Supreme court of India has stated in many judgments that every bail application has to be looked into separately. They look what the case is against you, Evidence if any against you. 1. Regular bail generally applies to people who are already in custody.
  2. Bail in respect of persons accused of non-bailable offences before the Court or the authority. – Section 480 BNSS
  3. Powers of High Court and Court of Session to grant bail. – Section 483
  4. Anticipatory bail. – Section 482 BNSS
  5. Maximum periods of undertrial detention. – Section 479
  6. Grant of bail does not quash the FIR nor declare the accused guilty or innocent

The Bharatya Nagarik Suraksha Sanhita, 2023 was launched and came into force on 1 July 20[https://bharatyasnagariksuraksha.com/in_latest/high-court-upholds-constitutionality-of-bns-s-copy/](https://bharatyasnagariksuraksha.com/in_latest/high-court-upholds-constitutionality-of-bns-s-copy/)

below are some of the bail and bond related provisions.

What is Regular Bail?

When we talk about bail, its typically divided when the offence is bailable or non bailable. Regular bail means releasing the accused from jail, while the case is pending in front of the authorities. The accused can live his life normally with a few conditions imposed by bail court.

Lets take about Regular bail:

If the offence is bailable, then section 478 BNSS will take apply. If its a Non bailable offence, then section 480 BNSS applies in front of Magistrate given the condition mentioned in the section is satisfied.

Court of Session or High Court plays a role when Special bail is granted. Under section 483 , they can order the person to be released on bail, cancel some conditions of bail and send the person to jail if he was out on bail.

Essentially, just because you got charged with an offence. Doesn’t mean you will or won’t be jailed until the case is resolved. Its up to the courts to decide what Section applies to your case and go by what the section states.

Which law will decide bail for a criminal case?

India’s newest procedure Penal Law is Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS). Under chapter 35 deals with provisions regarding bail and bond. i.e from section 478 to section 496.

Any of the above could apply depending on your situation. If the offence is bailable then 478 will apply. If its Non bailable, then we can file for bail under section 480 BNSS. Anticipatory bail will be governed by section 482 of BNSS. Section 483 grants special powers to High Court / Court of session to grant bail. If you are detained as undertrial for too long then section 479 BNSS will allow you to seek bail.

The offence you have been accused of can be influenced by Bharatiya Nyaya Sanhita, 2023 or any other specific law. If the law you have been charged with has specific clauses restricting bail, then a general bail application will not work for all criminal cases.

Look at the FIR, arrest memo and each remand granted along with other relevant information to help build your bail application.

Who needs Regular Bail help?

Some scenariow where Regular bail help will be needed are if;

  • A person has been arrested and registered under an FIR;
  • Has been produced before the Magistrate after arrest
  • Was sent to Police/Court custody after production
  • Applied for bail earlier and was rejected.
  • The case has non-bailable offences.
  • The court has passed an order concerning bail. Which needs to be followed up with legal proceedings.
  • A criminal matter has been initiated against the accused through a special law. And needs to be addressed.

Family members usually hires a lawyer when their loved one is arrested because he/she cant take care of the matter by himself/herself from inside the jail. Documentation and accurate information is crucial in this case.

Advocate BK Singh can assess the facts of your case and help you understand if your situation calls for Regular Bail or Anticipatory Bail or Default Bail or Bail after Rejection or something else.

How does Regular Bail Work?

  1. Figure out why the person is in custody and what stage we are at procedurally speaking.
    Review Documents such as FIR, Sections told against you, Arrest memo and remand order ( s).If bail was previously asked, see the bail order( s) passed by the court as well.

  2. Figure out what court you need to apply for bail.
    There can be different Forums. Depending on the offence committed, Magistrate/ court of session/Special Court/High Court could be involved. The statute under which the offence falls and the nature of the offence would determine what route needs to be taken.

  3. Prepare a bail application and draft it in a way that reflects the facts that are legally relevant to the relief sought
    The bail application is not an opportunity to try your trial. Matters such as custody,nature of allegations, investigation status, antecedents, likelihood of you cooperating with authorities, flaws in prosecution version if any etc. will need to be addressed.

  4. Allow the prosecution to oppose bail as part of the procedure.

  5. Court will take both parties argument and the record of the case and pass an order.

  6. Comply with all the conditions and complete the necessary bond and surety formalities if Bail is granted.
    Section 484 BNSS tells us that “amount of a bond shall have regard to the circumstances of the case and shall not be excessive.” and Section 485 talks about Bonds and Sureties.`

Just because court passes a bail order, doesn’t mean the job is done. You have to follow the terms provided to you and attend the future court proceedings.

Documents Needed for Regular Bail?

Every case is different and requires different documents. But generally every lawyer will ask for these basic documents.

  • Copy of FIR/complaint filed;
  • memo of arrest/cop custody;
  • Order/s of remand passed;
  • Copy of the old bail application/ order( s) passed (if any);
  • charge-sheet/ investigation materials if available;
  • ID/proof of address;
  • Antecedents like Employment proof/business address. Any medical records if really needed;
  • Information of previous criminal cases(if any);
  • Information of other accused( if any) and seek parity along with their documents. Any order passed by the Court in the matter of the criminal case.

Please do not hide any previous criminal cases or adverse orders taken against you when you were contacted by the lawyer. Only when he knows the truth can he advice you accordingly.

How long does a Regular Bail take?

There is no exact time frame for Regular bail matters. Depending on the court and type of case, it can take long or short. Various factors play a role in how long it can take. Position you are in custody, notice requirements, responsiveness of the prosecution, court workload and facts of your case.

Always keep in mind that time is essential. Every day we spend in custody affects us and the applicant. But never rush an application without seeing the FIR,remand order and any previous bail applications. You might land yourself into more trouble.

Section 479 deals with undertrial detention that is too long. It specifically states the maximum duration you can be detained as undertrial. Based on the maximum sentence prescribed for the offence you have been accused of. There are few exceptions to this section as well. Offenders who are below the age of 21 when they commit the offence can also be treated differently.

Read the section. Just because your an undertrial doesn’t mean you will be set free because of this section. Its got many exceptions to it and will also vary from offence to offence.

When to contact a bail lawyer?

Basically, after arrest , produced before judge, when you have been remanded by police, your bail application got rejected or your custody changes.

Q2. Under which BNSS section can regular bail be filed?

Ans. Sections 478 and 480 deal with bail for bailable and non bailable offenses. Section 483 grants special powers to the High Court and Court of Session. The applicable section will be decided according to your facts.

Q3. Can we apply for regular bail in non-bailable offence?

Ans. Yes, you can apply for bail if the offence is Non-bailable. But unlike bailable offence, you will have to convince the judge that you deserve bail and the court will take into consideration the standard restrictions before granting bail.

Ans. The difference between regular and anticipatory bail is that anticipatory bail is filed by a person before he is arrested on suspicion of having committed a non-bailable offence. Read Section 482 BNSS. Regular bail is sought by someone who has already been arrested.

Q5. Can we apply for bail after police remand?

Ans. Yes. A person who is currently in custody can apply for bail. The stage of proceedings would dictate where you can apply for bail. See what reason the Police Judge gave for why you should continue to be in custody.

Q6. Can we apply for regular bail from Session Court?

Ans. Yes, Session Court have special powers under section 483 BNSS. Whether Session Court is the right court to approach will depend on the facts. Offence, Procedure that has taken place and the law applicable to the offence.

Q7. If I get bail in my criminal case, is my case solved?

Ans. No. When you get bail that only means you no longer have to remain in custody while your case is pending. It does not mean that your FIR is dropped, you were found innocent, acquitted of the charges or that your case is solved.

Q8. Can the bail granted to me be cancelled?

Ans. Yes. Just like how section 482 BNSS allows the High Court and Court of Session to release someone on bail. They also have power to direct for that person to be arrested and sent to prison. If you fail to comply with the conditions set for your bail. Your bail may be cancelled.

Q9. My lawyer filed a bail application for me and it was rejected. What should I do now?

Ans. You can always file for bail again in the future. Take note of why the judge rejected your application. If something has changed in your situation, you can file a new application. Do not retry submitting the same bail application as it will waste more time and money.

Q10. How can Advocate BK Singh help you?

Ans. Advocate BK Singh will read your FIR, find out where you are at in terms of custody and see if any orders have been passed. He will then advise you on what legal remedies are available to you. The court has the final say when it comes to bail.

Conclusion

I understand this is a lot to read and process but think about this. Filing for a bail application is usually the 1st step someone takes when they are arrested. But its not as simple as filling up a paperwork and you are free. Along with bail application you have to understand the FIR, Custody/ statue, Sections your dealing with. If there was a previous order passed and what does the law say you can or can not do.

When that family member gets arrested who lives in Ghaziabad or nearby cities. They shouldn’t worried about what to do next. Ask questions like “Under which section have they arrested him?” Which court has the authority to look at my case?” What does the record say?” “ What law enables the court to take action?”
