Can Companies Be Forced to Comply With Consumer Court Orders in India?
Yes. A favourable consumer court order against a company is NOT just a beautifully worded piece of paper. If the Company does not comply with the order’ instructions relating to refund/compensation/interest/replacement/possession/ or some other relief awarded by the Consumer Commission, then the consumer has the right to request that the Commission ‘execute’ the order.
Execution of a consumer court order is typically where most consumers lose their patience. You have battled with your complaint for months or even years. You receive a favourable order but the company doesn’t pay up. You send email after email but are ignored. The company’s branch office keeps telling you that they have sent the matter to their lawyers. Maybe they will give you a part-payment…
At this stage it can become about fighting your consumer complaint from a whole new angle. Execution the consumer court order.
Representation can be especially useful at this stage. The terms of the order, time allowed for compliance, any appeal filed/stay granted, and the exact amount due are just some of the aspects that need to be reviewed together. Advocate BK Singh works with consumers to help them understand their options and determine what legal action should be initiated. No unrealistic promises.

Why Does Execution Against a Company Matter in 2026?
Orders for refund/ compensation cannot succeed unless the company honors the order.
There can be delays in redressal in cases against builders, insurance companies, defective goods, bank services, hospital complaints, travel grievances, e-commerce businesses and various other consumer grievances. Sometimes with their individual branch offices, Corporate offices, Legal Cell and Accounts Departments it becomes too much for the common man to follow up post issuance of the order.
BK Singh can help you ascertain whether the order is executible immediately or the company has paid a part amount if there is a stay or an appeal filed against the order by the opposite party.
Save precious time by getting such orders analysed within the time-frame by Consumers from Delhi NCR and elsewhere in India. Don't waste months doing the unnecessary correspondence after you've received the favorable order.

Frequently Asked Questions

Yes. Orders of Consumer Commission against companies are enforced using Section 71 CP Act in instances where the order has not been complied with. Exact mechanism would differ based on the relief granted by the Commission, timeline provided to comply with order, appeal pending/stayed or otherwise etc.
2. Company not following consumer court order?
If the order against a company by Consumer Commission is final and binding, it needs to be followed unless enforcement is sought. Section 71 deals with execution of orders and Section 72 deals with consequences of non-compliance with orders. Speak to Advocate BK Singh about reviewing the judgement/order, any amount paid and details of appeal/pending (if any) before taking any further action.
3. Company file an appeal against execution?
Filing an appeal against order does not mean that you cannot go after execution. The question is whether the appellate forum has passed a stay or any other order which prohibits enforcement. Advocate BK Singh can review the appeals filed and stay orders to determine how best to proceed.
4. Consumer court order to refund amount from company?
Consumer Court orders are certainly capable of being enforced. 5. Directors liable for consumer court order not paid?
Not exactly. Often times a company and its directors are treated as separate entities. Whether the directors of a company can be held personally liable for orders passed by the Consumer Commission will depend on the facts. Against whom was the action originally initiated? What is the language of the order? Reading the judgment is required before making any demands on directors in their personal capacity. Advocate BK Singh can assist you in reviewing the judgment.
6. Builder company not obeying consumer court order?
If a Consumer Commission has passed an order against a builder company which is pending compliance, an Enforcement application can be filed. Whether the order was for refund of money, compensation, delivery of possession or some other relief, the company is required to comply with orders passed by the Consumer forum. Continuing non-compliance can become contempt justifying enforcement, unless a valid appeal or stay or subsequent order has been passed by a higher forum.
7. Insurance company not following consumer court order?
Technically, no. Nobody should disregard a Consumer Commission order that applies to them. If you’re a consumer and the insurance company has not paid you the compensation ordered by the Consumer Commission, then you should look to initiating enforcement proceedings against them. However, ensure that you take a look at the judgment/order, verify payment history if they’ve claimed payment, whether an appeal has been filed and if a stay has been obtained before approaching Advocate BK Singh.

9. Consumer court order execution is Section 72?
No. Section 71 deals with execution of orders passed by Consumer Commission whereas Section 72 deals with consequences if such orders are not followed.
