Why Is Expert Drafting Important for Filing an NCDRC Appeal?

State Consumer commission order passed against you. Now your brain will say “Should I file an Appeal”. Well technically speaking it’s not that easy.

You can’t simply file an NCDRC Appeal and put forth all your contentions which you presented before the state. You have to find the error which can be challenged before the National Commission and how exactly does your issue come in the angle of filing an appeal. And this point comes into the picture where you require GOOD legal drafting.

If you happen to be a consumer / home buyer / insurance policy holder / patient / investor or businessman and have received an order against you or your company from the State Commission. There could be a huge amount involved if you are a consumer/home buyer. You might be stuck since years with your grievance and might be going through a bad phase financially. If you own a Company then there might be a huge monetary liability which has been imposed on you and your company by that order. In such a situation your appeal has to be drafted in a way which you can put forth your case better in front of the court.

Consumer Protection Act 2019 provides you the provision to file an Appeal against the orders of State Commission before National Consumer Disputes Redressal Commission as is provided under section 51. There are various aspects which you got to keep a check on while filing your appeal. Limitation being one of it. You also have to see if your matter comes under Section 51(2) which talks about substantial question of law and whether you need to deposit any amount as per statute.

These are some questions which cross BK Singh Advocate mind when his clients approach him after receiving an Order from State Commission. Is my appeal filing under the correct section. Did we keep a check on Limitation. Are all my issues which I want to be filed can be fit to be filed as an appeal. What about my record. Is there a requirement of me depositing any amount?

Why Does NCDRC Appeal Drafting Matter in 2026?

When you have received an order from the State Commission against you and it’s not in your favour you will instantly think of filing an appeal. But what you will be confused about is HOW to file an appeal.

National Commission is also a statutory body which hears all Consumer cases. They entertain Appeals under Consumer Protection Act 2019. There are certain Appeals which can be filed against the Order of State Commission as provided under section 51. The Jurisdiction of National Commission is provided under section 58.

You can’t place each and every grievance you have against the Order of State Commission in front of National Commission. You need to analyze what type of Order you want to Appeal against.

If the Order which you have received was passed by State Commission after hearing your Appeal then you can file your Appeal under Section 51(2). But that means you have to convince National Commission that there is a Substantial Question of Law involved in your case. Along with you mentioning what that question of law is in your Memorandum.

As BK Singh Advocate, when I receive a order and strategize my drafting I ask myself, Under which section am I filing my Appeal against the Order.

What Documents Should Be Reviewed Before Drafting an NCDRC Appeal?

Depending on your case there are certain documents which you will have to go through along with your advocate. Mostly you would be needing the order passed by State Commission and all those documents which led to such order.

Basic documents which are required before filing an Appeal

  • Certified true copy of order passed by State Commission
  • Consumer Complaint .
  • Copy of written statement or reply filed
  • Any affidavits and evidence filed
  • Documents which were relied upon by parties
  • Any application filed before them along with Orders
  • If any Notice were issued, copy of Notices
  • Any correspondence (if any)
  • Copy of bills, receipts and proof of payment if made
  • Copy of Contract/ Warranty / Services Record
  • Medical Records, Insurance. Bank or any other documents which might have been relied upon in the matter
  • Orders of relative nature which affect your cause.
  • Copies of documents which will help you prove your ground of appeal.

There are some basic documents which I just mentioned which you must know. It always helps when you know what are the documents which will strengthen your case in filing an appeal.

When we receive our client’s documents for analysis at BK Singh Advocate. We often come across that what the client thinks they have before the State Commission during the proceedings is different from what’s actually there.

Documents might be missing. Evidence which you might have thought was Marked was never Marked. Correspondences you might have missed attaching.

The Evidence and Affidavits in the record can become important when assessing what was actually placed before the State Commission.

How Should Legal Grounds Be Structured in an NCDRC Appeal?

Your grounds have to be clear enough for the other party and the commission to understand what your contention is against the order.

One way to do this would be to point out what Finding / Order has been made by the State Commission, How you believe they were wrong in making that finding or ordering such and how that error affects your cause and how doing the opposite will remedy your grievance.

If your dispute is regarding Jurisdiction, Limitation, Evidence or findings from your consumers contract. Make sure to draft on those grounds.

Keep your grounds specific, it will make your legal argument look better.

When Should You Consult an NCDRC Lawyer?

Legal review is usually sought when a party has received an order from the State Commission (usually an adverse order) and wishes to file an appeal to National Commission.

Don’t hesitate to consult an attorney just because you have not yet received all of your documents from the State Commission. Often times, the initial review will inform the client what records are missing and what dates should be double-checked.

You should consider consulting with an attorney about the judgment/order of the State Commission if:

  • The order is adverse and you would like to challenge it.
  • The limitation date is approaching.
  • Monetary relief has been granted.
  • Order involves a substantial question of law.
  • The order was passed by the State Commission in appeal.
  • The proceedings were ex parte.
  • You believe material evidence was not considered.
  • You are unsure whether you should appeal, file a revision or pursue some other remedy under the statute.
  • The record is voluminous and/or technically complicated.
  • Different attorneys have handled portions of the proceedings in the past.

BK Singh Advocate will review the order and any documents you provide and inform you of the statutory remedy available.

Before proceeding, parties may also need to consider NCDRC Timelines and Hearings, particularly where limitation and hearing-related preparation are relevant to the matter.
