents in place when approaching them. You could use the OTS as your basis for facts but simply having a OTS application pending will not be sufficient reason for the DRT to issue an injunction.
If you wish to take up the matter with the DRT urgently then feel free to contact me and I will take a look at the sequence of events leading up to the step against which you have an objection.
Documents and Evidence Checklist
In case the borrower is informed about auction when his request for OTS is under process he must make sure that he has hard copy of all the papers. Usually loose paper work creates debate of what has been asked/requested , assured or accepted.
A Loan Settlement Lawyer would normally check the following:
- loan sanction letter and loan agreement
- security/mortgage made by the borrower
- Loan Statement
- Any notices/communications received with regard to NPA if applicable.
- Communication as per 13(2).
- Response/Object raised by borrower against 13(2) communication and Banks reply if any.
- Notice of possession under SARFAESI.
- Sale/E-Auction Notice.
As always oral assurance is no assurance unless its made by the person who can actually approve your concern "we will stop the auction dont worry".
When Should You Consult a Lawyer About a Pending OTS and Auction?
When legal steps can come into the picture is after normal collection activity has passed.
You should take guidance as soon as possible when an auction has been scheduled. Possession taken. Bank will not take your OTS payment. Settlement you have been approved for is now being revoked or there may be an error in your case.
No communication is also something to look out for.
If you have offered to settle your dues and the bank has not responded to you but SARFAESI clock is ticking don't think everything is alright.
BK Singh can determine whether your situation leans more towards settlement. Sarfaesi. Litigations in DRT's. Execution of settlement you have signed or all of these factors.

May draft/settlement letter, send legal notice to bank, look into OTS once approved. Check for recoveries that have been sent and file a petition if required.

Frequently Asked Questions
1. Will bank be able to auction my property if OTS is filed?
The bank cannot hold off its SARFAESI process just because you have a OTS application pending. If bank agrees or court grants you some forbearance then maybe yes.
2. Do I get an automatic stay if I file an OTS?
No. As soon as you submit a proposal to the bank you have applied for settlement. You don't get a stay on account of it.
3. Can the bank refuse to accept my OTS and proceed with auction?
Definitely. It's solely up to the bank whether they want to accept your OTS or not. Based on various factors they will decide if they want to negotiate with you.
4. What if my OTS is accepted by the bank?
Once the bank approves your OTS it becomes very important to know the conditions laid down by them. Like how much time they have given you to pay. What will be considered as default. Or if they can go ahead and recover at the same time.
5. Can the DRT stay off auction if I have an OTS?
The DRT may give you relief. There are many reasons on which they could give you a stay. Simply filing an OTS will not result in stay.

First thing you must do is gather all the notices issued to you under SARFAESI, Correspondence with the bank on OTS (if any), Documents pertaining to your loan account, history of payments etc. Do not wait for bank to come back to you on OTS.
7. Bank told me they won't go ahead with the sale.
Make sure you get something in writing from the bank. Its always better to get something in writing saying they have cancelled/postponed/sale on abeyance.
8. Can a bank cancel an OTS that was approved by them?
If you fail to adhere to the terms laid down by the bank. They can definitely cancel your OTS. Most times they will do it if you do not follow the timeline they have given you to make payment. But it completely depends on what you have agreed to.
9. Can I challenge the sale if there are errors in the SARFAESI process followed by bank?
It all depends on the situation. But if the bank did not serve you proper notice or if there was any error while doing valuation/reserve price or conducting the sale. Then you can go to DRT and challenge it.
10. When should I talk to a lawyer?
If the bank has informed you of a date of sale, seized your property, if you have applied for an OTS but haven't heard back or if bank is taking action to recover even after sanctioning a OTS and giving you terms to comply.
Conclusion
Just because there is an OTS pending won't prevent a bank from proceeding further with its SARFAESI recoveries and hold an auction. It would purely depend on what stage of recovery proceedings the Bank is at, OTS terms sanctioned (if any), Bank's response in writing to Borrower, Borrower has made payments as per OTS (if any) and whether any interim relief was granted by any forum.
So don't rely on oral promises made or assume that when your negotiating to settle your loan it means the auction is on hold. Do get all documents regarding OTS and SARFAESI notices if your auction date is nearing.
