How Can an NCDRC Lawyer Help with a Restoration Application?
Watching your consumer matter get dismissed due to non-appearance on a date assigned by the National Consumer Disputes Redressal Commission is heartbreaking. Whether you are the complainant or authorized representative. You spent years fighting against your builder, insurer, hospital, bank, manufacturer, services or any kind of business dispute.. you’re not going to hear “your case is dismissed” proudly announce.
You have the option of filing an application for restoration in hopes of getting your matter restored on the calendar. However restoration is not a sure thing. The commission will consider why you were absent for the hearing date. They will consider the relevant procedural provision. They will review the case record and the explanation advanced before it. One thing to remember is that these things have an urgency to them.
The Consumer Protection Act, 2019 allows for the National Commission to have powers relating the Consumer complaints, Review, and Ex parte orders.
Order 12 Rule 4 of C.P.Act, 2019
Section 61. Application for setting aside ex parte order of National Commission.
An application to set aside the ex parte order of National Commission may be entertained by the National Commission.
What this means is that under NCDRC Consumer Protection Regulations, 2020 . An application for setting aside of an ex parte order or dismissal of complaint in default shall be maintainable within a period of thirty days from the date of order or the date of receipt of the order.
The date is important because an application for restoration is not your chance to re-file your consumer complaint. Your application will be used to show why you were dismissed for non-appearance. You will ask the court to set that order aside. Keep these things in mind when drafting your restoration application.

Why Does Restoration Matter in NCDRC Cases in 2026?
Sometimes a complaint gets dismissed and the client is unsure of how to proceed. The consumer may think that because the complaint has been dismissed, it’s hopeless and cannot be brought back to life. Another client may just want to file a fresh complaint right away without exploring whether your complaint can be restored or whether there is some other procedural remedy available.
Once we understand what order was passed, we realize that an order dismissing a complaint for default is different than an ex parte order or an order on merits or a situation involving reviewable error or an appellate matter. The remedy available would differ depending on the situation.
For example, there is an express statutory provision under Section 60 of the Consumer Protection Act, 2019 for review of an order by the National Commission itself if there is an error apparent on the face of the record. Separately, section 61 talks about setting aside of an ex parte order.
Likewise, NCDRC Regulations have expressly allowed for applications with respect to dismissal of a complaint in default. Regulation 14 allows 30 days to make such an application (subject to the language used and facts of course).
There are advantages of being close to Delhi NCR because of this reason and some logistical reasons too such as having the matter heard at the National Commission in New Delhi. However, having a local lawyer in your city can even assist you with a matter at the National level. They can help with fetching documents, providing a conference room to meet, and other communication challenges.
If you have lawyer at NCDRC, your case can be fought even if you are based out of Delhi. Whether you are from Lucknow, Kanpur, Jaipur, Chandigarh, Mumbai, Pune, Bengaluru, Hyderabad, Chennai, Kolkata, Ahmedabad or anywhere else in India, we can handle your case while you not having to attend every proceedings.
What Is a Restoration Application Before the NCDRC?
A restoration application is an application filed before the Commission seeking restoration of consumer proceedings dismissed for default or otherwise. Restoration of proceedings in those cases where the law allows.
Restoration Application is not filing a fresh Consumer Complaint. Restoration Application means dealing with the earlier proceeding by filing an application seeking reason for the order which dismissed the complaint, reason for absence/default and on what legal ground we can restore the said order.
As per Rule 35B of NCDRC Consumer Protection Regulations, 2020,
“Application to set aside ex parte order or dismissal of the complaint in default shall be maintainable within thirty days from the date of order or from the date of receipt of the order, whichever is applicable.”
That is why BK Singh Advocate will always look into the order first. He will not believe that every dismissal order can be restored in similar fashion.
What Documents Are Needed for NCDRC Restoration?
The documents will depend upon the facts of your case. But as a standard principle you should start with getting together a complete copy of the file.
Here are some Documents to add:
- Copy of the order which dismissed the complaint or passed the relevant ex parte order.
- Copies of the original complaint and main pleadings already filed at NCDRC.
- Copies of notices replies rejoinders affidavits and written statements which are part of the record.
- Copies of any previous orders which would indicate the history of dates of hearings and adjournments.
- Evidence which supports your cause for absence on the date in question.
- Medical certificates. Flight itinerary. Email receipts. Any other evidence that will help establish your claim.
- Evidence of the date of receiving/copying/of knowledge of the order sought to be challenged (if date is an issue legally speaking.)
- Powers of attorney / vakalatnama/ any such authorization / representation formats if needed.
- Tabular representations of important dates.
- Any other document which you wish to refer to specifically regarding your reason for default.
- Don't forget to add your reasons for seeking restoration in the body of the application.
- You want to make the commission's job easier and not dump every document in your file. Part of being prepared is making sure you give the documents which support your request.
- Hence the NCDRC Lawyers team approach will begin with reviewing documents. No cookie cutter templates here.
What Can an NCDRC Lawyer Do for a Restoration Application?
DetDetermining what remedy is available is where a lawyer’actual job starts.
First, Counsel must look at the order and facts of the case history. Was the case dismissed for default? Was it decided Ex parte? Was it decided on merits? Otherwise how was it procedurally developed?
Secondly, Counsel must review what the limitation requirement is. If the matter involves dismissal of complaint in default then Regulation 14 will apply with its express thirty day limitation.
Third, clearly set out factually the reason for the non appearance. An application to restore cases cannot be made based upon facts which are manufactured simply to create an excuse.
Fourth, compile all supporting documents in a manner which allows the Commission to easily comprehend what happened.
Finally, counsel can actually appear and make submissions on behalf of the applicant dealing with the request for restoration, subject to any procedure or directions from the Commission.
BK Singh Advocate can assist clients to determine if restoration or another remedy would be available to you. This can become crucial in instances where the impugned order was not simply a dismissal for default.

2. Can you restore complaint dismissed for default from NCDRC?
Yes. A complaint dismissed for default is restorable as per the procedure available. Rule 14 of the Consumer Protection Commission Rules of Procedure, 1987 deals with applications for dismissal in default.
This rule grants thirty days to file a restoration application from the date of order passed.
3. What is the limitation for filing restoration application before NCDRC?
Rule 14
An application for setting aside an order passed ex parte or for restoration of a complaint in default shall be entertained within a period of thirty days from the date of the order or where the order is sent by post, from the date of receipt of the order as the case may be. 14[Consumer Protection Commission (Procedure for Conduct of Cases) Rules, 1987.]
4. What if it’s been more than thirty days?
See the order and the dates carefully along with the rules of procedure that are applicable. Instead of assuming that your case is barred by limitation someone needs to contact a lawyer and find out.
5. Isn’t restoration like asking for a Review?
No. Review of orders is provided under Section 60 on the grounds of error apparent on the face of the record. Restoration or setting aside of an order passed by default/ex parte is a completely separate application.
6. Section 61 of Consumer Protection Act, 2019 states
61. Where an order is passed by the National Commission ex parte, the party against whom the order is made may apply to the Commission for setting aside the order.
7. Can my lawyer guarantee that my NCDRC case will be restored?
No. No responsible lawyer will guarantee a restoration. This is for the commission to decide based on the facts, order, explanation and record coupled with the applicable law.
8. What paperwork should I give my NCDRC lawyer?
Order of dismissal, consumer complaint, previous orders if available, pleadings, evidence, any documents which help you explain your absence and any evidence which can help establish when you received knowledge of the order (if at a later date).
9. Does it matter why I missed the hearing?
Yes. A reason will be required if you are asking the commission to restore a complaint or set aside an ex parte order due to your absence. The commission will take the reason for your absence into consideration when deciding whether or not to restore. Hence your explanation for your absence should be truthful and supported by documents if possible.
10. Can I file a consumer complaint again if my complaint was dismissed?
Every case is different. This question cannot be answered without reviewing the order of dismissal and determining the limitation status of your claim. You may not be allowed to file another consumer complaint.
Conclusion
When you get an order dismissing your consumer complaint in default it can feel like your case is over. Your case isn’t necessarily over. Let’s double check our legal standing before throwing in the towel. Both the CPA 2019 and the NCDRC Rules of Procedure contain provisions dealing with orders passed ex parte or dismissing a consumer complaint in default. Order XIV of CPC which applied prior to the new CPA has now been replaced by Regulation 14.
Regulation 14 provides a period of thirty days to file an application to set aside an ex parte order or restore a dismissal in default. Please get a copy of the order, review the case timelines and take prompt action. Don’t fall into the misconception that restoration is the same thing as asking for a review or that you can appeal.
