Allahabad High Court directs FIR against lawyers who vandalised court room and initiates contempt proceedings.
A group of lawyers vandalised the court room last week. They did so after an advocate was allegedly mistreated by Justice Ajay Bhanot.
Allahabad High Court on Friday directed that an FIR be registered against the lawyers who vandalised the court room last week. They vandalised the court room after an advocate was allegedly mistreated by Justice Ajay Bhanot.
A Bench comprising of Justice Bhanot and Justice Divesh Chandra Samant dismissed these allegations and held that the Allahabad High Court Bar Association made "false imputations" against the incident. Further used inflammatory language in its letter sent to the Chief Justice.
The Bench observed that some of the Lawyers not only vandalised the court room and broke the furniture present in the court room. But they also assaulted the Government Counsel and Court Staff.
That false narrative was created through social media to defame the image of the High Court and Justice Bhanot.
On forwarding the matter to the Chief Justice the Bench gave following recommendation:
- That the Registrar General be directed to have FIR registered against the Lawyers who were responsible for inciting violence, conspiring to commit violence and committing the act of violence and vandalism in court.
- That the Registrar General be directed to have FIR registered against those who have put false posts on social media about the above mentioned incident in the High Court. Also have these false posts taken down from social media.
That criminal contempt proceedings be initiated against the Lawyers. Since there are prima facie criminal contempt. Therefore the Bench forwarded the matter to the Chief Justice to forward it to the suitable Bench. So that criminal contempt proceedings can be initiated against the Lawyers involved.
Court held that they will not look away from the incident that took place just because there should be harmony between Bar and Bench.
"That violence should be appeased in Courts will result in Blackmail of the Courts. And will not stop further instances of violence. Appeasing violence does not satiate it. Only bringing the culprit to justice and showing deterrence through law will help stop it."
Court further stated that speaking truth to power by bar is not giving them the right to promote violence towards an individual and against an institution.
"It is not acceptable that anarchy becomes a kind of dissent. Free Speech at Bar does not mean free speech to defame Bench" said the Bench.
Court will not look away from this incident because of harmony between Bar and Bench. That violence should be appeased in Courts will result in Blackmail of the Courts. And will not stop further instances of violence.
Allahabad High Court
This all happened when Justice Bhanot's court asked a lawyer to apologize to an SP who was sitting in the chairs meant for lawyers. The lawyer had requested the SP to move to a seat further behind.
Bar Association had said that a chair was kept for Police officers and other officials in Justice Bhanot's court. Further alleged that Justice Bhanot told the lawyer he would put him in jail. And that another Senior Counsel was laughed at by the Judge.
The Association issued a statement on 27th of October. Saying that they will not visit Justice Bhanot's court until something is done. Although there was no call given by the Bar Association to not go to the courts. The Lawyers vandalized the court room on 28th of October.
The Court has brought to light what actually took place. Through its order on 29th October. It held that the Counsel was not made to apologize.
"He made a conscious decision to show remorse. Showing remorse is not humiliating. It's a way to redeem yourself. When in dialogue with the Court we as the Bar and Bench have the ability to accept that we have made a mistake. Which shows us as strong not weak. Because we can make our laws better by admitting our faults."
It further held that the Bar Associations allegations that the judge pointed his finger at the lawyer and said he would send him to jail is "falsehood and deliberately false". That there was no such order pronounced or that is on record.
The order also contains statements made by Sr. Adv. VP Srivastava that he was not humiliated by the Judge. The Bench applauded the Senior Counsel for telling the truth.
"It gives me pleasure that Shri V.P. Srivastava has come forward to tell the truth in front of many of his fellow Lawyers. This shows his good character and is fitting of the tradition set by the Bar."
About the Chair. The court said it's purpose is to allow assistance to the court.
"We have provided this chair to such Officials/ Person. So they can have a vantage point to follow what's happening in court. To know what kind of help they can provide the court and be able to give it."
The Court said that no Member or Office Bearer of the Bar had taken issue with the chair.
When describing the events that unfolded in court last week the Court said.
"There were many unruly Lawyers trying to start an incident in Court. The Lawyers were acting with such hostility and shouting that you could not think you were in a Constitutional Court. You felt as if you were surrounded by a violent mob."
After the Judges stood up from the bench. One of the Government Counsel rushed to their chamber with his face puffy and was struggling to walk.
"After that Shri Paritosh Kumar Malviya informed us that as soon as we stood up from the bench. Some Lawyers attacked him in the Court Room. He also told us that these Lawyers had threatened him because he defends the State in cases. And that he would have to suffer for it."
There is no justice for judges who fall victim to false statements made on Social Media.
Allahabad High Court
When discussing the Bar Associations letter the Court said.
"We can clearly see how the false statements and language used in the letter dated 27.10.2026 by Dr. C.P. Upadhyay, President Elect of the Allahabad High Court Bar Association and Shri Santosh Kumar Mishra Secretary Elect of the Allahabad High Court Bar Association led to todays incident of violence."
Social Media exploded with false news about what happened in court.
"The spread of lies on a mass scale about judicial proceedings are detrimental to our Judicial process. And to the dignity of our Courts.
Judges work their whole lives to build their reputation. Which can be destroyed in seconds by lying on social media. There is no justice for judges who fall victim to false statements made on Social Media."
The Court also held that social media can cause people to hate our constitutional bodies of government. Can hinder the working of our constitution and can lead to anarchy. All of which played out in this scenario.
That Criminalizing of our Bar is breaking down our Judiciary in the State of UP.
"Our Young Bar needs to learn the right values and excel in their field. We must teach our younger members the ways of this Court and the values our Seniors hold."
