How Can Consumers Understand NCDRC Hearing Process and Case Proceedings?

NCDC hearings can seem overwhelming when you first pick up your cause list. Reference numbers, multiple party appearances, lawyers written submissions, procedural orders – even the seasoned practitioner gets headaches. If you’re a consumer, however, you’re probably worried about more basic questions: what happens on hearing day? What are the important documents? And what do I need to do now?

If you know what to expect at NCDRC hearings and how cases progress before they reach the hearing stage, you can avoid some common mistakes. Matters will be listed for admission, directions, miscellaneous applications, final hearing, execution, review or for some other procedural purpose. Your gameplan for preparing leading up to each stage will vary.

If you’re based in Delhi NCR or anywhere in India and your consumer dispute involves a high enough claim value or your State Consumer Commission order is ripe for appeal or revision, you’ll be appearing before the National Consumer Disputes Redressal Commission (“NCDRC”).

As a Court of law, NCDRC has unique procedures. It is not your typical civil court. First, it is a special quasi judicial consumer forum. Second, while the Indian Contract Act and Indian Civil Procedure Act may still apply, its procedures are governed primarily by the Consumer Protection Act, 2019 (‘the Act’) and rules made thereunder.

One mistake consumers and professionals make is showing up to a hearing only to learn that the matter is listed for some purpose other than arguing their side of the story. Each hearing will be for a specific purpose: notice/admission, directions, final arguments, etc. Even NCDRC’s listing orders these days reflect this structure with headings such as fresh admission, admission after notice, directions/miscellaneous, final hearing, review application etc.

With NCDRC Lawyers, we will have hopefully called or emailed you in advance to begin preparations. Cramming through your documents once you receive the hearing notice is not ideal. You’ll need to read the case file beforehand carefully and thoroughly: beginning with the pleadings, all of the evidence, any orders passed, down to the listed applications and objections, even including the relief sought.

So, prepare accordingly and know what stage of litigation your case is actually in.

Why Do NCDRC Hearings Matter in Delhi NCR and India?

Let’s start with location. The National Consumer Disputes Redressal Commission has jurisdiction throughout India allowing consumers and businesses located across India to invoke its jurisdiction. But why would a consumer (or business) in Delhi, Noida, Gurugram, Ghaziabad, or any other city in India care about a proceeding at NCDRC?

To the consumer in Delhi, Noida, Gurugram, Ghaziabad , a proceeding at NCDRC could mean millions of rupees. A dispute with a builder over flats, delayed insurance claim, banking dispute for wrongful dishonor, hospital refusing to acknowledge medical negligence, defective goods or services you purchased from a vendor; any of these consumer claims can involve large amounts of money and piles of paperwork.

At NCDRC Lawyers, we understand how to manage the practical aspects of appearing at NCDRC. Each stage of the litigation before NCDRC requires an understanding of where the matter procedurally is, knowing how to organize the documents based on what’s at stake at that stage and tailoring your submissions based on the issues that the Court must determine for your case.

Also, NCDRC has a Head Office in New Delhi and Regional Benches at Kolkata, Mumbai, Chennai and Guwahati. However, now disputes are filed in NCDRC as per pecuniary jurisdiction directly. From the Head office different benches have been allocated to entertain cases based on places and also on subject matters.

The work of the Commission is discharged through Benches. A review of the NCDRC’s current Listing Directions will show that different Benches have been allocated to hear matters belonging to certain categories or instituted in particular years.

As a result, depending on the Bench where your matter is assigned, the practice for attending hearings for any particular case will differ.

Preparing and appearing at NCDRC isn’t just about Delhi location anymore. Filing documents, checking case status, even procedural communications will all happen online meaning you will have to manage electronic records. The NCDRC has various online filing services as well as case enquiry services for consumers and lawyers. That being said, the rules of the Commission allow for appearances by authorised agents at the NCDRC as well as written submissions.

Quick Facts About NCDRC

  • Central Consumer Protection Act, 2019 is the main legislation that lays down the constitution and jurisdiction of NCDRC.
  • The Consumer Protection Act, 2019 extends to the whole of India.
  • Article 58 gives original, appellate and revisional jurisdiction to NCDRC.
  • Appeals from State Commissions and orders passed by Central Consumer Protection Authority can be filed before NCDRC.
  • NGT and Supreme Court are superior courts to NCDRC
  • The pecuniary jurisdiction of NCDRC is ₹ crore.

What Happens During NCDRC Case Proceedings?

As we alluded to in the title of this section, proceedings at NCDRC will not all occur in one hearing. Depending on the type of proceeding your case is (original consumer complaint, first appeal, revision petition, execution matter, review application, transfer application, or any other application or proceeding), there are various stages that an NCDRC case will go through in its lifetime.

Filing and Scrutiny

The proceeding obviously begins with the appropriate filing and any supporting documents required. Defects in procedure or filing can be cured at the scrutiny stage.

Keep in mind that per NCDRC’s latest practice directions, both scrutiny and listing are considered substantive stages of a proceeding. Particularly when it comes to matters belonging to special categories mentioned in the practice directions.

Admission and Notice

During the admission stage, the Bench will decide if the matter is admitted and notice is issued. Just because you have an “admission” date before NCDRC doesn’t mean that the Bench will decide the entire dispute finally that day. A party should know whether the matter is for fresh admission, admission after notice, or finally for hearing.

Directions and Interim Applications

The bulk of listing dates will be for purposes of the Bench issuing directions. During this stage, the Bench is likely to dispose of applications, verify documents, check if/documents have been served on the opposite party, review pleadings and compliance with any previous order or make miscellaneous direction(s) to move the case forward.

This is where having an organised case file becomes important. Ideally, you (or your lawyer) should be able to quickly identify (1) what previous order needs to be complied with, (2) what is the current status of compliance and (3) what relief is being requested from the Bench.

Final Hearing

Finally, it’s time for final hearing. By this stage, both sides are typically asked to argue their substantive legal and factual case based on pleadings and evidence already before the Court.

Keep arguments concise and on point as to the issues that must be decided. A long recital of facts does not make for a compelling argument. Focus on pleading each material fact and tying it to the legal issue as well as the relief requested.

Order and Further Relief

After hearing arguments, the Commission will either pass order or reserve judgment depending on the facts of the case and procedures applicable. Once an order is passed, the next steps will depend on the type of order passed.

For instance, Section 60 provides limited power of review of its own orders on the grounds of error apparent on the face of the record. Typically, an application for review must be filed by a party. Section 61 allows for setting aside of an ex part order passed by NCDRC. Section 67 specifically talks about appeals from orders passed by NCDRC to Supreme Court subject to statutory provisions.

Identify what further remedy is available from the order actually passed by NCDRC. You cannot assume every order that doesn’t go your way at NCDRC is appealable to the Supreme Court. That will only lead to avoidable setbacks.

What Documents Should You Have Ready for NCDRC Hearing?

Consumer work is document heavy. Create a simple chronology that actually works. Refer back to it. The more you prepare beforehand, the smoother the hearing will go.

Documents you should have ready will vary depending on the matter at hand. Some general documents NCDRC Lawyers will go through before any hearing include:

  • Copy of complaint, appeal or revision petition filed at NCDRC.
  • Written statement/version filed by opposite party.
  • Any affidavits and evidence already filed before the Court.
  • Invoices/bills, payment confirmations, bank statements.
  • Copy of agreement, allotment letter, insurance policy, warranty card or service contract.
  • Email chains, Letters and even WhatsApp chats (if relevant).
  • Any legal notices sent and their replies.
  • Order of District/State Commission in the previous stage.
  • Any expert reports, medical records or Technical Institutions (if any).
  • Proof of service and filing related documents.
  • Any pending applications filed before NCDRC.
  • Order sheet and Cause-list copy showing latest entry for the case.
  • Any settlement discussions (if legally permitted to be disclosed/sent to Commission).

If there are multiple consumers involved, ensure each consumers details are correct. Name, date, amount and claim should tally between the pleadings and proof.

How Should You Prepare for an NCDRC Hearing?

Your preparation for each hearing begins with the last order passed by the Court, not the initial complaint.

Your lawyer should prepare a brief factual chronology of the events. Ideally every significant date should be tagged to what document in your record.

Taking our earlier examples, a builder-buyer dispute could start with a booking amount, agreement, payments made, promised date of possession, follow up correspondence, delay in possession, refund demanded, proceedings initiated below NCDRC etc.

An insurance matter would have completely different set of events. (Policy, Incident occurred, Claim sent to insurance, survey process, insurance repudiates claim, subsequent correspondence, etc.)

Your preparation should finally answer the question: What remedy is the consumer claiming? Does the consumer want a refund? Compensation? Interest? Something else? Where in the documents can you find this? What are the legal provisions that support your claim for this relief.

When to Consult a NCDRC Lawyer?

Assistance from a lawyer is useful when the matter is already pending at NCDRC or you’ve received an order from State Commission against you. Legal help is useful when limitation may be an issue or when significant monetary claims are at stake.

Consider speaking with a lawyer when:

  • There is a significant documentary record for the case.
  • Matter is listed/admitted for final hearing.
  • The opposite party has filed a jurisdictional objection.
  • You intend to file a revision petition against an order.
  • An order has been passed against you ex part.
  • You want to file a review application against an order.
  • There are execution problems after you’ve received an order.
  • Similar proceedings are pending before District / State Commission and NCDRC.
  • You have multiple consumers involved in the dispute.
  • There are multiple defendants or the opposite party is a company/insurance company represented by an army of lawyers.

You don’t have to travel to Delhi just because your matter is pending there. If you’re outside Delhi NCR we can save you unnecessary travel by first talking to you. Appearing in person on the first occasion is rarely necessary. Oftentimes reviewing the record, advising on available remedies and helping prepare the papers can help your case more.

A business could be preparing to defend themselves and corresponding documents/legal written submissions. An individual may just be preparing to claim a refund, compensation for deficiency of services or unfair trade practice or asking the NCDRC to enforce an order.
