Kerala High Court Grants Relief to Principal Denied School Entry for Wearing Churidar
Nobody can tell you what to wear unless they are enforcing some form of law. With regard to any institution or establishment if they have a dress code than the court held.
In the recent case the Kerala High Court asked the police to take necessary action so that the headmistress of a High School in Kottarakkara can enter into the school premises after she was debarred from entering due to her wearing a churidar.
Justice PV Kunhikrishnan held that No one can enforce what a person should or shouldn't wear in public unless they are enforcing a rule which has the support of law.
If any such dictations are made on the personal choice of an individual it becomes the responsibility of the authority which enforces law to act.
Clothes are a way to express your culture comfort and choice and you can't be measured by it said the Court.
Its the choice of every Citizen what they should or shouldn't wear and no custom of society can interfere said the Court.
Women's Dignity and Choice
Although it seems to be an issue about wearing a Churidar by a head mistress at work but it goes deeper to the question of a Women's Dignity and Choice said the Court.
One's choice of dress or it's dignity or cultural value lies with that person.
No one can dictate how you should dress or if you can wear something. A person decides the value and cultural significance of any attire.
No one can tell you what you can't wear at School if its not prohibited by law
Sindhu S Nair was the Headmistress of Eswara Vilasom High School AT Kottarakkara. She filed a petition to the Court after she was denied entry to her own school due to her wearing a Churidar instead of Saree.
On February 3rd the manager of her school came to her room and told her she will not be allowed to wear a Churidar to school. He also directed the guards that she should not be let in if she wore one. As reported by the Court.
When she went to school the next day wearing a churidar. She was denied entry by the guard at the gate.
Nair then contacted police and an FIR was registered. After this Nair went to the High Court to ask them to provide her protection and bar the Manager from her position.
There was a Circular from Directorate of General Education which allowed teachers to wear Churidar which she relied upon.
The manager denied the allegation and told the court he never asked her to not wear the Churidar to school.
The Court didn't delve deeper into the allegation as there was an enquiry going on against the manager.
Also wearing a Churidar modestly to work does not degrade her stature as the headmistress of the school said the Court.
As there was a circular issued from Directorate of General Education which permitted teachers to wear churidar.
So the Court held that she couldn't have been denied entry to school due to her wearing a Churidar.
When passing its order the Court also mentioned that the authorities will have the liberty to take necessary measures.
