We'll have to go through your loan agreement, notice, account statement, security documents and law applicable to see if there is anything you can do about the bank notice. Don't ignore the notice from bank but don't accept what is stated either until you've gone through everything.

Once the conditions prescribed by the SARFAESI Act are satisfied the secured creditor who qualifies has the right to enforce their security by law provided all rules are followed. The borrower can approach DRT if any and challenge whatever action is being taken against him/ her subject to facts of his / her case. It does not mean once you initiate a case the possession / auction is stopped. Whether it will be stayed will depend on law and whether the court grants a stay.

Quick Facts About the SARFAESI Act

  • The SARFAESI act 2002 defines what are known as Specified Enforcement Actions which are permitted to a Eligible Secured Creditor.
  • Mostly a time period of 60 days is provided under Section 13(2) from the date of serving a Notice under section 13(2) to repay the loan amount.
  • Procedure to follow when a borrower makes any kind of Representation/Object under section 13(3A).
  • If any eligible secured action is performed under section 13(4) then they are allowed to challenge such action in DRT under section 17.
  • Usually Section 17 allows filing of applications within 45 days from the date of Secured action.
  • Filing of application does not automatically result into staying the possession/auction.
  • You may file for Settlement / Interim Relief as well this will not be granted always.

What Does a SARFAESI Act Lawyer Do?

Will the recovery measure taken by your Bank fall under law? A lawyer who is well versed with SARFAESI act will help you know what remedies you have against the lender. They can look into notices issued by Bank, draft a representation to Bank, file an application before DRT, reply to DRT proceedings and discuss for a negotiated settlement.

When a bank has loan given to someone then they are empowered to recover the loan using the provisions of SARFAESI Act. But this authority is not absolute and it comes with restrictions laid down by law. Any person aggrieved due to action of the lender under the provisions of SARFAESI Act still has all the remedies open as if no such law existed.

We at BK Singh Advocate help the people find out when their case is against recovery of loan and when its an objection to the mode of recovery under the provisions of SARFAESI act. It is important to know this as the forum to approach and the relief to seek varies.

What Documents Should You Keep Ready?

Its always easier to do a legal audit when you have complete history of your loan and recoveries. Missing papers may prevent you from being able to establish banks claims payments or where you stand.

  • Have the following ready if available:
  • Loan sanction letter/agreement.
  • Any mortgage/title papers/security document.
  • Any guarantee papers which can hold guarantors liable.
  • Account statements/payment made.
  • Section 13(2) demands Notice & service of the same.
  • Any representation/objection given to bank and banks response.
  • Any valuation/sale notice/auction notice/junk documents.
  • Any communication regarding OTS/Restructuring and banks letter if any.
  • Any pending application/prayers, arguments/orders/drt drat hearing notices.

Do not dispose of any email's receipt's of money paid or compromise letters if any. BK Singh Advocate will try to assess what you have on hand and point out what is lacking and what will help you in your case.

When Should You Consult a SARFAESI Lawyer?

One might have to approach a lawyer from the point where a Statutory Demand has been issued, objection is rejected, possession proceedings have been filed or you are informed about auction of the property. Guarantor will have to consult with lawyer when bank calls him to repay under the guarantee or files any recovery proceedings.

It would be beneficial to get the cause reviewed once there is some chance of Auction Date being suspended. When last date for approaching DRT is nigh or if you want to challenge an Order which has already been passed. You can never rely upon the bank sitting for Settlement Talks. Settlement Talks do not stop Statutory Proceedings per se.

BK Singh Advocate can help you understand the papers and check if there is any scope of representing before bank or apply to DRT or plead for Interim relief, file an Appeal or even seek a Settlement Talk. It would depend on case to case situation. No lawyer can promise you that the bank will recall the proceedings or the Tribunal will grant you a stay.
