Bail in Domestic Violence Related Criminal Cases Bail Options in India
It happens slowly and then boom. An argument between husband wife leads to police enquiry to an FIR being registered against the accused person for cruelty, dowry, assault, threatening or breach of protection order etc.
At this stage what exactly does the accused wants to know? Will I get arrested? What are my bail options?
That will entirely depend upon what allegations are made, what sections are being applied, if an FIR has been lodged, if you’ve been arrested and what accusation is being levelled against each of the accused persons. There may be domestic violence proceedings happening along side the criminal case. There may be maintenance proceedings going on as well. Just because a proceeding has been initiated against you, do not assume the other will be automatically quashed.
As of year 2026, Criminal Law is BNSS 2023 which translates to Bharatiya Nagarik Suraksha Sanhita 2023. The DP Act i.e. Protection of Women from Domestic Violence Act 2005 still stands which provides Civil and Criminal Remedies against Domestic Violence.
In case you are looking for a good Bail lawyer to handle your matrimonial criminal case in Delhi, Ghaziabad, Noida, Gurgaon, Faridabad, Lucknow, Mumbai or any other city of India then consult an advocate first. Understanding your situation is key. Advocate BK Singh would always recommend you understand what are the allegations made and what offences have been alleged against you and what stage you procedurally are at.
Why Does Bail in Domestic Violence Cases Matter in 2026?
Lets say in case there is a domestic issue which leads to someone accusing you of a non bailable offence then you would have to consider bail. If you have not been arrested then you can consider Anticipatory bail. Else you will have to consider normal bail.
Difference between both? Section 482 BNSS talks about anticipatory bail. Where as Normal bail would come into the picture once the person has been arrested or is in custody as per the said section. The Sessions Court as well as the High Court can grant bail under BNSS. They just have a different set of jurisdictions and circumstances under which they can grant bail.
Courts could be multiple in Delhi NCR. You could have a criminal case pending against you and the other case could be filed under domestic violence Act in front of the Magistrate. Under Domestic Violence Act you can file an application before the Magistrate and ask for relief such as Protection order, Residence order, Monetary relief, Custody and Compensation.
Once a protection order is granted by the Magistrate you need to abide by that order. It is illegal to violate the protection order or interim protection order. It’s a crime under section 31 of Domestic Violence Act. And that crime has been made cognizable and non bailable offence under section 32.
Therefore, it is very important to understand what orders have been passed, what FIR has been registered and what allegations have been made. That is why I always suggest to see the orders passed and allegations made against the accused before we decide what kind of bail application shall we file.
For situations where arrest has not yet taken place, readers can also review the Anticipatory Bail Lawyer guidance available on the website.
Quick Facts:
If someone thinks that they are going to be arrested for a non bailable offence they can file for anticipatory bail as per section 482 BNSS.
If the person is already in custody he can ask for bail. Yes regular bail.
Just because a FIR has been registered under Domestic Violence act does not mean that all the respondents named in it will be arrested.
If someone breaches a protection order granted by the Magistrate under section 31 of domestic violence act then yes it becomes an offence and that offence is non bailable.
If you get bail it does not mean your FIR will get cancelled or investigation will stop or your case will be thrown out of court.
While granting bail court can impose conditions.
It all boils down to what exactly has been alleged against that person. What evidence is there against him. What role did he play. What stage of proceedings are you at and under which law the offence has been alleged.
What would amount to a Criminal Case filed related to Domestic Violence?
I would not recommend clubbing Domestic Violence Law with Criminal Law as they are 2 different laws which have been applied.
Under Protection of Women from Domestic Violence Act 2005 Domestic Violence has been defined. And various orders can be granted by the Magistrate such as Protection Order, Residence Order, Monetary order, Custody and Compensation orders.
But there could be another FIR which has been registered which may attract offences under Bharatiya Nyaya Sanhita 2023 or any other law which has been applied. Like Cruelty by husband or husband’s relatives could amount to section 85 BNS if all ingredients are met and facts of the case satisfy the same. There are certain chapters which have been introduced in BNSS which deal with the Prosecution of offences u/s 85 BNS.
Therefore while dealing with bail you have to understand the difference between-
(1) What is the Complaint that has been filed?
Secondly, You need to figure out facts of the case.
(2) Is there any Arrest made in said Complaint?
If the Complaint is filed under Domestic Violence Act, Criminal side should not be blended with the domestic violence Act. Both have different procedures. But if there is an offence which has been clearly defined and an FIR has been registered against the accused then accused should take help of the Criminal Procedure for the respective offence.
For matrimonial allegations involving cruelty and dowry harassment, the dedicated Bail in Section 498A and Dowry Harassment Cases service page provides related information.
What Law will apply for bail?
For most cases we have BNSS 2023 which is our criminal procedural code.
For bail purposes if the offence is a bailable offence then bail is mentioned under section 478. But if the offence is non bailable and the person has either been arrested by police or produced before any court other than High court or Court of session. He can seek bail as per section 480. Anticipatory bail has been covered under section 482. Power for High Court/ Court of session to grant bail is provided under section 483.
If someone has been accused of Domestic violence, substantive law dealing with the case could be under Domestic violence act or could be under different law which provides for cruelty or any other offence.
Important thing to note here is section 31 of Domestic violence Act. Where if someone violates a protection order or interim protection order granted by the court then he can be punished with imprisonment up to 1 year or fine of 20000 rupees or both. And section 32 of domestic violence Act says that this offence is Cognizable and Non bailable offence.
Once court grants you bail they can impose conditions on you when granting the bail. Make sure you follow those conditions. In a recent Supreme Court order in 20 24 the Supreme Court said that conditions which are granted on bail cannot be treated as an order of passing independent maintenance.
See there is a very thin line between bail conditions and you continuing with your matrimonial responsibilities.
If the accused is already in custody, the Regular Bail service page explains the distinction between post-arrest bail and anticipatory bail.
Who should read this article?
If you are a husband whose name has been mentioned in an FIR. If you or your parents / relatives have been named in some Matrimonial matter. Someone from your family is getting arrested after a complaint was filed. Someone from your family has violated a protection order or an interim protection order.
If you live separately from your spouse. In chances where both of you live separately. You may reside in Ghaziabad and the case is pending in Delhi. You may stay in Noida but your FIR was lodged in Faridabad. It’s important to understand the territorial jurisdiction of where your case is pending.
One thing I have noticed is that since multiple people are mentioned in the Complaint everyone kind of assumes they are at the same stage of the proceedings. No they are not. Each individual will have different allegations against them. Some may reside at your location. Others may not. Documents will be issued to some of you. So first step is to understand where everyone stands.
BK Singh Advocate can understand the information you provide and tell you whether you need to apply for Anticipatory Bail or Bail or some other criminal remedy that you can seek.
What Is the Bail process?
Step 1: Understanding what has happened
Be it a Police notice, legal notice, complaint, FIR, memo of arrest, order passed by the court each document has its own value.
Step 2:
Understand what allegations have been made and what sections are they have invoked. Did the accused commit the offence he’s being accused of. Were there any previous proceedings against the accused. Is the accused in custody. What stage is the investigation at. Has the court passed any orders regarding the bail.
Step 3
If the person has not been arrested but he thinks that he might be arrested for a non bailable offence then yes he can apply for anticipatory bail under section 482 BNSS. Apply it to the Court of Session or High Court as applicable.
If the person has been arrested then yes he has to deal with bail. The court will look into the facts and apply what law provides for the accused.
Just because you have applied for bail does not mean you will get bail and go home. You still have to follow court orders.
Step 4: Following the court orders
You have been granted bail. You are free from jail but not from the case. You still have a pending case against you. So follow the conditions!

Documents that you should keep
The lawyer would want to see what documents you have to understand where you actually stand in the process. Remember every case is different and has different facts.
Here are some documents which can be useful for you:
Copy of FIR/complaint (if applicable)
Copies of notices received from police
Arrest memo & Remand papers (if arrested)
Copy of domestic violence Act petition.
Any orders passed by court (Protection/ Residence/ interim order)
Previous bail applications/copies of bail orders.
Any summons/notice received from court
Marriage proof/residence proof related documents.
Medical report (if there are allegations of injuries)
Any message/ emails/ documents which can prove your side of the facts.
Address proof of accused. (If this is an issue)
Remember do not delete any messages or documents thinking they may not help you. Keep them and let the lawyer decide whether they help you or not.
If you have received any court documents/papers then make sure to carry them with you while meeting Advocate BK Singh rather than explaining what all has been done to you.
