How Can Residents Take Legal Action Against Pollution Through the National Green Tribunal (NGT)?

Pollution makes life unbearable but if living in conditions of dirty roads is chronic, water sewage is filthy, there’ Fly dumping near your residence, untreated effluent runoff into bodies of water, dangerous waste dump sites or any ongoing activity that is harming the environment then you might actually have a legitimate legal claim. But is every pollution related claim able to be filed at the National Green Tribunal (NGT)? Unfortunately not. When NGT Comes to Mind?

NGT stands for National Green Tribunal. NGT is its own special forum and whether or not the NGT will hear your claim depends on what type of environmental dispute you are experiencing, what environmental laws might apply to your situation, what evidence you have gathered (if any) and what you hope to achieve by filing a legal claim. The Principal Bench of NGT is located in New Delhi, India and there are currently zonal benches located in Bhopal, Pune, Kolkata and Chennai.

Since NGT is located in India I get asked a lot of questions from residents living in Delhi NCR about the NGT and its ability to help with pollution problems in Delhi NCR or India as a whole. The questions I think you need to ask as a resident of Delhi (or any city for that matter) isn’t just “Should I approach NGT?” but “Is my complaint serious enough for NGT to hear?”, “What evidence should I be keeping?” and “Why should I need to hire an experienced environmental lawyer?”

Lets take a look at each question.

Why can pollution become a legal matter heard by NGT in 2026?

Well if your pollution concern can be heard by NGT it usually means your case involves a substantial question relating to the environment and the matter falls under the jurisdiction of the Tribunal. When the NGT was enacted, it was created to enforce legal disputes that revolve around the environement and arise under the enactments listed under Schedule I of the NGT Act. The NGT can be empowered to provide relief and compensation for you and your neighbors regarding environmental damage.

Your individual concern as a resident may be due to seasonal smog pollution from an industrial process, companies releasing untreated effluents into bodies of water, contaminated lakes/rivers, mishandling of hazardous waste, illegal activity violating the environment or continual destruction of nature.

Lets focus on Delhi NCR for a second. Because neighborhoods usually involve graded societies/body corporates, municipal corporations, RDAs, developers, industries, construction sites, Pollution Control Boards, or some type of government body we represent. Your case can become more complicated when involving these parties but it all comes down to the facts of the case.

As an individual yes you can file a case against pollution in NGT. However, you can ONLY file before NGT with the right type of case. According to the NGT’s FAQ’s on their website “Any person seeking relief and/ or compensation for environment damage, which falls within the jurisdiction of the Tribunal may approach the Tribunal.

A Legal Representative (Advocate) is not mandatory to file an application before the Tribunal.” – National Green Tribunal

But this doesn’t mean you can file every neighborhoods dispute at NGT. You should always have a lawyer review what you plan to file or think you can file with NGT. An environmental lawyer should look over what you’ve told him about your pollution concern and see if the pollution raises a substantial question relating to the environment, whether NGT has jurisdiction, what statutes would apply to your specific dispute, if there is a better authority for your claim and if you have enough material to prove what you are saying happened is true.

If your lawyer reviews your case and feels NGT is not the correct forum to approach your legal matter then I would suggest you find a new lawyer.

WHAT TYPE OF POLLUTION COMPLAINTS SHOULD YOU CONTACT AN NGT LAWYER FOR?

If you meet the above qualifications then your NGT lawyer can assist you with ANY TYPE OF CASE that has caused damage to the environment (ie. Air Pollution, Water Pollution, Land Pollution etc.). But here is a list of some examples:

These are just some basic examples of pollution related cases. Each case can be handled differently depending on what your specific legal concern is. If you truly feel you have something that can’t be handled by normal courts then you may want to speak to someone about your legal rights.

WHAT LAW(S) Applies to NGT Pollution Claims?

Your pollution claim will mainly deal with National Green Tribunal Act. This is the act every NGT lawyer needs to focus on when dealing with your matter. Section 14 explains the Tribunal will hear any civil case where a substantial question of law or fact with respect to the environment arises as the result of the enforcement of any Act mentioned in Schedule I. We can see from Section 15 that the tribunal may grant relief and compensation to any person for:

  • Damage to his property
  • Harm to his health.
  • When can I apply to NGT? – Section 18
  • Applications and appeals to be filed to NGT. – Section 20 Specific principles to be followed by NGT – India Code

Just because your neighbor may be breaking the law, doesn’t allow NGT to treat your case like a regular Civil Court where every neighbors dispute can be solved. You have to keep remember

NGT Will Only Focus on the Statutes Listed under the NGT Act

Factors to consider before you hire a lawyer for your pollution concern:

  • Type of pollution concern – Air /Water/Soil etc.
  • What environmental statute does your situation fall under
  • Cause of Action
  • Limitation
  • What you want to happen
  • Type of evidence you’ve gathered. Pictures, Videos, Inspection Reports, Medical Documents

There is a lot more that goes into your specific case and only you know what you want to happen about your pollution concern. But please keep in mind that if you have a legitimate concern then it needs to be handled by a professional.

WHAT SHOULD YOU DO BEFORE CONSULTING A LAWYER ABOUT POLLUTION?

Gather Evidence. PLEASE DO NOT create evidence. Take pictures, video log your complaints you’ve made, keep any letters you’ve received, get lab work done(you know what you’r dealing with. ), any notices you receive about pollution in your area, pictures of inspector visiting location, notices from your council or building society or documentation about what you believe is happening.

HERE ARE SOME OTHER QUESTIONS YOU SHOULD THINK ABOUT BEFORE SPEAKING WITH A LAWYER.

  • Where exactly is the pollution happening?
  • What type of pollution do you believe is occurring? Dust, Smog, Water, Land
  • When does it happen? Is it continuous?
  • Who are you going to have to deal with? Your neighbor? Builders? Municipal corporation? State Environment Department? Who is the possible polluter/authority you may have to deal with?
  • Have you made any previous complaints. If so, what was there response?
  • Is it affecting people, your property, animals, a body of water or nature?

Don’t worry you don’t need to sit down and write down your answers. But please these are some things you should know before speaking with a lawyer. Again, taking notes will help determine if you even have an actionable claim against your polluton concern.

WHAT KIND OF DOCUMENTATION CAN HELP WITH NGT POLLUTION CLAIMS?

Similar to above. Since every pollution case is different we have no specific document list that applies to every case. Some cases will need to speak to a lawyer first to even figure out:

  • Who the applicant is/ What Address will be used for Applicant.
  • Pictures
  • Video
  • Previous Written Complaints
  • Correspondence you may have received from your authority or CPCB
  • Any Communication from PCB
  • Inspection_sample_taken report
  • Lab_report (if any)
  • Consent Documents if applicable
  • Notices you may have sent to suspected polluter
  • Medical bills or documents relating to your cause of action that involve injury to you or your property.
  • Map/Photo of Polluted Area

CAN I File a Complaint to Authorities First?

No, you don’t always have to file a complaint with the authorities first. Now this may be beneficial for some cases because you’ll want to file a complaint with your local pollution control board or municipality but some cases may need you to gather other facts.

I said FILE COMPLAINTS won’t solve your case. What will help is building a rock solid Factual based case that allows you to prove your claims whether it be NGT or some other court of jurisdiction. Only you and your lawyer can determine if you have enough to file a legal claim or not.

HOW CAN A LAWYER HELP WITH MY NGT POLLUTION CASE?

Hiring BK Singh for your NGT matter can assist you when dealing with these types of issues. If you don’t want to type up your own letter on various websites and mail it hoping for help then you should contact someone about your legal rights and what you can do about your pollution concern.

BK Singh and his team of environmental lawyers can assist you with the following:

  • Explain your issue to you what type of pollution you may be able to seek relief for.
  • Go over any documents you may have.
  • What laws would apply to your situation.
  • Determine if NGT is even the right authority to hear your dispute and most important…
  • How you would like to proceed.

BK Singh and his staff can even prepare your application/petition for you if that is what you would like to do. They can go over:

  • What documents would be required/ annexures would be needed.
  • What legal grounds YOU can proceed on and etc.

Remember, we will not promise you the world. No firm can guarantee you any orders from court. All we can do is make sure YOUR issue is properly represented before the right authority.

WHAT HAPPENS AFTER YOU CONSULT WITH BK SINGH FOR YOUR NGT POLLUTION CASE?

BK Singh will want to know EVERYTHING about your pollution situation. Usually clients come to us and explain what happened. Where did it occur? When has it been happening? What have you done about it? Your attorney will go over all documentation you have and begin his legal research. If we believe you have an NGT case then paperwork will be prepared.

BK Singh will want to know if you have an NGT petition already filed. If you are on appeal, what relief are you seeking? Environmental damages? Rehabilitation? Compensation? What statutory relief are you looking for?

Then the Tribunal can order the concerned Statutory Authority to file a fact and action taken report before the Tribunal or refer the matter to experts in these fields for any of the above cases.

Okay enough legal jargon. Once we have enough we will either set up a free consultation to discuss your matter further or prepare your application/petition.

CAN NGT ORDER ANYTHING I WANT THEM TO?

Yes and No. If you have an NGT case then yes the tribunal can order relief, compensation and restitution. You have read this before. Section 15 of the National Green Tribunal Act 2010 deals with compensation, relief and restitution. The tribunal has the power to give any direction to the respondent and any other person or authority to:

  • Restore the environment which has been damaged by the act of that respondent.
  • Stop any further pollution or damage to the environment from happening.
  • Award compensation or restitution to you.
  • Pass orders on the concerned authority/body to take certain actions.
  • Give any other directions with respect to the restoration, preservation and improvement of the environment.

NGT can order just about anything you can think of when it comes to your pollution concern. But remember, because you MAY be entitled to something doesn’t mean NGT will order the relief you want.

Nobody can predict the future. Only the NGT can base their decisions on the facts, evidence you provide to your lawyer and decide if they have jurisdiction over your case.
