Can Police Arrest You Without Notice After an FIR, and How Can Advocate BK Singh Help?

There is an FIR filed against me. You haven’t received a notice in writing but police have been calling your family/home/etc. Can the police arrest me without notice?

Nobody wants to get arrested. You’ve heard one thing. The police have to serve you notice before arresting you. You’ve also heard that the police can arrest you as soon as they file an FIR. Both of these statements are absolutely untrue.

The short answer is yes, they can, but only under specific situations after filing an FIR. Now just because an FIR has been registered against you, it does not empower the police to arrest you. Police in India can’t just do anything they want to, there are various laws that allow a citizen protection from illegal arrest.

If you are a student, a salaried employee, a small business owner or even if you have a wife and kids to support, going to jail (notice or no notice) can derail your life. Even if the police haven’t arrested you yet your job, your reputation, relationships, and daily life can be impacted.

Police are NOT obligated to send you a notice before arresting you. You will NOT be arrested immediately after filing an FIR. These are all myths.

Under what circumstances can the police arrest you without notice? Whether the police can arrest you without notice under BNSS, 20 23 will depend on the offence you are accused of, certain statutory requirements, and the facts of the investigation.

BK Singh is a criminal defence lawyer you can call today if you or someone you care about is facing threat of arrest, have been given a notice by police, or want help navigating your legal rights for anticipatory bail. Understanding whether the police can arrest you without notice and if you should take preventative measures by going to court yourself are essential steps to building your case. BK Singh helps residents in Delhi NCR, Ghaziabad, Noida, Gurugram, Faridabad, Lucknow, Jaipur and even Mumbai. Why Is Arrest Without Notice After FIR a Serious Concern in India in 2026?

An arrest doesn’t only take away your liberty for a few hours/days. Its ramifications extend into your daily life. An employee may face interrogation from their employer. An owner may be prevented from operating their business. Families are devastated when police take their loved ones in handcuffs, with court dates and bail to schedule.

Things could be worse if the FIR wrongly implicates someone in a non-bailable offence. Or if police keep showing up at someone’ doorstep because they are unaware of their basic rights.

The Indian Judiciary has gone out of their way to make it clear that arrest is NOT meant to be a default option upon registration of an FIR.

This week, The Apex Court stated on January 15, 2026- “where the offence is punishable with imprisonment of ‘seven years or less’, the procedure of issuance of notice under Section 35(3) BNSS “is the rule and arrest is the exception which can be made subject to the conditions as are laid down in the Statute”."

Schedule a consultation with Advocate BK Singh to learn how these safeguards relate to your specific FIR. Don’t leave things to chance.

Can Police Arrest Without Notice After FIR Under Indian Law?

Police can arrest any person without giving any notice of arrest or warrant if offence is punishable without licence & such conditions which are necessary to make arrest without warrant are satisfied. Such offence for which police can arrest without warrant are called cognizable offence. Below are certain conditions which need to be satisfied by police before arresting a person without warrant.

Subject to certain safeguards ,Police are empowered to arrest without warrant if following conditions are satisfied -

Section 35 of BNSS lays down the circumstances in which such arrest can be done.

(1) If offence is punishable with imprisonment for seven years or more, Police officers have to satisfy statutory conditions i.e. A police officer has to have reason to believe about the involvement of the person and the need for arrest.

Police will not be able to defend their stand by putting forth the argument that the FIR has been registered and hence the accused should be in police custody for interrogation.

(2) If an offence is punishable with greater punishment, then it changes the statutory conditions required to be satisfied. Each special criminal law provides for such specific provisions.

(3) If arrest is not necessary, then police officers shall issue notice to the person to appear. ( Section 35(3))
