How Does Advocate BK Singh Assist With MSME Payment Recovery Cases?
It's never fun when a small business can’t get their payments. You have payroll to make. GST to pay. Suppliers to pay etc. More than likely your customer will tell you they will pay you by another date and nothing will come of it.
If you operate a Micro or Small Enterprise. This nonpayment can be deadly to your business.
An MSME Payment Recovery Lawyer will help you understand your outstanding invoices, agreement, PO's and delivery challans etc. What forum of recovery would apply to you. And help you recover your payments through Notice, Discussions, MSEFC Forums, Arbitration or even Commercial Litigation.
We have had clients that have been passed due Invoices. Supplies of goods/services that have been disputed. PO's that have gone unpaid. Services provided that have not been paid. Even retention amounts withheld. What a lot of people fail to understand is. Instead of wanting to know if you can sue your buyer. You want to know what are your options to recover the money you are owed. And what do those options actually have based on your documents.
The buyer says we received goods but we aren’t happy with the quality. The buyer says yes we received your invoice but we had to clear your invoice with our 3rd party. You operate an MSME registered business. What if you were supplying goods prior to becoming registered.
These are all scenarios that come into play. Which is why when you speak to an MSME Lawyer about your case. We will need to see any documents related to the sale. Prior to moving forward with any litigation.
No matter if you operate in Delhi NCR, Noida, Ghaziabad, Greater Noida. Gurgaon, Faridabad, Meerut, Lucknow, Jaipur. Mumbai, Bengaluru, Hyderabad, Chennai or even Kolkata. When your business has buyers that owe you payments. It can cause major setbacks to your business instead of just that one payment not being paid.
Why Do MSME Payment Disputes Matter in India in 2026?
If you have ₹5 lakhs or ₹20 lakhs stuck up in outstanding invoices. As a small manufacturing/ trading/ service company. That's like your working capital for several months. And everyone just keeps chasing the other person on phone/friendly mode. Because no one wants to harm the commercial relationship.
But here's the BUT-
Details get missed over time. The person who worked on the deal leaves the company. You lose emails. Buyer decides to dispute things which they didn't dispute earlier at the time of delivery.
BK Singh will analyze the commercial dealings between you and your customer. There is no obligation that we start harassing them the moment you contact us. We can send a demand letter. Try a friendly settlement or ask you to reconcile the dues which might commercially make more sense.
If you fall under Micro and Small Enterprises category there is a provision under MSMED act also. If your invoice is overdue section 15 says that payment shall be made due within a period of 45 days from the date of receipt or deemed receipt of goods/services. Interest can be claimed under section 16. And dues can be recovered under section 17.
Also sometimes location of your supplier matters. If you are supplier from Delhi selling to Mumbai then that's one scenario. But if you are a supplier from Noida selling within Noida that's different. These are some of the things which needs to be analyzed rather than jumping into conclusions.

What Is the Core Legal Issue in an MSME Payment Recovery Case?
The main point to be understood here is that the money has become payable because goods were supplied and / or services were rendered. And now what remedy do we have to recover the said money.
Simply perusing the Invoice will not help us.
The Advocate needs to verify if the goods were supplied or services were rendered. Whether Invoices were accepted or objected to. Whether any Credit Notes were issued. Any part payments made. Purchase orders will become relevant also along with payment terms on contract.
If we plan to file a Statutory Claim against MSME then another factor is whether that entity was an MSME i.e. Supplier at all for purpose of transaction for which you want to apply MSMED Act.
BK Singh Advocate will first verify when was the MSME/ Udyam registration done by the supplier and match that with date of purchase order, supply, invoice and date of default. You cannot say that I got registered afterwards so it will cover my previous supplies also.
This could alter your remedy entirely.
You may still be liable to file a Commercial suit, or Arbitration or may still have to go with contractual remedy to recover your dues.
Can Every MSME File an MSEFC Recovery Claim?
Nope. Making it into an MSME will not solve the question posed here.
Predominantly, whenever Chapter v comes into play, its MSME's which have certified themselves as Micro & Small Supplier. How are they registered? When were they registered? What kind of Purchase Order took place?
If a person supplied a machine in year 20XX and become registered under MSME after few months and now they want to claim benefit under this law. What would your answer be?
Same case could be applied to buyer stating that supplier hasn't completed the job as per agreement. or Material was not up to the mark. These cannot be validated just by producing an unpaid invoice.
So things Advocate BK Singh can look into before-
- If its a Udyam registration and when was it done.
- Purchase order / quotation which was accepted.
- Deliver/ job completion.
- How was payment supposed to be made and was any conversation had in between.
- If any objection was raised at that time or when they begun the recovery process.
These are some points which can help you decide not to waste your time by taking legal action under this law which will be irrelevant to your case.
What Documents Are Needed for MSME Payment Recovery?
Lot many payment disputes are decided on what your books say.
You will need your commercial documents from where MSME Lawyers can build up their case. Apart from just uploading invoices which are unpaid.

Even if it looks tiny never ever delete such messages. You might have an Email from customer saying they are liable to pay 8 lakhs. It would be more helpful than calling them ten times.
BK Singh Advocate would be able to relate this information to your case.
What If the Buyer Disputes the Goods or Services?
Buyer's defence needs to be analyzed on case to case basis.
There may be genuine cases where it is true that the goods were returned at the time of delivery or some milestones were pending as per contract.
But there are many cases where this is quoted when you keep on asking them for money.
Your lawyer can analyze when was the issue of quality raised as compared to date of delivery and what were the previous acts of buyer. If they have accepted it and paid some amount then those can surely work against them.
BK Singh Advocate can also look for any clause of inspection period mentioned in contract, how the acceptance will be done, any warranty clause etc.
So the defense from buyers statement doesn't mean that we start trusting them but understand the situation according to the documents.
Can an MSME Dispute Be Settled Without Full Litigation?
Yes.You may also get some liquid cash instead of dragging on with lengthy litigation,if you settle.
If your vendor is facing a problem with one of their customer from ages back who owes them Rs.18 lakh. Customer is ready to pay 14 Lakh and denies paying the balance because of shortage. Then you could think of settlement if a satisfactory agreement is reached which is realistic and a proper settlement deed is prepared.
But take precautions while entering into out of court settlements.
I will pay you the full amount next month is not sufficient.Settle with knowledge of what you are settling.Make sure how many installments will be done.If there are defaults what would be the interest applicable. If there are any ongoing proceedings, is the agreement of settlement on full and final basis of the dispute.
BK Singh Advocate can help you settle and also protect you with a safety net if the other party does not honor the settlement terms.
