Why Does Maintenance Matter in New Delhi in 2026
As mentioned above, households in New Delhi and Delhi NCR are not homogeneous when it comes to employment and income patterns. BK Singh Advocate clients vary from salary earners to consultants, freelancers, professionals to business owners and entrepreneurs. There are also cases where one spouse earns and lives in India whereas the other spouse is an NRI or settled abroad. Some earn income from a combination of sources such as salary and business or investments.
An applicant would be struggling to make both ends meet at their home. Rent, school fees, medicine, travel and daily household expenses have to be managed while spouses start living separately. The longer it takes to receive monetary relief through the courts, the harder it can be on a spouse that may be reliant on their partner for finances.
A respondent would likely have an entirely different set of financial concerns. Income may fluctuate over time. Earnings can go up and down based on seasonal changes in business, loans taken for business or personal use, expenses paid for the profession and/or aging parents to take care of. Bank account statements and total earnings from a business do not always explain the liquidity situation.
BK Singh Advocate takes these factors into account when drafting a claim or defending against a maintenance claim. BK Singh Advocate will try to get the financial information before the court as truthful as possible. Liabilities, expenses and earnings should be accurate so that you avoid unnecessary delays and legal complications in your matrimonial lawsuit.
BK Singh Advocate is also located in New Delhi so finding the right court matters too. New Delhi family courts and other competent courts have jurisdiction to entertain matrimonial disputes in Delhi. If you reside in New Delhi, you can have related matrimonial cases filed in any other Delhi NCR court like Gurugram, Noida, Ghaziabad or Faridabad.

Can Maintenance Be Settled Outside of Court?
Yes. Parties can mediate on financial matters pertaining to a matrimonial dispute. Depending on what proceedings have been initiated, parties can sometimes reach a mutual agreement. However, these agreements have to be reasonable and able to be formalized in a legal document.
The terms of the agreement can be broad. Monthly maintenances, lump sum payments, children’s expenses, division of property, pending suits against either spouse and any other claim raised in the matrimonial disputes can be addressed based on facts and rights in the issue.
Just because you and your spouse agree on a number, doesn’t mean you can shake hands and walk away. Details such as amount to be paid, duration payments are to be made, method of payment, existing maintenance claims, pending lawsuits and what happens if a party fails to comply or does comply all need to be discussed. Caution has to be taken when discussing matters involving children. Children are never just another entity in a financial dispute between husband and wife.
BK Singh Advocate can assist parties with reviewing terms of the settlement agreement before it is executed and becomes a binding agreement. If both parties are willing, settling by way of negotiation can provide you both certainty of outcome. However, every case is different and the decision to settle is always up to you and your spouse.

Can Maintenance Amount Be Modified?
The amount of maintenance ordered by the Court is not set in stone for all time.
If there has been a change in circumstances and the applicable law allows for it, either party can request a modification to the ordered maintenance. A significant change to either party’s income, expenses, number of dependents or any other change in circumstances could be relevant to bring up to the Court. Section 25 of Hindu Adoptions And Maintenance Act, 1956 permits modifications to an existing maintenance order if “there has been a change in the circumstances.
You’ll want to carefully consider your circumstances.
For example, if you lost your job or were fired from work and you have no comparable income, this could be grounds to request maintenance from your spouse. Alternatively if you obtained a higher-paying job, you may be required to pay more in maintenance to your spouse. The same can happen if you have less expenses for a child or if another dependent needs more financial support. Any major change could be considered by a lawyer to see if you qualify to make a request to the Court.
Remember, do NOT stop paying a court ordered amount just because your situation has changed. Consult with an attorney to see if you can request a modification to the amount.
Contact BK Singh Advocate to see if the previous order can be changed based on your current financial situation.
Frequently Asked Questions
1. Can a wife ask for Interim maintenance in divorce case?
Yes. Either spouse can request interim maintenance if the statutory requirements are met under the applicable law. Under Section 24 of Hindu Marriage Act, either spouse can claim relief in the nature of maintenance pendente lite as well as expenses required for the ongoing litigation.
2. Can my husband ask for maintenance from me?
Yes, they can in certain circumstances. It all depends on the facts of your case and which matrimonial statute applies to your situation. Keep in mind that Section 24 of Hindu Marriage Act doesn’t specifically say this is a benefit for women only. BK Singh Advocate will go over your specific facts when you meet with the attorney to determine if you have any legal claims you can make against your spouse.
3. Can a working wife get maintenance?
Because every situation is different, there is no yes or no answer. If a working wife’s salary does not fulfill her reasonable needs and considering her liabilities and standard of living, courts have allowed maintenance claims by wives. Courts also look at the financial positions of the parties when deciding these matters. You’ll have to prove your legal entitlement to maintenance based on the law you file under and present proof to support your claim.
4. Is there any percentage of salary given for maintenance?
No. There is no one size fits all formula that the courts will use to determine how much maintenance a spouse will receive from the other spouse. Depending on your situation, the court will review all evidence under the applicable law and consider all relevant factors and circumstances.
A Maintenance Lawyer in New Delhi can guide you on the potential amount of maintenance you may be entitled to receive or potentially have to pay. Do not go by what you read on a blog post as providing exact numbers.
5. What is difference between maintenance and permanent alimony?
Technically, maintenance could include any payments made during litigation as well after litigation has been finalized. “Permanent alimony” is most commonly used to refer to the monetary awards ordered by a judge under the applicable matrimonial law at the time of decree or even after a decree has been passed.
Terms like relief, permanent alimony and maintenance have different meanings depending on the statute and the facts of the case.
6. Will the court look into the income of both parties?
Yes. The court can request financial information for both parties during the course of litigation. Each party will have to disclose their income, income earning potential, assets, liabilities, reasonable needs and obligations they have financially towards themselves, their spouse and if any, children.
7. What if wife is hiding her income?
The person who knows about the hidden income should provide proof to the court. Proof can include documents, direct deposit information to unknown accounts and credible evidence that you are aware of. The court can use its best judgment to determine whether the spouse is lying about their income if proof shows their spending habits are higher than their claimed income.
If you think your spouse is hiding income, present information to the court. Merely telling the court is not enough and will hurt your credibility.
8. Does maintenance include children's education expenses?
Education expenses can be claimed under all Indian matrimonial laws. Children are a common factor in matrimonial disputes and courts can consider their expenses separately.
If you file under the Hindu Marriage Act, divorce proceedings are the type of proceeding you would file to claim maintenance. Section 26 allows claims for children expenses from both parties. Courts have allowed maintenance payments for education purposes.
9. Is it possible to claim maintenance in a one time amount?
Yes. As mentioned above, parties are not prohibited from reaching a financial settlement including lump sum payments. Divorce by mutual consent allows parties to not only divorce each other but decide how to split finances, division of property, custody and more
You should always have BK Singh Advocate review terms of any settlement you are thinking about signing. You do not want to sign away your rights without knowing the full legal consequences of signing the agreement.
10. What documents I should carry when meeting a maintenance lawyer.
Marriage related documents, existing orders/petitions from court if any, salary/income proof, bank statements, rent housing loan statements if applicable, children expenses if applicable, health care/treating expenses.
Conclusion
Both parties going through a maintenance battle can avoid making this issue any harder than it has to be. The petitioner should know what their actual needs are and come prepared with documents to prove their needs. The respondent should know what income they earn, what their current liabilities are and avoid making generalized statements about money.
You may file your claim under the Hindu Marriage Act, Hindu Adoption and Maintenance Act, BNSS, Domestic Violence Act or numerous other laws governing matrimonial relationships. Lawyers in India will know which court has jurisdiction over your matter based on the facts you tell them and the nature of the case pending.
