How Can You Challenge a Wrong Consumer Complaint and Get It Dismissed in India?

Consumer complaints don’t announce themselves before they spring up. One day you get served. A builder gets served notice of demand for refund. An insurer gets notice of allegation that it improperly denied a claim. An online retailer gets notice about a sale that its own computers confirm has already been refunded. Knee-jerk reactions are understandable. Money, attorneys’ fees, reputation and time you’ll never get back that you have to devote to trying to fix the problem are all at stake.

But if your goal is dismissal with prejudice, firing off a form denial or asking for another adjournment isn’t the solution. Dismissal With Prejudice is only achievable where the complaint has a bona fide legal or factual deficiency- jurisdiction, statute of limitation, no consumer status, no proven deficiency or inability to connect the claim to evidence that would be admissible in court. Some complaints are dismissed right away. Others unravel after discovery.

Why Does Consumer Complaint Dismissal Matter in India in 2026?

Consumer complaints cross cities and forums. A consumer in Noida can buy from a seller in Mumbai, insure from Bengaluru and file his complaint in any forum permitted under Consumer Protection Act. The same applies to consumer complaints in Delhi, Ghaziabad, Gurugram, Faridabad, Jaipur, Lucknow, Chandigarh, Ahmedabad, Hyderabad, Chennai or Kolkata.

Consumer complaints also go beyond customer service level issues. An adverse order can direct a defendant to pay refund, replacement, compensation, corrective measure or costs. Non-compliance = more exposure.

What Does “Dismissal” of a Consumer Complaint Legally Mean?

Dismissal means that the Consumer Commission refuses to hear your complaint because it cannot be maintained or because you failed to prove your case. There are various orders and stages of the proceeding in which this can happen. Because many people confuse Dismissal on limitation grounds, Dismissal on merits and Settled cases we have set them out separately.

Your complaint can be thrown out at the outset, thrown out after evidence is seen or withdrawn after a settlement is reached. You want an attorney who will know which result is legally possible instead of making a meaningless promise to “get your case dismissed”.

There are many complaints that will merit dismissal because you were not a consumer, the goods were purchased for a commercial use not covered by the statutory exception, the Commission lacks jurisdiction, the claim is barred by limitation and you have no reasonable excuse for the delay or the complaint papers simply do not allege a deficiency. Which Legal Framework Governs Dismissal of Consumer Complaints?

The principal Act that governs consumer protection is Consumer Protection Act, 2019. Terms such as “complaint”, “consumer”, “defect” and “deficiency” are defined under section 2. Commercial purchases, in general, are not covered (except purchase to earn one’s livelihood through self-employment). Sections 34, 47 and 58 contain provisions with respect to pecuniary jurisdiction of District, State and National Consumer Disputes Redressal Commissions respectively.

Pecuniary jurisdiction is looked at by assessing the value of goods or services paid as consideration, and not the value of high-end demand of compensation that is sought in complaint. Location of purchase and other territorial aspects are taken into account too.

Procedure for filing of complaint, respondent’ s written statement and evidence are given under section 38. Reliefs available if a complaint is successful are given under section 39.

There is a limitation of two years from the date of cause of action stated under section 69. However, admission after the prescribed time limit is allowed, if the forum thinks that there was enough cause for the delay. An objection has to be precise to the facts.

Who Should Seek Professional Consumer-Case Defence?

Frequently Asked Questions

1. Can all false complaints got dismissed at the first hearing?

No. Merely on the other party stating that the consumer complaint is false. The Commission can take cognizance (“Notice”) of pleadings, documents and evidence placed before it. Complaint can be got dismissed only at the first hearing in obvious cases where a jurisdictional/maintainability defect is apparent from the complaint itself.

2. Can complaints got dismissed because I am a business/company making the complaint?

No. Not necessarily. Each case would be determined on the facts. If the purpose of the transaction was for commercial purpose then it is excluded from the scope of the consumer protection laws. However purchase by self employed persons for the purpose of livelihood would not be considered commercial. Also the fact that you are a company/GST registered or issue invoices in the name of the company will not per se determine whether the complaint is maintainable.

3. Can limitation be a ground to get consumer complaint dismissed?

Yes. Unless exempted, consumer complaints must be filed within two years of cause of action as per Section 69 of the Consumer Protection Act, 2019. Complaints filed after two years can be admitted when the complainant provides sufficient cause for the delay which is recorded by the commission. This requires careful legal analysis of the relevant dates and the nature of cause of action (whether it is continuing or not).

4. Does an arbitration clause prevent me from receiving notice of consumer complaint?

No. Arbitration clause will not divest the statutory remedy available to consumers and therefore the consumer complaint need not necessarily be got dismissed because there is an arbitration clause. Further consumer proceedings can be taken up despite such a clause and the agreement would still be relevant to determine jurisdiction, contract obligations, evidence, possibility of settlement and merits of the specific dispute.

5. What happens if the opposite party does not file a reply within prescribed time?

Generally the opposite party is given 30 days to file their written version, which can be extended by the commission by not more than 15 days. If this time frame is exceeded, the defence shall not be recorded. Therefore it is important that the date of service and date of filing be ascertained at the earliest.

6. Can a consumer complaint got dismissed because it is settled?

Once settled, the complaint is either going to be withdrawn or disposed of with the terms being recorded by the Court. Technically it should not be dismissed but deciding the facts and ordering dispute resolution is very close. That being said, if a settlement is reached it is important that dates of payment, performance of certain duties, release clauses (future claims barred), consequences of default etc. are clearly mentioned and agreed upon before you let the consumer complaint being withdrawn.

7. Can Consumer Complaint be defeated due to non-availability of evidence?

Yes. The complainant has to prove that there were defective goods, deficient service, unfair trade practice or violation of some consumer right by way of placing before the commission reliable evidence to prove their claims. That being said, the opposite party simply cannot dump documents before the court and ask the court to prove. The defence has to be coherent in their records. Merely asking the court to believe that the complainant has no evidence on particular facts within knowledge of the defendant will not help you specifically deny those facts.

8. Will I have to personally appear if the consumer dispute is against my company?

No. Personal appearance would depend on direction of the Commission, nature of allegations, stage of proceedings and whether they have to lead evidence. Generally the company would be allowed to be represented by an appropriately authorised person/advocate and your personal appearance would not be required at every hearing. However the Commission can direct you to appear in person at any stage of the proceedings.
