Do you know what is the right place to file your dispute?

Rouse Avenue Courts deal with certain criminal and labour issues. You business dispute may not necessarily have to be heard in this court.

Depending upon the nature of your case if you want to recover money from your dues your dispute may be filed in the Commercial Court. There are multiple Commercial courts located at Delhi and they have their own territorial and value jurisdiction to hear commercial disputes.

Or if you want to file a complaint as a Micro or Small Enterprise for delayed payments. You may file your dispute in Micro and Small Enterprises Facilitation Council (MSEFC)

This step can make or break your case.

If you file your dispute in the wrong court. Not only will your case become costlier but will also lose more time. Speak to BK Singh Advocate and MSME Lawyers who work in Delhi and let us analyse your dispute and see if MSEFC. Your dispute falls under Commercial Court. Arbitration or a Court close to Rouse Avenue Complex.

For assistance with MSME dispute resolution, the appropriate forum depends on the facts, the applicable law and the jurisdictional requirements.

When should you approach a Lawyer for your MSME?

You should always approach a Lawyer when you have commercial disputes.

Why should you know this if you live in Delhi?

Because, Delhi has multiple businesses operating around. From traders. Service providers. Technological companies. Contractors. Dealers. You name it.

Now each one of these entities face different type of disputes.

You as a trader from okhla may be getting payments delayed by your customer for past 2-3 months. A company from connoquitt place can have a contractual dispute. Someone can have received an arbitration notice. You may have gotten a labour dispute against your business. You may have been linked to a criminal offence. Business under your company’s name. Defection. Forgery. Criminal Breach of trust. Etc.

You might have a different dispute that is not mentioned above.

Hence just because you are a MSME doesn’t mean your disputes will be the same as another MSME.

So how do you you know which Lawyer to speak to or which court will you have to visit?

You need to understand what kind of transaction you were in. When did you supply your goods. When was payment due. What was the contract terms. What’s the jurisdiction. How long has your dispute been pending etc.

BK Singh Advocate and MSME Lawyers can help you understand these issues.

Quick facts:

MSMED act gives benefit of delayed payment to buyers if your buyer purchases goods/services from micro or small enterprises.

Section 15 gives the maximum time-frame to make the payment. Which cannot exceed to 45 days from the date of receiving the goods/services by the buyer.

Section 16. If your payment has been delayed you are eligible to claim compound interest at the rate of 3 times the rate notified by RBI per month as calculated on a monthly rest.

For matters concerning MSME delayed payment recovery, the relevant documents and eligibility requirements should be reviewed before deciding the legal route.

Micro Small Enterprise Facilitation Council

There is a Micro and Small Enterprise Facilitation council set for Delhi purchasers.

Rouse Avenue Courts may not solve your dispute.

If your dispute is commercial in nature. You will have to visit the commercial courts. (mention commercial court jurisdictions)

There are multiple commercial courts that will hear your dispute in Delhi.

It all depends on your facts and circumstances of your cause of action. Your dispute type.

Businesses considering an MSEFC reference can review the MSME Samadhaan filing and representation service to understand the general legal support available.

How to understand your issue? ?

Don’t worry. We mentioned everything above. Your issue can be because of payment. Commercial purpose. Labour disputes.

If you supply goods/services to someone and they haven’t paid you for 2 months. You can claim interest under chapter V of the MSMED Act. Provided your dispute satisfies the requirements.

If your dispute is related to your contract. You will have to see the Indian Contract act. Or if your contract has a clause mentioning about arbitration. You may have to send a arbitration notice.

If your issue is related to labour. You dispute will be heard under the law which concerns labour.

Same goes for if you have received a criminal notice/complaint.

Moral of the story is we need to understand WHERE your dispute lies.

Having a Udyam certificate for your MSME doesn’t mean you can file a case in MSEFC. Or your dispute will be governed by MSMED act.

Above mentioned chapters in the MSMED Act is only for micro and small enterprises. Who supply goods or provide services to any buyer. If there is a default in making the payment by the buyer. Then sections 15 and 16 apply to your case.

You can file your complaint to the concerned Micro and Small Enterprise Facilitation council if your dispute is governed by Section 18 MSMED Act
