Environmental Clearance Disputes: How Can Real Estate and Industrial Projects Handle Legal Challenges?

You can have your land ready, finances committed, approvals obtained, and buyers waiting but 1 dispute over environmental clearance can put your entire investment at risk from both a legal and commercial perspective.

As a real estate developer, industrial operator, or investor facing environmental clearance litigation, the case is rarely about “a file pending before the NGT.” The challenge can impact your construction schedule, project finance, ability to take/preserve possession/occupancy, ongoing operations, reputation, and future approvals.

Environmental disputes have therefore become that much more timely in 2026. On July 29, 2022, the Supreme Court in Vanashakti v. Union of India reaffirmed that the pre-existing EC regime under the EIA Notification, 2006 is mandatory and cannot be bypassed. The court struck down the 2021 OM which introduced an administrative framework for granting post-facto EC while upholding the validity of the more narrowly tailored 2017 notification.

Why Does Environmental Clearance Litigation Matter in 2026?

Environmental clearance has become litigious, since the very sanction is with respect to viability and legality of the project itself. Grant of Environmental Clearance (“EC”) is not on the same footing as any other approvals. Prior environmental clearance is required for projects subject to Environmental Impact Assessment Notification, 2006 is an integral component of the statutory process called Environmental clearance .

Typically construction activity being carried out for real estate projects are contested based on scale of project, land leveling activities, treatment/use of water, treatment of sewage generated, solid waste management or any other basis/ conditions where permission was granted . For industrial projects the dispute would be based on emissions allowed/ discharged, effluent treatment plant quality and discharge, handling of hazardous materials , consent to establish /consent to operate from pollution control boards or general condition imposed with EC.

National Green Tribunal is empowered to entertain all cases which are environment disputes and also entertain appeals against any order or decision of any authority in the matters of adjudication under the National Green Tribunal Act, 2010.

Quick Facts About Environmental Clearance Disputes

  • Projects/activities that fall under the Schedule to the EIA Notification, 2006 are required to obtain prior EC, subject to applicable categories and exclusions as specified in the Notification.
  • Projects are usually referred to as Category A projects and are appraised at the Central level. Category B projects go through the State level clearance mechanism, where applicable.
  • The procedure includes Screening, Scoping, public consultation and appraisal among other requirements, where applicable.
  • NGT Act, National Green Tribunal Act, 20 
  • Section 16 of the National Green Tribunal Act, 20 empowers the Tribunal with appellate authority in respect of certain environmental clearance orders and decisions.
  • The appeal under Section 16 against grant of EC has to be filed within 30 days. Condonation of delay can be sought from the Tribunal if the reasons for delay are valid as per the statute.
  • Section 20 directs the Tribunal to dispose off matters following the principles of sustainable development, precautionary principle and polluter pays principle.
  • In Vanashakti, Supreme Court laid down a comprehensive judgment in 20 enlarging the ambit of requirement of prior EC.

What Documents Should Be Collected Before Litigation?

Environmental cases require a lot of documents. DO NOT expect your lawyer to take upon himself/herself the onus of figuring out whether you have a strong EC complaint just from a few paragraphs you write about the project.

Keep copies of the entire EC application & approval file. EIA report. Copy of environmental management plan. Terms of reference for EIA study / appraisal. Minutes of appraisal meetings. Records of objections at public hearings. Correspondence with authorities and a copy of all conditions issued alongwith EC.

If relevant include Title/deed of land. Approved plans/building permission. Project layout. Photographs of construction over years. Pollution control consent. Water related consent/permission/w licences. Solid waste management audits/certificates. Surprise inspections reports by authorities. Compliance /follow-up reports & notices issued by concerned authorities.

In case of affected resident/association/organisation., photographs, videos, correspondence, copies of complains/approvals sent to authorities, inspection reports by authorities, objections raised during poublic hearings, technical expertise if any provided by experts, etc anything that documents how the alleged environment damage is related to the project/development.

When Should You Consult an Environmental Lawyer?

Ideally environmental legal advice will be sought before receiving a notice.

Ideally a proponent will seek advice when… 

  • the planned activity is covered by EIA Notification schedule;
  • the project involves an expansion or modernisation; 
  • there is doubt as to what category applies; or
  • multiple environmental approvals with overlapping scopes are required.

There’s also good reason to obtain an early review if…

  • an EC has unusual conditions; 
  • the project proponent has received a show-cause notice;
  • a Pollution Control Board issued compliance notices; or
  • citizens or an association are threatening NGT proceedings.

When an affected person seeks advice late however, it is usually because an EC has been granted or project work has commenced (apparently) without clearance. Time becomes limiting. What Happens After an Environmental Clearance Is Challenged?

Depends on the nature of proceeding. 

If its an appeal, the Tribunal sits over the order/action which granted environmental clearance which is being challenged. The Tribunal examines whether that order/action was passed in violation of statutory provisions. A writ petition which was filed initially could have been filed on completely different jurisdictional ground and might have sought a different relief. Hence the pleadings, documents produced, technical evidence and statutory provisions have to be suited to the proceeding at hand. They cannot be taken verbatim from some other matter.

Ad interim relief can be sought before NGT in certain cases to restrain further construction/operations which may cause environmental damage beyond repair. Granting of such relief would depend upon the facts, evidence and the principles of law applied.

NGT is a technical forum. As stated by Ministry of Environment and Forests," NGT is a body constituted to provide adjudication in the matters relating to environmental protection and preservation of natural resources. The Tribunal is a blend of judicial and expert members".

An NGT order can be challenged in Supreme Court in an appropriate case where the requirements of Section 22 of NGT Act are fulfilled. Appeals to Supreme Court are not a system of conducting another trial de novo on every issue of fact.

1. What do you mean by environmental clearance challenge?

A legal challenge against grant / refusal / conditions imposed from environment clearance or environmental validity/appraisal process of a project.

2. Can I file a case against my residential project in NGT?

Yes. If matter falls under the statutory scope of NGT and the relief sought is relatable to environmental laws, relief can be granted by NGT. The nature of relief would depend on decision challenged, environmental law involved & facts and nature of project.

3. Can I start my industrial project before getting EC?

Starting construction/operations before obtaining mandatory EC expose you to significant legal risk. You are required to obtain prior EC for projects specified under EIA Notification, 2006.

4. Does post-facto environmental clearance mean EC is granted after completion of construction?

The NGT & SC in 20months’ judgment have clarified that projects require prior EC as per applicable regular regime of EIA Notification, 2006. Exceptional statutory regimes for specific projects have been separately dealt with. Please do not confuse that post- facto regularisation would be available as matter of right in all such cases.

5. What is the limitation to file an appeal before NGT against grant of EC?

Statutory limitation for NGT governed appeals is 30 days as per Section 16 of the NGT Act from the relevant date mentioned under NGT Act. This period may be extended if an appeal is admitted after the prescribed period. (NGT has limited statutory power to admit appeals late upon satisfying sufficient cause). Appellants must refer the order dated and facts to compute limitation.

6. Can any citizen file a plea against grant of environmental clearance?

An affected person/ eligible applicant would likely have a remedy under NGT Act or other applicable law. Determination of standing, limitation, jurisdiction, limitation or nature of impugned decision must be carefully assessed before filing any such plea.

7. What documents are required for EC cases?

Documents may vary from case to case depending on the nature of decision/projects. Some of the key documents include EC order, EIA report, appraisal docs., public-hearing recordings/papers, project layout/plans, IC/CC reports and correspondence with regulators along with technical evidence to support your claim.

8. Can NGT stop construction work if there is a pending plea against the project?

The tribunal has powers to grant relief if statutory criteria are satisfied and if facts of the case permit NGT to intervene in the matter. Interim relief is not guaranteed and is granted at NGT’s discretion.

9. Is environmental clearance the same as getting a NOC from PCB?

Environment clearance is different from consent required under pollution laws from various Pollution Control Boards (PCBs). Projects would require different or both types of permissions /consents.

10. Why should I consult an environmental lawyer before starting construction work on my site?

Why NOT? It is always advisable to seek early legal advice on (a) whether your project requires EC; (b) which Government is competent to grant it; (c) what are the documents that need to be submitted to different Governments for securing EC and what other environmental laws would impact your project.Go ahead, invest after reading this answer. It is much better to know now than repent later.

Environmental clearance litigations have become something of a lottery for Indian real estate and industry projects. With law catching up 20 26 Statute increasingly makes it foolhardy to expect that an EC will be regularised ex-post facto SC judgments.

That means prior diligence on your environmental standing if you’re a developer thinking of breaking ground, redeveloping or materially altering your operations.
