An arrest breaks families. Relatives hear “interim bail” thrown around when someone they know has been arrested. The bail petition is pending. They’re scared of police action. Someone at home needs to go to the hospital for an emergency. The applicant needs more time from the court before the main bail application is heard.
The first question that comes to anyone’s mind in such situations is Can my loved one be protected till the court decides on the bigger question?
Say no more. Let me introduce you to interim bail…
Interim bail under Indian law is bail granted by the court for a temporary period or till a certain stage is reached in the proceedings. While interim bail is not defined as a separate category of bail under law, bail under the Bharatiya Nagarik Suraksha Sanhita, 20 23 can either be classified as bailable or non-bailable. However, courts have recognized interim bail as an available form of temporary judicial relief for accused persons analyzing the facts and circumstances of each case.
The Supreme Court in one of its judgements stated that while the expression “interim bail” has not been defined and classified as a separate type of bail under the criminal procedural laws, it has been frequently used and understood as a substantive legal term. It refers to the temporary release of an accused which is granted by a court under the appropriate set of circumstances. Thus the Court observed that interim bail can be allowed if the matter of regular bail is kept pending or if there are sufficient and compelling reasons to grant interim bail.
However, as mentioned earlier, this does not give every accused person a right to seek interim bail.
Depending on the nature of allegations, the stage of the investigation, custody status of the accused, possibility of absconding, chances of influencing witnesses, medical evidence, urgency of the situation and bars under any special statute (if applicable) – would be factored in by the court before deciding whether to grant interim bail.
The Bharatiya Nagarik Suraksha Sanhita, 20 23 is the law that will govern criminal trials in India starting 1 July 20 . TheBNSS replaced the old Code of Criminal Procedure, 1973. Chapter 35 of BNSS talks about bail. Section 478 BNSS talks about grant of bail for offences that are bailable, Section 480 BNSS talks about bail for non-bailable offences, Section 482 BNSS talks about anticipatory bail and Section 483 BNSS talks about special powers of High Court and Court of Session to grant bail.

He understands how to help people with interim bail, regular bail and anticipatory bail and other criminal legal problems. Why Does Interim Bail Matter Across India in 2026?
Cases seeking personal liberty are not filed at the most “convenient” of times.
A man learns of an FIR in Delhi on a Friday night. An employee is arrested in Noida because full hearings for regular bail cannot take place within office hours. A family faces an genuine medical urgency in Ghaziabad that requires immediate relief. These are the same stories playing out in Mumbai, Bengaluru, Hyderabad, Chennai, Kolkata, Ahmedabad, Lucknow, Jaipur and other cities India.
Why Interim Bail Matters
Regular bail can take time – notices to be served, the prosecution to respond, reviewing case records or an extensive hearing.
An interim relief helps bridge that gap.
Days matter for a family. Jobs are at stake. Children might have to be looked after by the accused. Medical emergencies have to be tended to. But courts also cannot allow an investigation to be stalled just because the accused person wants to call it urgent.
BK Singh Advocate therefore looks at applications for interim bail with empathy and an understanding of the competing interests at play instead of seeing it as trying to get around the usual safeguards.
The Supreme Court itself has a separate category on its e-filing website for “Interim Bail” filings which is separate from both anticipatory bail and regular bail as a request for relief considered in-between hearings.

Quick Facts About Interim Bail in India
- In simpler terms, interim bail means bail/temporary relief granted for a temporary period.
- BNSS has no chapter named “interim bail”. It has provisions for
- Interim relief during pendency of proceedings of application for regular bail/anticipatory bail before the Court.
- The duration will be judged from the words stated in the interim order by the Court.
- Grant of interim bail shall not be treated as acquittal or dropping of FIR.
- All norms of bail will be applicable during this time frame.
- Additional conditions in case of offence under special acts NDPS, PMLA or UAPA.
What Is Interim Bail Under Indian Criminal Law?
Interim bail is bail which is granted by the court on a temporary basis. It is granted for a temporary period of time, a particular event or stage in proceedings. Think of interim bail as short-term relief rather than a long-term solution to the issue of bail.
Courts have granted interim relief either on an application for standard bail i. e. bail posted after arrest, or on anticipatory bail if the circumstances merit it. Courts have even entertained temporary bail in extraordinary personal circumstances.
In fact, the Supreme Court said: "Interim bail is now part of our accepted legal lexicon, though not defined as such in the Code. It means release granted till a pending application for regular bail is finally decided or there exist such special or exceptional circumstances as may call for grant of temporary respite."
Notice the above sentence. Because someone accused of a crime files a bail application they are not immune from arrest or custody. The Court can impose the consequences of the alleged offence if it does not grant an interim order.
Best Bail Lawyer sees this situation quite often as clients will usually refer to interim bail, regular bail and anticipatory bail as if they mean the same thing.
They do not.
Is Interim Bail Different From Regular Bail?
Yes it does. Regular bail typically deals with the release of someone who is already in custody and wishes to be released on bail while investigation or trial is pending and who agrees to comply with the conditions set forth by law. Interim bail is typically granted for a short period of time. A regular bail order shall continue to operate until it is revoked or modified as per law. Unless it is sooner revoked or modified, interim bail shall cease to operate when the date, hearing or event mentioned in the order occurs. Section 480 BNSS deals with bail granted for a non-bailable offence by any Court other than High Court or Court of Session. Section 483 Special powers of High Court and Court of Session as to grant of bail. The High Court and Court of Session have powers to grant special bail. Since both our members offer verified regular and interim bail services through BestBailLawyer. com, we cover these bail types for those who are already in custody. BK Singh Advocate takes into consideration a clients custody status first because that one misunderstanding can send a family to a bail option that doesn’t help.
Is Interim Bail the Same as Anticipatory Bail?
No. Anticipatory bail is sought by a person from a Court where he anticipates that he will be arrested for a non-bailable offence. Section 482 BNSS however translates to COURT SHALL DIRECT THE PERSON TO BE RELEASED ON bail WHERE HE FORESEES ARREST.
Interim bail has much broader implications as it refers to temporary relief of an order of protection passed by a Court and can apply to various proceedings.
Say a person moved an anticipatory bail application before the Court. The Court can pass an interim order granting interim protection from arrest till the date of next hearing. That interim order does not mean the anticipatory bail has been granted.
There have been several orders passed by the Supreme Court recently wherein Courts grant interim protection to persons from arrest in anticipatory-bail hearings and hear out the application for the actual relief later.
If readers have themselves reached a stage where they have a well founded fear of arrest, please read our curated Anticipatory Bail Service to know how interim relief from arrest differs from any other form of bail.
BK Singh Advocate ADVISES EVERY client to READ the ORDER. verbatim. operative part. Terms such as “interim protection”, “ interim bail”, “till the next date” and “in the event of arrest” mean everything.
When Can Interim Bail Be Considered?
There is no magical combination of circumstances that will allow for grant of interim bail.
All facts of the case, urgency involved, allegations made and stage of proceedings will play a part in court’s decision.
Interim order is when the main bail application would normally be heard but you require relief before the matter can be finally heard. Court will grant interim relief in deserving cases subject to court’s satisfaction and the statute under which you seek bail.
Some examples are:-
- The regular bail application is pending before the court and you want to be released on bail till the date of hearing of the main application;
- You have sought anticipatory bail and want the court to grant you temporary relief till your anticipatory bail is finally decided;
- You have an urgent verifiable medical condition supported by medical records;
- Death/Serious illness of father/mother/spouse/child;
- Any other personal circumstance that you think the Court should consider in order to grant you interim bail;
- Your appeal against cancellation of bail is pending before a higher court.
The above are only some examples and do not limit yourself to only these.
Wanting to attend a business meeting, facing general inconvenience or concocting medical illness without any supportive medical records cannot be said to be urgent merely because you say so.
BK Singh Advocate gets bored listening to sob stories. Prefer some documentary evidence.
Can Interim Bail Be Granted in a Non-Bailable Offence?
MAYBE. “NON-BAILEABLE” DOES NOT MEAN YOU CANNOT BE GRANTED BAILED UNTIL TRIAL. IT ONLY MEANS THAT BAIL IS NOT YOUR RIGHT LIKE IT IS ON A BAILABLE OFFENCE. THE COURT HAS DISCRETION.
Section 480 BNSS ALSO GOVERNS MANNER OF BAIL, CONDITIONS TO BAIL FOR NON-BAILEABLE OFFENCES BEFORE THAT COURT INCLUDING STATUTORY LIMITATIONS/CONDITIONS.
GRANT OF INTERIM RELIEF STILL DEPENDS ON OFFENCE, POSSIBLE PUNISHMENT, MATTER AGAINST ACCUSED, NEED FOR CUSTODY & ANY SPECIAL STATUTE THAT COVERS THE OFFENCE.
IF IT IS COVERED BY SOME SPECIAL STATUTE THEN USUAL BNSS ANALYSIS MAY BECOME INCONSEQUENTIAL. THERE ARE ADDITIONAL LAYERS OF BAIL LIMITATIONS IMPOSED IN NDPS, PMLA, UAPA, ETC. SPECIAL STATUTES.
THIS IS WHERE PEOPLE GET CONFUSED. SO..
YOU MAY BE READING SOME ARTICLE ON BAIL THINKING THAT SAME TEST APPLIES TO ALL CRIMINAL MATTERS. IT MAY NOT.
BEST BAIL LAWYER WILL ALWAYS READ THE FIR SECTIONS AND SPECIAL ENACTMENTS TO DETERMINE IF INTERIM RELIEF EVEN HAS A POSSIBILITY OF BEING GRANTED.
What Factors Does a Court Consider Before Granting Interim Bail?
Its true that bail court is neither trying nor recording evidence in the criminal case. But what it is deciding is whether interim liberty would offend the purposes of investigation/ diescovery or trial process.
Nature of offence charged, role attributed to accused, need for custodial interrogation,antecedents,flight risk, risk of evidence destruction,response to investigation are all factors which are relevant in that analysis. Speedy hearing is another.
If interim bail is sought on ground of medical urgency,then Courts can ask for bona fide medical documents to support the claim. If urgent family matter is the ground, documentary evidence assume significance.
Cooperation with the investigation would become relevant documention if interim relief has been granted earlier and enjoyed responsibly. Recent SC judgments in 20-26 have held that positive response to conditions of interim relief as well as cooperation with investigation can be considered....

What Is the Legal Framework for Interim Bail Under BNSS?
Anyway, what is clear is that the BNSS doesn’t make any mention of an Interim Bail chapter. Deal?
“The point of departure.” Let’s examine these three:
Section 478 BNSS
Section 480 BNSS chiefly relates to bail granted for a bailable offence. Given bail for a bailable offence is inherently different from applying for bail at the discretion of the Court in the case of non-bailable offences,BestBailLawyer. com , our comprehensive Bail from Police Station guide also references Section 478 BNSS as the go-to bail section within BNSS for cases where bail is granted in relation to bailable offences.
Section 480 BNSS
Section 480 BNSS relates to bail for non-bailable offences before any Court other than the High Court or Court of Session.
You’ll see it imposes conditions and also allows for certain exemptions – including children, women, sick/infirm persons in particular scenarios.
Section 482 BNSS
Section 482 BNSS applies to anticipatory bail – in situations where someone expects to be arrested for a non-bailable offence.
An application for interim relief would be applicable where such an application is made.
Section 483 BNSS
Section 483 BNSS vests the High Court and Court of Session with special powers relating to bail. In one judgment from 2026 , the Supreme Court itself quoted this section word for word. Included in this, is the power to “release on bail” an accused in custody as well as powers to make changes to conditions imposed by a Magistrate.
None of these sections go on to define interim bail separately. There have been occasions where Judges have noted that the very nature of the relief suggests it’s temporary. BK Singh Advocate breaks these sections down further based on the offence charged as well as any special laws that may alter the usual bail conditions.
What Documents Can Matter in an Interim Bail Application?
Applications for anticipatory/temporary bail are usually time sensitive. That doesn’t mean documents should be hurried. The Court wants something to work with. Here are documents that will help, subject to the facts in your case:
- Copy of FIR/complaint;
- Memo of arrest/remand/custody (as available);
- Copy of the anticipated bail application that is pending;
- Copies of prior bail orders (if any);
- Medical reports (upon which you are relying for interim bail);
- Death certificate / Hospital report (if applicable for family emergency)
- Copy of ID & address proof (if relevant)
- Anything else that indicates a willingness to cooperate with the investigation;
Whatever else you think might help explain the need for employment/financial dependence on accused that is allowed under law. Don’t take claims of sickness for granted. The court will want to see a doctors prescription/report from diagnostics and hospitalization for anything more than a layman's statement that someone is ill. For the same reason, don’t give the Court half-truths by submitting edited, incomplete or exaggerated documents. BK Singh Advocate and Best Bail Lawyer will review whatever record exists to weed out what will actually help you for the limited relief you are requesting.
Can Interim Bail Be Granted for Medical Reasons?
Medical grounds, yes. But Medical bail is not automatic no. The Courts consider seriousness & bona fides of condition, availability/timing of treatment etc., exigency, conditions in custody, facts of case. Supreme Court has stated that exceptional circumstances and suffering which cannot be endured may justify interim relief even if regular bail is not called for. That statement cannot be read as conferring a right. You can't just put down "medical emergency" in an application and expect to get off. Medical records must be genuine, upto date and specifically related to the application. If medical condition is of relative of the accused (instead of the accused himself) the Court may investigate as to why it is that accused has to suffer and whether interim bail is justified.
BK Singh Advocate analyses Medical interim bail from the perspective of evidence as well as law.
How Long Does Interim Bail Last?
INTERIM bail is bail which is granted for some period.
It can be till a particular date which is mentioned in the order or till the next date of hearing or till disposal of the pending application/status/event/etc.
Whatever is mentioned specifically in the order.
Do not interpret it that it is valid till further orders.
Read the order which granted temporary bail to him carefully and see if he is obliged to surrender at the end of the stipulated period.
If he has to surrender and he fails to surrender then he can get into real mess.
Prosecution can initiate coercive measures against him.
He will be put to disadvantage while seeking bail in future also.
High Courts have granted temporary bail and Supreme Court has granted specifying very clearly the period after which the accused shall surrender.
So based on the language of the order, Surrender may or may not be needed at the end of interim period.

What Conditions Can Be Attached to Interim Bail?
Courts can impose various conditions for help in investigation or ensuring availability of accused. These conditions may relate to
- Attendance during investigation upon request;
- Appear before court/investigating officer;
- Non-contact /threatening of witnesses;
- Destroying evidence;
- Restriction on travel;
- Bond/Surety;
- Surrender when interim bail period expires. Please keep in mind that conditions vary according to the order that is passed.
Conditions must be read carefully by a person who has got himself some respite. Calling the complainant, travelling abroad without permission or just not showing up can be grounds to prove that you have violated your bail. The Delhi bail conditions explained by BestBailLawyer. com further states that interim bail, anticipatory bail and regular bail serve different purposes and you may have bail conditions/cancellation disputes in the future.
BK Singh Advocate would rather you people clear up any condition you don't understand before proceeding than take things to their extremes and regret later.
Can Interim Bail Be Cancelled?
Yes.
Interim bail doesn't mean one is exempt from having it cancelled.
If the defendant misbehaves, intimidate witnesses, tamper with evidence, abscond or otherwise misuses their freedom of movement, then yes - – the State or complainant can certainly pproach court for whatever relief is appropriate.
Or the interim relief might simply EXPIRE by its own terms even where there has been no wrong doing.
That's the difference I was referring to. Expiry is not the same as cancellation. If the bail order says you get protection UNTIL 10 October, it can EXPIRE (END) by force of the order itself on that date, unless extended.
The issue of bail being cancelled is different. That occurs when court TAKES ACTION to CANCEL bail based upon alleged misbehavior, or some other reason they find valid.
BK Singh Advocate speaks to both situations in this post as Best Bail Lawyer and avoids labeling every termination of interim relief as "bail cancellation".

While explaining interim bail..
3. Can one apply for interim bail before police arrests you?
Yes. You can seek temporary relief by filing bail bond application. Keep in mind that court may deem it interim bail or can hold that it actually passes anticipatory bail.
4. Can one apply for interim bail after police arrests you?
Yes. Interim/temporary bail can also be granted after arrest subject to facts. Best Bail Lawyer treats such cases different than those who seek anticipatory bail before arrest.

Final Thoughts
Interim bail can be useful because sometimes criminal justice system may not keep pace with an acute liberty matter.
But interim relief is not the same thing as 498a bail order.
Let’s begin with basics: What’s custody situation? What bail petition is pending? Why interim? What’s the FIR say? Any special law? What’s the order passed by the court verbatim ?
Interim Bail in India is still a fact dependent, discretionary relief granted by Courts. While criminal laws have no separate definition for it, our Apex Court has validated grant of interim bail.
But when arrest, custody, medical emergency or pending expiration of interim relief gives rise to an acute issue, call BK Singh Advocate. Dial our Best Bail Lawyers to discuss FIR, bail order, custody status and appropriate criminal forum.
