What Evidence Is Needed to Stop a SARFAESI Auction in DRT?

They could’ve been paying you EMI’s for the last couple months and suddenly get a bank auction notice. You have an e-auction happening tomorrow. Stop SARFAESI Auction. Your home or industrial property or store. Office complex or farmland etc..

Where ever you derive income from for your business. Now you’re wondering how can you stop a SARFAESI auction?

Understanding what evidence you can submit in front of the Debt Recovery Tribunal to stop your bank auction is important.

What you should understand is that having an evidence checklist to stop SARFAESI auction in DRT will force you to collect documents. Which will allow you to explain to the DRT what the secured creditor did. When and where the secured asset stands in the statute. Why the secured creditors actions as prescribed by the SARFAESI Act should not be allowed to proceed, or is improper as per the Act & Rules.

That could make all the difference in the world.

Many borrowers walk into my office with a few loan documents. Some borrowers only have the bank auction notice and their property related documents. While others think because the auction price is low they’ll be okay. Or because they were talking to the bank to settle their loan.

Although all that information is great you always want to try argue your DRT matter on a statutory grounds.

Any person may prefer a complaint to the Debt Recovery Tribunal against any action taken under section 13(4) within 45 days of such action.

Yes you read that right. Any Person can file a complaint with the DRT knocking on the banks door for not following procedure.

BK Singh Advocate represents clients dealing with SARFAESI issues & DRT matters. So if your a borrower or guarantor and your property is about to be sold by the bank reach out to us.

By gathering this information we can establish to the DRT if the secured creditor made any mistakes during the process of enforcing their security interest.

You want to stop an auction you better start gathering this information ASAP.

Why You Need Evidence For Stopping A SARFAESI Auction

In 2026.

Ok lets clear that up. As mentioned above there are several steps during the SARFAESI process. Once the debt account qualifies under certain parameters the secured creditor can initiate action under section 13 of the SARFAESI Act.

A borrower will typically receive a demand notice under section 13(2) from the secured creditor. The borrower is then given 60 days to clear their loan. Else action can be taken by the secured creditor under section 13(4) of the SARFAESI Act.

Which can then lead to bank auctions and taking possession of your property.

If your a borrower reading this and feel like you can stop the bank from taking possession of your property. Or stopping an e-auction then you will need evidence.

You can’t just say “The bank wasn’t willing to negotiate” or my property isn’t worth that much. Or “we were in talks with the bank about settling this loan.”

I have put together a list of things to lookout for if your bank has sent you an auction notice.

BK Singh Advocate will analyze every step your loan account has gone through. From when your loan was approved to your receiving that dreaded possession notice. All the way to tomorrow’s e-auction date.

Your Loan Documents

If your wondering why your bank auction or possession should be stopped. There could be many reasons why.

Maybe your bank never gave you a proper possession notice. Perhaps the bank has undervalued your property. Or your property isn’t even described correctly on your loan account. Information on your account could be wrong etc.

These are some examples I have encountered as a DRT lawyer. No matter if your located in Delhi NCR or anywhere else in India you will need evidence to present to the DRT. To get a bank auction stopped..

Gathering evidence quickly can be great especially if you’re in a time crunch to stop a bank auction from happening.

Lets see What Evidence You Need To Stop A SARFAESI Auction

Under the SARFAESI Act. Below I’ll explain every step of the SARFAESI process. And why you need evidence if any of these steps were mishandled by your bank.

After receiving notice under section 13(2). The secured asset can be taken into possession by the secured creditor. And your property can be sold off via auction if the bank follows each step correctly.

You can file an application under section 17 of the SARFAESI Act against actions taken by the secured creditor. During these measures if you believe the bank has not followed the Act.

As stated above, if your immovable property is being auctioned off by the bank. You would have had to have received a Notice of Possession by the bank. After you receive the Notice of Possession you should receive a Sale Notice. Giving the bank permission to sell your property at a public auction.

If you receive a Sale Notice you better make sure you have all the information about your upcoming bank auction. Under Rule 9, no immovable property that is being sold by the bank can be sold before the 30 days provided in the Sale Notice.

You should also make sure your mortgage was registered on CERSAI website. If your mortgage was not registered with CERSAI you can approach the DRT. Because section 26D states all mortgages must be registered with CERSAI. If your mortgage wasn’t registered the secured creditor cannot take any measures under chapter III of the SARFAESI Act. Which includes sending you notices, taking possession and selling your property.

Filing a Securitization Application to your local DRT will NOT stop an auction.

How Can Evidence Stop A SARFAESI Auction?

Visit our Property Auction Stay Lawyer page to learn more.

If the Debt Recovery Tribunal understands that there was a mistake made when your bank took action against you. You may have your auction stopped from happening.

You’ll have to show proof to the judge that your secured property was not handled according to SARFAESI. If you feel that your bank did something incorrectly during their enforcement.

Example: Let’s say your property that is undergoing SARFAESI action is being sold by the bank for too cheap. You feel you should of received a higher auction price because of this.

You’ll need proof that can prove to the judge your statement is valid. If you’re thinking photos of your property will get the job done. Think again.

Photographs can help but what I would do is request a recent valuation that i can compare to the banks valuation. (If the bank even provides you a valuation). Also get a description of your property from the bank auction notice. And why the bank chose the auction price they chose.

If someone says ” The bank never gave me a possession notice.” What I would want to see is that envelope they received it in. Photos, anything could help prove that statement.

There are 2 types of evidence you’ll want to gather if you’re looking to stop a SARFAESI auction.

Evidence that proves a transaction took place between you and the bank.

Evidence that can help prove your statement that the bank did something illegal to your secured asset.

Keep in mind the DRT does not care about your situation. They have laws to follow and will only grant you a stay if according to law – they feel its suitable.

Documents Needed To Stop SARFAESI Auction In DRT:

Here is a list of documents that can help stop your bank auction. This isn’t everything you’ll need to stop an auction. But these documents can help you validate if your bank followed every step of the SARFAESI Act.

Loan Documents:

When you applied for your loan and got approved. There were many documents you’ve received and probably tossed away. I know I am guilty of this as well.

Try to find your original loan approval letter and any documents that changed your loan agreement. Such as loan amendments if there were any.

You can cross verify what the bank is saying to you. With what you were originally told when you got your loan. Example: How much loan was approved? Who all is on the loan? What was your interest rate at?

Here are a few loan documents to look for..

  • Loan Applicatio
  • Facility Letter
  • Loan Account Repayment Schedule
  • Loan account restructuring or enhancement if any.
  • Loan terms. ( Interest rate & repayment details)
  • Any letter provided to you that changed your loan repayment terms.

These loan documents can also help you make sure the bank auction notice matches your loan agreement.

Property & Mortgage Documents:

Did the bank give you proper notice of what property they sold? If a mortgage was created on your property you’ll want to see the document. If your bank held the Title deed to your property. Pull out that document along with your mortgage and property description.

The bank auction can be stopped if they are selling the wrong property. Or if they listed the property wrong on their auction.

Make sure you get every document that describes what property was pledged to the bank.

  • Mortgage Documents
  • Property Description
  • Bank Auction Notice
  • Title deed (if the bank held it)
  • Any sale deed you created when you purchased the property.
  • Survey Numbers

Account Statement

Next would be your loan account statement. Make sure you get the full account statement. Don’t just show the court random pages of your loan account.

Ask the bank for a copy of your account statement. If that doesn’t work log into net banking and print out the entire statement. Now you can cross verify what the bank has been demanding from you. If part of your loan account is incorrect. Highlight that area and point out what you don’t agree with.

Will this stop your bank auction? I’ve seen cases where the loan account had incorrect information. Which helps us argue to the court why your bank auction should be stopped.

If your loan account is off by 10 rupees then no. That’s not something we can argue will get your auction stopped. But if you hire BK Singh Advocate we can analyze your loan statement and make that determination for you.

Demand Notice from the bank:

This goes under loan documents but your demand notice is something you should keep. I cannot stress this enough. As mentioned this is one of the most important documents you’ll need to analyze. For your matter in DRT.

Keep the entire notice how ever you received it from the bank. Include the envelope your notice came in. If you got a notice via post make sure to note the post office information. Did you get a notice via email? Print that email out and keep any forwarded emails.

Write down the day you received your demand notice. If this is the first time your hearing about your loan account something might of happened that day.

Your Representation to the bank:

After you receive your demand notice you have every right to write to the bank and explain your side of the story. Once you’ve sent in your representation to the bank. The bank has 15 days to reply if they accept or deny what you said in your letter.

Don’t just tell the judge you wrote your bank a letter. Show me copies that you sent something to your bank and they received it.

Get back of receipt if your representing via post. And email printouts if you emailed your bank.

The bank can either accept what your saying is correct. Or inform you why your wrong within 15 days of receiving your bank repayment. We will need a copy of that response if your bank happens to send you one.

BK Singh Advocate can go over what your bank had to say about your representation. And if the bank made any mistakes during this process.

Possession Notice:

If your bank has taken physical possession of your property. They would of had to have sent you a Notice of Possession. Because your property is immovable the bank can’t just show up without proper notice. Make sure the bank gave you a proper Notice of Possession and it lists what they where possessing.

Under Rule 8 of the SARFAESI Act. Your bank is to provide a copy of the Notice of Possession to you. And affix a copy on the secured asset they where taking possession of. You will also receive 2 newspaper papers published within your Notice of Possession. One of them needs to be in the local language of where your property is located.

Documents You Should Have If Your Property Is Being Auctioned By The Bank.

  • Notice of Possession.
  • Envelope you received the notice of possession.
  • Photos of the notice of possession on your property.
  • Copies of the newspapers that were published about the Notice of Possession.
  • Photos of your property. ( Helps establish where your property is at if the bank took possession.)
  • Any communication you’ve received since the bank took possession.

Once you receive possession of your property you should immediately take pictures of the dates and times. If the bank took possession of your property. They could of already done a PAN chnama (translation: Taking stock of your property by the bank). You’ll want those documents if your bank completed that for your property.

Stopping Your Bank Auction Once and For All!

If you think the bank auction is unfair we may be able to stop your SARFAESI Auction..

Below I’ve mentioned all the important documents you need to stop your bank auction. These are not all the documents you’ll need. There is plenty more evidence you could use to fight your bank auction. But these are good starting documents to help you validate your auction..

Bank Auction Notice

First things first you need that bank auction notice. Again it should go without saying but show me the entire bank auction notice. Clients will sometimes send me a picture of their phone with the bank auction notice displayed. Please send me the full download of your auction notice if possible.

Under Rule 8.6 you have specific information that must be on the bank auction notice. Since your selling an immovable property there are certain things you’ll want to look for when the bank sends you an auction notice.

Does your loan description match the property they where selling? For example on my bank auction notice it showed my fathers name. And I was the borrower on my loan. Something like that will definitely get brought up to the bank.

How did the bank come to the decision to set this auction price? Did they even provide you a valuation of your property?

Does your bank auction notice list any liens on your property? If there are make sure the bank listed them on the auction notice.

How much money does the bank say they’re owed? Does that match up to what your loan account shows on the auction notice.

When is your auction taking place? Did you get proper notice of your bank auction?

Did you bank provide you an Earnest money deposit section on your auction notice?

You bank should of published your auction in local newspapers as well.

Rule 9 discusses more about selling your property under a public auction. And what procedures the bank must follow to make sure you receive your bank auction notice.

If you have any questions about your bank auction feel free to contact us. At BK Singh Advocate we will analyze the date you received possession. To determine if the bank acted improperly under the statute..

OTS Will NOT Stop A Bank Auction

An OTS (One Time Settlement) will not stop your bank auction from happening. People tend to think just because they have money to settle with the bank. That your bank won’t auction them off to the highest bidder.

The bank spoke to you and said they would like to discuss OTS with you. You immediately went and submitted an OTS to the bank.

Just because you sent an OTS and your bank hasn’t denied you yet. Doesn’t mean you’re safe from getting auctioned off.

As long as you can prove to the court that you have evidence of an OTS been discussed. We can use that to our advantage during your DRT hearing.

No documents means we’ll never know and your argument could be unsuccessful in front of the judge.

Make sure any communication you’ve received about your OTS is in writing. I would rather see a piece of paper than you telling me you spoke on the phone.

Documents that Show An Emergency To Stop Your Auction

If you want the Debt Recovery Tribunal to fight for you and stop your auction. You have to show them there is an emergency to stop your auction.

Make a list of all your notices and dates. Including your bank’s auction notice. If your auction is being sold online take screenshots of your bank auction website. Any newspaper notices or emails can be saved and emailed to BK Singh Advocate.

If you can legally obtain this information your bank bids on your property would help too!

Make sure to have those possession documents I mentioned above. Since the bank has already took possession of your property. They could of did a PANchnama on your property. (Notice i took stock of my property) Those documents can help us too.

Create a timeline showing when your bank sent you a demand notice. When you sent in your representation to the bank. What date did the bank take possession of your property. And what date will your auction be held at.

This is a great visual to show the judge you need this auction stopped immediately. BK Singh Advocate has stopped many auctions by proving the bank did not follow statute.

If your a guarantor and dealing with a bank auction you should contact us ASAP. Gather up any mortgage documents you have signed. Any loan documents that led up to your bank auction.

Make sure you get that possession notice too! Anything related to your loan and communication you’ve received from the bank can help us.

Guarantors can also stop a bank auction if the proper procedure was not followed. Contact us today if your a guarantor or own property that will be sold by the bank.

Documents That Won’t Help You To Stop An Auction:

Send everything you can to your lawyer.. But here are some documents that won’t help you when fighting a bank auction.

Pictures of you family or how you want to keep your home away from the bank. Although that may help you explain to the judge why you don’t want to get auctioned. Its not going to stop an auction.

Photographs of notices without dates or incomplete information. Never print something off that has editable dates. Don’t alter any documents either.

If you have a document that doesn’t favor you argument. I would rather you show me that then alter it to suit your needs.
