Bank Rejected Your OTS Request and Started Auction? What Can You Do Now? 

OTS rejection turns your EMI stress into real property troubles. You might have been negotiating an OTS with bank branch for weeks and by now have already blocked funds or otherwise expected some delay. However, what you receive is a bank auction notice.

OTS discussions and settlement requests are business level requests to a lender to accept a lump sum or repayment plan. It is not a judicial command to stay auction.

Ideally your loan sanction, mortgage/deed of security, loan statement of account, Section 13(2) demand notice, copies of objections already sent (if sent), bank’ reply to objections sent, Notice of possession, newspaper ads for sale, valuation report / papers, auction advertisement and any written communication regarding OTS requests sent to bank.

1. Will bank go forward with auction if my settlement offer is rejected?

Ans. Yes, bank can still proceed with auction. A rejected or pending OTS request does not automatically stop SARFAESI recovery process. The upcoming auction can usually be contested in court depending on history of notices served, possession actions initiated, process bank has followed for sale and documents connected to case. 2. Will sending OTS again stop auction? 

Ans. Sending OTS Request will not stop auction by itself. Bank has the authority to accept, reject or negotiate any settlement offer they receive subject to their own policy while simultaneously moving forward with SARFAESI process. Any promise or indication that they will delay should ideally be requested in writing rather than taking verbal assurances.

3. Can I still file in DRT after auction is noticed?

Ans. Yes. Legal action under Section 17 is available to borrower or any other person aggrieved and disputing certain measures taken under Section 13(4). Time limitation and ability to file lawsuit will differ based on what action is being disputed. 4. Can DRT stop bank auction? Can filing for stay be guaranteed? 

Ans. No. Just because you file an Application under Securitisation Act at DRT does not mean you will receive a stay of auction. Interim relief is granted at the discretion of the Tribunal based on facts of the case, merits of the application, statutory conditions, urgency of the matter, documents presented to it and legal arguments made before the Tribunal. 5. I disagree with price bank set for my property. Can I object? 

Ans. Yes, if there error in valuation methods used or sale process to be followed then you can object to valuation or reserve price fixed. Mere disagreement with set amount will typically not be enough. Valuation sheet would have to be reviewed along with process adopted by bank and circumstances around entire matter.

6. Bank agreed to settle in principle but later noticed property for auction?

Ans. Oral settlements are difficult to treat as seriously as a written settlement would. Emails communications, sanction order, repayment terms suggested, conditions to approve OTS and proof of any amount paid/deposited becomes extremely crucial here. Ideally Advocate BK Singh will want to know exactly what was said, by whom and when verbally before advising you on significance of such statements.

7. Can I negotiate settlement even after auction notice?

Ans. Borrowers can still negotiate. RBI has specifically mentioned a compromise settlement is a resolution mechanism and is to be treated as per the directions issued by RBI and subject to policy approved by the board of the regulated entity. You should still be able to negotiate with bank even after receipt of auction notice. But please do not fall prey to thinking negotiations will STAY the bank from following statutory enforcement procedures. It would be beneficial to get any assurance or agreement from lender in writing.

8. Bank is auctioning my house which I use as my primary residence. Now what? 

Ans. Just because you use the property as your primary residence does not mean the mortgage lender loan attached to that property can not be enforced against you. Review Terms of loan, type of security provided, any statutory exemptions applicable if any, stage of enforcement bank has reached and what process bank has followed. DRT Lawyers will look at legal technicalities involved instead of making an assumption that just because property was your primary residence bank cant auction it.

9. Can Guarantor file in DRT to prevent auction if he owns property?

Ans. Guarantor or anyone else affected might be able to file depending on what terms were agreed to under security documents, what type of enforcement action has already been initiated, and facts involved in particular situation. Just because you gave guarantee does not mean you will be protected from sale. Just because a person owns property does not mean he or she can automatically file for legal relief. 10. How long can I wait to contact a lawyer after receiving auction notice?

Ans. Don’t wait. Challenging an Auction becomes more difficult the closer it’s sale date because you will owe time to gather necessary documents, verify DRT has jurisdiction, find out legal suit can be filed and if so, FILE the suit. OTS rejection by bank is not a legal affidavit saying you have no recourse. Just because bank rejected your settlement does not by itself provide you legal grounds to stop auction immediately.

Was SARFAESI route initiated? What remedies have already been triggered? When was sale notice issued? What do the emails regarding settlement really say? Has a legally binding agreement been created or were borrower just waiting for approval from bank?
