How does a Bail matter progress?
Phase 1: Initial Consultation. Your lawyer listens to your allegations, secures whatever record you have and understands where you are procedurally.
Phase 2: Legal Analysis. Your lawyer reads the statutes that apply to your case, analyzes the offence, where you are at with custody/arrest and reviews any previous proceedings and where you should go from here.
Phase 3: Application (if required). Your lawyer will prepare the necessary documents/application and attend court on your behalf. If your entitled to bail your lawyer will prepare an application for bail and attend Court before a Judge/Justice. The prosecution will usually also address the Court and the Judge/Justice will analyze the bail materials and give you a decision. Phase 4: You get an order that you’ll have to follow..
Granted Relief! Now you have been given conditions and/or bail by the Court. This doesn’t mean you’re free no charge your responsible to follow any orders the court imposes on you. Every case is different but these are the general 4 phases of a criminal matter. You don’t want to just pay someone because they have a “bail package”. You want someone who will analyze your matter and give you options.
WHAT FACTORS CAN INFLUENCE BAIL DECISIONS
Think a lawyer can just look at this and say yes your getting bail. Why?
As previously stated bail is subjective to the Courts discretion. The Courts will look at a variety of factors under the provisions of the statute and the facts and circumstances of your individual case.
Nature and seriousness of alleged offence, stage of the proceeding, whether you’re in custody or not, the allegations against you, the material on record and the representations made to the Court are just some factors that are taken into considerations depending on your circumstances.
Reminder that courts will often impose conditions on any bail order they grant. The Supreme Court has reminded us in recent judgments that bail conditions as well as the duration or continuance of anticipatory bail must be tailored (based on the facts of your case) and not by cookie cutter standard. BK Singh agrees.
Advocate BK Singh cannot guarantee you that your bail will be granted. Just as no other lawyer can. But we can give you an professional opinion on your matter based on current legislation and your records.
