How Can NCDRC Provide Relief Against Execution of a State Commission Order During Appeal?

Orders by the State Consumer Commission can be for refund of a substantial amount of money, payment of compensation, delivery of possession, removal of deficiency or compliance within a certain time. Filing an appeal to the National Consumer Disputes Redressal Commission is only one component of a party’s legal concerns. One much simpler question: Does the order remain enforceable while the appeal is pending?

Yes. The NCDRC can provide interim relief from a State Commission order through the proper appeal. But merely filing an appeal does not automatically stay execution. It is normally necessary for the appellant to separately apply for an interim stay and the National Commission will either allow or deny that request depending on the facts, type of order and law.

The main concern often arises where the State Commission order directs refund of funds by a builder/developer to a homebuyer, payment of claim by an insurer, payment of compensation by a hospital or other substantial payment of money by a business. Time can be lost if the appellant gives up rights by voluntarily subjecting themselves to execution proceedings after deciding against applying for stay. On the other hand, filing an immediate request for stay will not buy the appellant more time to decide what it wants to do.

Why Does an NCDRC Stay Matter in Delhi NCR and Across India?

Orders passed by State Commissions have instant monetary/commercial consequence. A developer operating in Delhi NCR may receive a refund order due to dispute with homebuyer. An insurer operating out of Mumbai may be asked to pay up a claim. Orders for compensation/hospital to comply with certain instructions. Orders passed by Consumer Forums operate as decrees and affect finances/commercial dealings immediately.

While Consumer Protection Act, 2019 provides for statutory mechanism for appeal, it is important to understand that filing an appeal is not a stay of the order. Appeal is only a challenge to the order. A Stay order prevents operation/ enforcement of the order (to the extent as directed by NCDRC) temporarily.

What Is the Core Legal Issue in an NCDRC Stay Application?

An NCDRC stay of State Commission order essentially is akin to relief sought at interim stage i.e. during the pendency of hearing of the appeal before National Commission. It is not sought at that stage to dispose off the appeal finally. The sole question which is sought to be decided at this stage is whether the impugned order shall operate completely till the appeal is finally disposed off or till further orders or execution shall be suspended in part only.

It is at’this juncture that most clients are misguided about the applicability of the rule of depositing 50% of the awarded amount. Mere by making a statutory pre deposit, appellant does not become entitled to stay as of right.

The Apex Court has while dealing with these two aspects has differentiated these issues from each other. It has affirmed the discretionary power of NCDRC to grant such conditional stay as it thinks fit and has further observed that factors like Prima Facie case, balance of convenience and irreparable loss are factors which go towards deciding the question of granting interim relief.

1. Can NCDRC stop execution of order passed by State Commission while appeal is pending?

Yes. NCDRC has power to grant interim stay against State Commission order while hearing an appeal. But filing appeal itself does not prohibit continuation of execution proceedings. Commission can grant or refuse interim stay or grant with conditions based on facts of case, urgency of matter and nature of orders passed.

2. Will my appeal before NCDRC automatically stop execution?

No. Only filing of appeal before NCDRC will not suspend order passed by State Commission. You may have to file separate application for staying order. Till the time interim stay application is processed, successful party will try to proceed with execution. Happens all the time in refund cases/insurance compensation cases/builder-buyer disputes/other monetary claims.

3. Does deposit of 50% amount itself means NCDRC has granted stay against State Commission order?

No. Condition to deposit 50% amount upfront as per Section 51 is completely different from filing application for interim stay. Paying deposit will only help relevant appeal to be admitted in NCDRC but will not stay execution of order. Request for interim protection is analysed/ 

4. Does NCDRC can ask me to deposit more than 50% amount if it wants to grant stay against State Commission order?

Yes. If NCDRC wants to grant conditional stay against State Commission order, it can ask you to deposit higher percentage than the required 50% from parties. In some cases NCDRC can even ask you to deposit entire amount as condition precedent to grant of stay. Conditions should be decideable on facts and cannot be arbitrary. Reason must be mentioned.

5. How long do I have to file appeal against order of State Commission?

You get time of 30 days in general to file appeal before NCDRC as per Section 51. Extension is granted in case of delayed appeals if sufficient cause is mentioned for delay. So better keep checking the date on which you or your attorney received State Commission order. Don’t leave it for last few days to file appeal.

6. Shall I wait till I receive notice of execution then ask NCDRC for stay?

No. You wouldn’t want to wait till execution order is actually sent against you and proceedings initiated because by that time it would be more urgent/conflicting situation procedurally. If State Commission order demands you to make a payment/start compliance from day 1 itself, then it is advisable you chill and plan your appellate route/stay option at the first instance. 7. Can NCDRC grant me stay without any conditions?

No. NCDRC has discretionary powers when it comes to granting interim relief/stay. Therefore it can’t be presumed that NCDRC would grant you an unconditional stay. Factors such as stronger prima facie case in your favor, balance of convenience, risk of irreparable loss to you if stay is not granted, condition of deposit being satisfied and nature of order passed by State Commission would be looked into before granting any interim relief.

8. Can all orders passed by State Commission be challenged before NCDRC in similar manner?

No. Nature of appeals would be different if State Commission had passed the complained order in Original jurisdiction or Appellate jurisdiction. Certain appeals have to compulsorily contain substantial question of law. Nature of Order and complete sequence of events need to be understood before deciding proper NCDRC remedy and strategy.

9. What documents shall I carry if I have to meet NCDRC lawyer for urgent stay related advice?

Copy of State Commission order/compliant (if filed in written version)/all affidavits/evidence produced/respondent’s written statement/agreements/invoices/payments made/received/order/correspondence.
