How to File an Appeal Against Consent to Operate Cancellation
You get a cancellation order when your factory is trying to do an emergency delivery. You have salaries to pay. Customers want to know when they can get delivery dates. Operations wants to know if they should keep working. Resist the urge to figure out what you want to do next until you’ve read exactly what the Pollution Control Board wants you to do.
You can file petitions in courts against the cancellation of Consent to Operate. But you must choose the correct remedy depending on which section they used to issue the order. Orders relating to grant of Consent under the Water Act & Air Act are primarily appealed before the appointed appellate authority. Those orders cannot be assumed to be appealable before NGT directly.
Read the order thoroughly. Is it simply issuing a cancellation order or is it also directing you to close? Did the Board order environmental compensation? Does the letter mention a previous inspection, show-cause notice or reply that your company might have submitted in response?
Have these answers at hand before you discuss your litigation options. If you are setting up a meeting with BK Singh Advocate to discuss NGT Lawyers, take a hard copy of the full order instead of just the first page. Or if you have a screenshot of the order, do not alter/zoom out such that the signature block is not visible. Take the email, speed post receipt or the portal confirmation showing that you received it.
Separate these two questions in your mind as you read through the order: Was the cancellation warranted and what do you have to do now to come into compliance? The company may very well fight the Board’s findings and still need to correct a procedural issue with how it runs. But pouring money into fixes doesn’t answer whether or not they followed due process in coming to that decision.
We are here to guide you through your options for appeal, explain the significance of 20-26 consent modifications and how to compile your evidence before you meet with an attorney. Our goal is not to provide hope that you’ll get it canceled. The goal is to help you understand what decision you want to fight so you can hold onto that evidence and not treat an appeal as a mechanism to reopen production.
Why This Matters for Businesses in India in 2026
Shutdown means BUSINESS SUCKS on your owner/operator. Let BUSINESS SUCK dictate how quickly you respond, NOT gather evidence to respond. Make a realistic list of impacted orders, employees and must-do maintenance with your environmental reports. It will allow you to be better prepared when talking to counsel. Quick Facts
- Locate provision: “CTO cancellation” itself is silent over the route of appeal. ct0 cancellation does not mention appeal at all.
- Appeals from Water Act consents: Section 28 Appeals are generally the first appellate relief against orders passed u/s 25,26 and 27. FAOLEX
- Appeals from Air Act consents: The order of State Board is appealable within 30 days of order being intimated to the petitioner at Appellate TECs under Section 31. Pollution Control Board Assam
- NGT time limits are separate: NGT has to pass the Order within 30 days, extendable by another period not exceeding 60 days for sufficient cause. Meg Biodiversity
- Requirement for hearing & reasons to be given: the relevant consent rules also mandate opportunity of hearing & reasons to be recorded while cancelling. Department of Science and Technology
- Demand interim relief separately: Don’t assume NGT’s acknowledgement of papers as authorization to operate. NGT can specifically grant interim relief. Meg Biodiversity
What Does Cancellation of Consent to Operate Mean?
Consent to Operate: means consent to undertake the regulated activity granted under the applicable consent regime with attached conditions specifying how that activity will be conducted and the controls used to minimise its environmental impact. Revocation : means withdrawing that consent. It does not mean rejecting an application for new consent, or amending a condition of existing consent.
Consent to Establish vs Consent to Operate Department of Science and Technology
Consent to Establish / Consent to Operate are also not synonymous with environmental clearance. Consent to establish something should not be construed as automatic consent to operate it, or for other environment clearances required. Digital Sansad
If one order is of revoking consent and second order is for disconnection of electricity then make separate rows for both. Similarly if there is any order asking for environment compensation then make a row for that too. This spreadsheet is made for BK Singh Advocate to know better what reliefs he can pray for. ekalyan31
The practical effect is you don’t pray about one order and forget about the other which is still affecting the premises.
Which Forum Should Hear Your Pollution Control Board Appeal?
Forum 1 is determined by the nature of law empowered, not the extent of business interruption. Consent decisions are typically appealed to the statutory appellate body. Some directions go directly to NGT appeal. Orders from certain appellate-authorities can also be challenged at the Tribunal.
| Decision being appealed against | Usual route |
|---|---|
| Water Act consent decision under Sections 25,26 or 27 | Appellate authority under Section 28. FAOLEX |
| Order by State Board under Air Act relating to consent | Appellate authority under Section 31. Pollution Control Board Assam |
| Direction issued under Section 33A of Water Act | NGT appeal under Section 16(c). Meg Biodiversity |
| Direction issued under Section 5 of Environment (Protection) Act | NGT appeal under Section 16(g). Meg Biodiversity |
| Applicable appellate order under Water Act Section 28 or Air Act Section 31 | NGT appeal under Section 16(a) or 16(f) respectively.Meg Biodiversity |
Just because you might have come across a direction passed under Section 33A of the Water Act being treated in a certain manner, don’t expect the same treatment for a direction passed under Section 31A of the Air Act.
There is no analogous instant appeal under Section 16 of the NGT Act for a direction passed under Section 31A of the Air Act; the appeal has to be filed under Section 31 route of appeal. Pollution Control Board Assam Visit: Orders Composite in nature have to be examined meticulously. Send each page and annexure along with NGT Lawyers, before you get them to draft a pleading so that the prayer for challenge can be suitably tailored
How should you calculate the filing deadline?
The overall limitation of 30 days for first appeal to be preferred under section 28 of Water Act and Section 31 of Air Act is computed from the date of communication of order. The Explanation to both the provisions are identical and mention that appeal after the expiry of the said period may be entertained if sufficient cause is shown for the delay. Delay is condoned at the discretion of the appellate authority.
NEVER forget, with respect to Section 16 NGT appeal, the additional window of 60 days is not automatic and is the absolute maximum limit of condonation which can be allowed. It is not extended as a matter of course to everyone. In the normal course, any extension will be way less than that. Meg: Biodiversity So please keep the envelope, email headers, portal notifications and download confirmations. Note a date stamped receipt of when you got what and who got what.
Ask BK Singh Advocate to work out limitation at the beginning of your consultation. Don't wait till you have spent time and money preparing a detailed technical report for your client. If limitation is at issue, put forward the entire timeline, rather than picking and choosing that date of receipt which suits the business.
How Do You Challenge Consent to Operate Cancellation?
Begin with a full order and chronological timeline. Identify forum and limitation, cross reference each allegation to conditions of consent and gather evidence. Seek advice on what petition to file, if any if Ex parte TRO is needed and what actions need to be remedied simultaneously with the court petition.
Focus on why, not just the decision
Good defense starts with what the Board decided WAS NOT TRUE. Common grounds for cancellation listed in the consent order are violations of conditions, insufficient pollution-control equipment or technology, misrepresentation or failure to provide information and listed payment failures. Carefully read each condition as they are amended by the additions that follow.
Department of Science and Technology. Prepare Yourself. Create a chart with four columns: allegation, condition applies, your response and evidence. Be objective.
If they say your effluent treatment plant is inadequate you grab the permitted treatment design, operating logs and any relevant monitoring reports. Figure out if it’s an issue with the designed capacity of the equipment vs the operation of the equipment vs one sample report vs missing operating logs. They are four separate problems that cannot be answered by saying the plant is running fine.
If the allegation is regarding payment then pull the demand notice, applicable calculation, payment receipt and portal acceptance. If the allegation is they increased production without approval, then identify what was authorized and what records show you actually operated.
Before you meet with NGT Attorneys, mark each issue as proven, disputed or unknown. That is infinitely better than swearing all allegations are either 100% true or absolutely false.
Check whether the hearing process was meaningful
Cancellation under this part shall be subject to the requirement of hearing specified in Section 21(4) of the Air Act. Even the central consent guidelines have been drafted in such a way that refusal or cancellation should be preceded by opportunity of hearing which is reasonable and of giving of reasons in writing to the applicant. By POLLUTION CONTROL BOARD ASSAM To assist you in preparing your response to a show cause notice, or in responding to an order that has been issued.
- Was the notice specific in informing you of the issue that you were expected to reply to?
- Were you allowed access to the documents on which the notice was served?
- Does the order reflect consideration of the explanation and records that you submitted with your reply?
Answering these simple questions can help you identify a potential hearing defect. Evidence that you served your reply. A copy of the reply saved on your computer will not do. Do not fall into the trap of thinking that identifying the hearing defect is enough to prepare your case. Work on the technical response as well. Attach any genuine defect you identify to it.
Carefully validate the facts
Double check names and dates before challenging conclusions. Ensure that the name of the unit, address, date of inspection, sampling point and period and equipment of manufacture cited in the order are accurate.
If you are contesting a laboratory report, get an environmental expert physically evaluate the problem and provide a written report explaining what he observed. Have him specifically differentiate between what the records indicate and what further testing would be needed to confirm.
Send original reports unedited. Submit the entire report, with all its caveats and attachments, not a highlighted copy of the page with the passing result.
Prepare a simple timeline of events for BK Singh Advocate review. Note what was operational at the time of the inspection versus what was repaired or modified after the fact. Do not mix evidence of past operating conditions with subsequent repairs to argue that a machine was operating properly at the time of inspection.
Specify the relief you truly require
Don’t just throw these together. Have counsel confirm that each request is legally available and if separate application or permission is required to consider it. Simply stating that the consent be “restored” is not a statement of relief. Discuss with counsel whether the challenge involves setting aside the orderaltogether, requesting reconsideration after a hearing is held or modifying a particular requirement, etc. The relief available will differ depending on the forum you choose.
Prepare a separate letter addressing immediate operational concerns. Explain whether this is a request to operate, to access the facility to maintain equipment, remove material, conduct an inspection/testing, etc. Explain what safeguards you will implement and what records would support such operation.
Appeal the order separately from your plan for corrective action.
Prepare a dated compliance plan detailing exactly what the perceived non-compliance is, what you plan to do to correct it, who will correct it and by when. Document expenses and work performed, but do not guarantee a technical result before it is determined.
Legal and engineering should be on the same page factually. A repair bill, for instance, should be accompanied by a narrative describing the work performed and what records are available to determine its effectiveness. You should be striving to create an honest, factually consistent story— not a collage of unrelated affidavits.
Can You Obtain a Stay or Permission to Restart?
Apply for specific interim relief. Appealing the order does not automatically stay the order. Read Sections 19 & 20 (see separately) on NGT’ s interim jurisdiction carefully.
In your application for relief, be sure to frame the relief you are asking for in both environmental and commercial risk terms. Section 20 specifically requires the Tribunal to use environmental principles (including precaution and polluter pays principles) in determining whether to grant relief.
For example, instead of simply asking that a tribunal overturn a notice of violation because you want to process material, Megha Guptaa BiodiversityJustice who inspected the facility said it was okay to operate:
- What activity do you want to undertake?
- What controls are you willing to put in place?
- What proof do you have that these would be effective?
- What conditions of supervision or restriction could you live with?
Don't overstate financial harms. If you have records, state what the dollar impact will be. Don't use fuzzy language like "$X per day of lost profits" or vague claims about how many employees will lose their jobs.
As previously mentioned, just because your lawyer filed an appeal, received an inspection or was told "don't worry" by someone, does not mean you can immediately start-up. Get advice concerning what specific written permission or order is required to undertake the activity you propose and read any conditions before you act.
If there is a hearing, ask the judge to give you a written explanation of exactly what is and is not allowed by the operative order. Give a copy of the explanation to the operators on the ground in addition to the attorneys and/or litigation staff.
What Documents Should You Prepare?
Compile all the consents/envclearances/compliance history, correspondence evidence, routes of compliance and any supporting documents regarding reliefs prayed for by the company. Treat this list as a due diligence checklist for discussion purposes. Do not assume that every forum will need these annexures. Please confirm the filing requirements from the intended forum.

Folder 2: Notices and orders:: Inspection notices, show cause notices, replies, copies of hearing notes, orders of cancellation and condonation, compensation demand notices and evidence of receipt/submission.
Folder 3: Technical Evidence:: lab reports, complete set of treatment-system specifications, Preventive Maintenance/Monitoring reports, operating logs, photographs and work order records of corrective actions taken.
Folder 4: Filing and operational specific:: Entity details, details of the proposed official permitted to sign on behalf of the entity, documents related to pending litigations, chronology (dated) of events and any documents that support prayer for interim relief.
Create a Table of contents with dates and description. File names should be standardized. For example, if you reference a report in the chronology you should be able to pick it right up based on the file name.
Include a column called “missing documents”. Clearly indicate if the document was requested. Who does/did have the original? Was a copy previously submitted to the Board etc.
If you have electronic copies of reports, keep the original and a copy of the email/website portal print out. There is no need to retype log books and create new documents retrospectively. Be Honest about the gaps. Ask what you can do to remedy the situation.
Always cross check any new information you plan to submit to an agency against what you've previously submitted. If you discover an error, own it and correct it. Don't submit multiple versions of information.
When Should You Consult an Environmental Lawyer?
Meet before there is even a show cause stage where cancellation is only recommended. Meet after a final order is issued as well. If you are meeting regarding a notice, come WITH the deadline for the response, not by it. Let them know what facts are needed to construct a response.
Set an agenda for your first meeting with BK Singh Advocate that requires yes or no answers. Do we need these documents? What should be included in a technical response? Should we be exploring immediate court remedies?
Call an emergency meeting any time you are notified that a cancellation has been issued, a disconnect/closure has been ordered or when you receive multiple letters that may each require individual responses. Review the entire history of what pending proceedings have taken place.
Meet if there is any confusion among yourselves about the facts. Maybe the plant manager knows one version of what occurred. The consulting lawyer knows something else. Your accounts officer will have yet another piece of the story. Get all the pieces together before giving definitive instructions.
Come to meetings with 5 questions already in mind. What are we asking the court (or body) to rule? Where must we file our response? When is it due? What evidence do we still need to acquire? What must the office do in the interim?
How NGT Lawyers Can Help
Promotes that they can assist you with NGT filings/appeals, PCB notices and "environmental regulatory issues". Sure they can discuss these topics when your business receives a CTO cancellation or other enforcement action brought against it. (ngtlawyers.com)
Ask BK Singh Advocate if the remediation proposed will be analyzed under a document driven framework. Remedies available, Evidence required to prove such a remedy and what compliance efforts are left to be completed should be considered.
Understand and agree to the scope of work before beginning an engagement. Will the legal representation include advice only, drafting/filing, interim applications/appearances or follow up compliance reporting? If technical consultants are needed, understand their fees will be discussed separately.
Inquire how you will receive copies of additional documents and hearing notifications. Designate one person at your business to store the entire case file and communicate with the rest of your operations team if they need instruction. A consultation should give you a better understanding of your options and what they can and can't do. Don't let someone feed you flowery language about their ability to "reopen something" when they mean jurisdiction, evidence and what relief is actually being requested.
Frequently Asked Questions
1. Can I move the Board to set aside a CTO even after it was granted?
Yes. Prior consent does not prevent cancellation when grounds exist now. Consent continuing subject to termination in paragraph 13 of the updated central consent regime; verify which regime was in force when your unit was allowed. Similarly, under state-specific laws. Simpliance
2. Is the Board required to give me a hearing before it cancels my consent?
The Hearing sub-section of that Air Act section and associated consent order guidelines provide procedural safeguards. Read both the hearing notice, right to reply and your submitted reply along with the reason for cancellation. Separately received orders for closure must be reviewed under that statutory provision. Don’t assume all orders must be appealed in the same manner. Pollution Control Board Assam
3. How many days do I have to submit my First Appeal?
30 days from service as a general rule Water Act Section 28 and Air Act Section 31. Both sections permit extensions for “sufficient cause” beyond the normal period. Submit early to have the receipt proof and consult right now rather than believing you can submit after the deadline expires. FAOLEX
4. Do I need to file every CTO cancellation directly with the NGT?
No. Appeal through the pathway for the law that was used against you. See table above and have a lawyer distinguish orders combining findings from different statutes. Do not think you must file with NGT because pollution is involved or your factory urgently needs to reopen. FAOLEX
5. Can I reopen production now that my treatment plant is fixed?
Even if the treatment plant is fixed, you may not necessarily be able to resume production. Get the repairs documented, certified correctly and ask your lawyer if you need Consent to Operate, modification or an interim arrangement. Only resume operations that your consent specifies.
6. If I qualify as an MSME, do I need a CTO at all?
Registration itself is not enough to avoid needing a CTO. Amendments enacted in 20 26 deeming Consent to Establish to have been granted to eligible micro and small units established in certain notified industrial areas should not be construed to mean that no CTO can ever be required of such units. Verify what if any operating-consent and environmental- clearance obligations remain applicable. Digital Sansad
7. What order copies should I send by email to setup a consultation?
Email whatever order(s) you have (full order if possible), the ack. receipt, your existing consent, any notices/replies sent or received and inspection/lab reports. Add a one page timeline describing events and listing of any other proceedings you are aware of. Reference missing documents instead of omitting them because you can’t find the file.
8. Will the NGT direct my unit to reopen if I have a favorable lab report now?
Because you have a report does not mean you can disprove each alleged finding. Get someone with technical expertise to explain what that report establishes and double-check that applies to the reasons in the order. Independently investigate if there was sampling bias, consent conditions violated, production exaggerated or subsequent repairs.
9. How much will an attorney charge to file an appeal?
Ask for an estimate in writing based on your documents. Get this after they review the file. Ask what stages (e.g., appeals, revisions) is included. Court fees, cover charges, future hearings, travel to your unit and technical consultations may be extra. Don’t assume it will be only ₹2000 because someone else offered “a pollution appeal” for that price.
10. How should I prepare to meet with BK Singh Advocate?
Prepare a file with dates for every order and related document which is still effective. Clearly list if the unit is running or not. Write what specific questions you want answered urgently and who can follow up for more records if necessary.
Additional Information: Final Thoughts
When filing an appeal against a Consent to Operate cancellation it is advantageous to know which order you’ re appealing, save what you received and file the challenge in proper forum. Don’t let the urgency to reopen obscure common sense. Objectively distinguish what the Board alleged, what your records show, what you dispute and what has already been conceded. Tailor any request for reopening to the evidence and do not ask for permission to do something else.
