What Is Bank Auction of Residential Property?
Bank auction of residential property means when your property which has been mortgaged against loan with bank or financial institution is sold off by bank to recover the loan which has not been paid by the borrower. The borrower has rights on the property until it is legally recovered as per the laws.
Many assume that if they don’t pay EMI’s, bank can just sell their mortgaged house whenever they want. But thats not true! There are numerous procedures including mandatory notices, requirements of possession of property linked with loan and separate auction proceedings as per law that bank has to comply with.
Once security interest is created on an asset, enforcement of the same is governed by Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act). This law is usually applicable for secured loans. Meaning where a security interest is created against the asset, the secured creditor has power to enforce the same.
Exceptions are always there where loan account is disputed between the borrower and bank on the grounds of wrong account classification, notices served/not complied with, calculation of dues, challenge in ownership, or wrongful procedure adopted by the bank.
Legal Framework for Residential Property Auction Cases
Bank laws related to recovery against properties include:
- Indian Contract Act, 1872
- SARFAESI Act, 2002
- Recovery of Debts Due to Banks and Financial Institutions Act, 1993
- Civil Procedure Code, 1908
How Does SARFAESI Act Affect Bank Auction Sale on Properties?
Under SARFAESI Act, once the asset is mortgaged as security against loan, the secured creditor can enforce its rights without filing a civil recovery suit. This special law is usually initiated by banks for secured loans that are eligible for SARFAESI process. This is done when the borrower has defaulted on the loan.
Eligibility of the loan to be covered under SARFAESI Act is checked when the bank account becomes NPA as per banking norms. Bank sends a demand notice u/s 13(2) of SARFAESI Act asking borrower to clear the dues within the specified time period.
If borrower doesn’t comply with the demand notice, bank / secured creditor can initiate recovery action u/s 13(4) of SARFAESI. This allows banks to take possession of the security asset.
Now, any person aggrieved by the actions initiated u/s 13(4) can file an application before the Debt Recovery Tribunal u/s 17 of SARFAESI.
Whether you can stop bank auction or not against your property depends on facts and circumstances of each case. Also, the availability and success of any remedy would depend on various factors such as:
- Nature of default
- Validity of notices served u/s 13(2)
- Loan Documents. Legal title of the borrower
- Whether POSSESSION has been given or not.
- Stage of POSSESSION.
- Stage of Aution.
- etc. Compliance of legal procedure by bank.
Should I use Debt Recovery Tribunal (DRT) for Bank Auction disputes?
If any person/borrower is affected by any action initiated under SARFAESI, he can challenge the same before Debt Recovery Tribunal (DRT). But this can only be done if the borrower believes actions taken for recovery were not in compliance with law.
Please understand that filing a case in DRT is not like visiting a cancellation office. DRT will examine whether the acts of creditor were legal on the basis of the documents/facts placed before it and provisions of law applicable to the facts.
Owners selling property via auction should not trust anyone by believing their promises or having talks and not putting it on record. When it comes to bank recovery, everything should be in writing. Only if a things are in writing, will the tribunals hear you.
Know how to search for Debt Recovery Tribunal (DRT) lawyer to represent you at the right forum and at the right stage.
