How Can Homebuyers Take Legal Action Against Builder Fraud and Service Deficiency?
Buying a house is usually one of the biggest purchases you will ever make. Problems often begin for home buyer families after making the booking amount payment. You may experience delay in possession, promised amenities may not be provided, construction may be different from what you agreed to or the builder may simply not listen to your repeated requests and complaints.
Fraudulent behavior and deficiency in housing services by builders can include misleading acts or practices, failure to provide promised services after sale, substandard construction, delay in handing over possession, unfair contract terms or any other failure or shortcoming in connection with the sale of a house. A “deficiency” under Section 2(43) of the Consumer Protection Act, 2019 also includes any fault, imperfection, omission or failure in quality, nature or manner of performance of any service required to be performed under a contract or otherwise.
Don’t lose your cool and start abusing the builder when faced with a home buyer dispute against builder. Keep all your records intact. The allotment letter, agreement for sale, payment receipts, brochure, email/Whatsapp conversations, notices of possession, photos of the defects and an inspection report are just some of the documents that can serve as vital evidence later.
Home buyers also had the wrong idea that a complaint can only be filed against builders under RERA or one can only approach Consumer Forum. The legal position is Supreme Court has held multiple times now that RERA and Consumer forums are different remedies independently available to home buyers. So whether you can approach one or both forums would depend on the facts of your case and what kind of relief you require.
Book a free consultation with BK Singh Advocate to understand, in the event of a serious dispute with builder, what documents would be important, what remedy you would have and where you can file the complaint. Remember, proper record keeping is what differentiates a rant from a valid consumer complaint.
Why Do Builder Frauds Matter in 2026?
Home loan EMIs and rental payments should not be your concern when you buy a house. Sadly, housing disputes can involve much more than just the sale price you agreed to pay. If the builder delays your project, you may have to pay EMIs and rent until you get possession. Unprovided amenities or construction defects also reduce the utility value of your house.
Delhi NCR home buyers can find themselves in disputes arising out of apartment purchases, group housing or site housing projects, plotted developments and even commercial or mixed use projects. Similar problems have been faced by home buyers from Lucknow, Jaipur, Mumbai, Pune, Bengaluru, Hyderabad, Chennai and other growing Indian cities.
The Consumer Protection Act of 2019 provides for Consumer Commissions to adjudicate consumer disputes. RERA on the other hand provides for a separate mechanism and remedies with respect to real estate projects.
Book a consultation to understand which forum you need to approach if the value of dispute, nature of relief and location of property leaves you wondering whether you should file a consumer complaint or opt for RERA.
Quick Guide on Builder Consumer Disputes
Delayed possession can form the subject matter of a consumer complaint if the facts establish a deficiency or another legally recognised ground of complaint against the builder.
“Deficiency” is defined under Consumer Protection Act under Section 2(11).
RERA Section 18 deals with return of amount and compensation for certain defaults with respect to failure to complete or handover possession.
Section 31 of RERA deals with Complaint to Real Estate Regulatory Authority or adjudicating officer, as the case may be.
For pecuniary jurisdiction, read Consumer Protection Jurisdiction Rules, 2021. Basically, District Commissions have jurisdiction where the value of goods or services and consideration paid does not exceed ₹50 lakh; State Commissions where such value exceeds ₹50 lakh but does not exceed ₹2 crore; and the National Commission where such value exceeds ₹2 crore.
Limitation to file a consumer complaint is typically two (2) years from when the cause of action arises. Please refer to Consumer Protection Act for specific provision relating to extension of limitation on account of delay. You can also review the limitation and delay condonation service for matters where limitation requires examination.

Can RERA & Consumer Complaints Be Filed Against Builders?
Yes. Consumer Protection Act and RERA are independent laws which were enacted for the benefit of consumers. The Supreme Court has clarified that both statutes can be used together.
Actual courses of action available would depend on facts. If your dispute is specifically about promoter related obligations or about the project registration or possession or interest or compliances or other matters then RERA would have better application.
Irrespective of which law applies, Buyer should avoid filing parallel proceedings for the same matter. Not only would it cause unnecessary expenses but also procedural complications. BK Singh Advocate can analyze your dispute and advise whether to file a consumer complaint or RERA complaint.
For homebuyers dealing specifically with builder and property-related consumer issues, the Real Estate Consumer Cases service provides a dedicated route for such disputes.

What Should You Do Before Filing a Builder Complaint?
Casual messages may seem cute when you are receiving them but delete them at your own peril. Oral assurances are hard to prove. That is why it is best to reduce every promise and agreement into writing.
Make a timeline of events from when you booked and made payments until the promised date of possession. Note the date of any material communication, whether possession was given or not and if and when you complained. Keep copies of all notices sent and received. Now decide what you actually want. Are you a buyer who wants possession of your home or someone who wants to bail out of the project and get a refund? Do you have major structural defects that will require a technical opinion?
BK Singh Advocate can review your timeline and ascertain what else you would require before filing a complaint. The NCDRC filing process guide can also help you understand the filing-related route.
Before proceeding, the appropriate forum and pecuniary jurisdiction should also be examined. The NCDRC pecuniary jurisdiction service is relevant to this aspect.
FAQs
1. Can I file a consumer complaint against builder for delay?
Ans: You can file consumer complaint if you are a consumer as defined under the Consumer Protection Act and the facts of your case establish deficiency or another ground of complaint that is permissible under the statute. The agreements, promised date of possession, correspondence with builder and current project status would have to be analyzed.
2. Give examples of deficiency in housing services?
Ans: Deficiency means any fault, imperfection, shortcoming or inadequacy in quality, nature or manner of performance of any service required to be performed under the contract or otherwise. Negligent conduct or omission to act and non disclosure of information are also considered deficiency.
3. Can I directly file complaint in NCDRC against builder?
Ans: The Consumer Commission which has jurisdiction would depend on the Rules in force at the time of filing the complaint. As per Rules of 2021, complaints cannot be filed with National Consumer Disputes Redressal Commission (“NCDRC”) originally if the value of goods or services and the consideration paid together does not exceed ₹2 crore.
4. Can I ask builder to return my money?
Ans: You can ask the builder to refund your money if the facts are such and the law applicable to your facts allows for a refund. Under RERA, Section 18 also allows for refund of amount paid by home buyers along with interest and compensation in certain situations where the promoter either cannot complete the project or is unable to give possession of the property.
5. Should I file complaint under RERA or Consumer forum against builder?
Ans: We cannot give a straightforward yes or no answer to this question. Consumer forums and RERA are different forums provided by law to address grievances of home buyers. The Supreme Court has clarified that there is no reason why a consumer cannot approach both forums in a suitable case. Based on your documents, the relief you require and the existing procedural status of your case, you will know what needs to be done next.
6. What are the necessary documents for complaint against builder?
Ans: Depending on what you intend to complain against builder for, you would require-documents to support your claim. Decide what exactly you want to allege against builder and relevant documents will follow.
7. Can we claim compensation against builder for mental harassment?
Ans: Each claim for compensation has to be examined on its own facts and the law applicable to those facts. Consumer forums do not grant compensation because the opposite party did not fulfill their contractual obligations. Mental harassment is a term that has to be proven by submitting facts. Consumer forums do not entertain claims for compensation in every dispute just because you have suffered an inconvenience.
8. My builder is not responding to my complaint letters. What should I do?
Ans: Prove that you did send them complaint letters and either keep a record of their responses or prove that the builder refused to respond to your letters.
