What Happens When You Fail to Remove NCDRC Registry Objections?

You may have liberally pleaded facts in your NCDRC filing. You may have demonstrated quantum of financial loss and supported it with reliable evidence. But your paper still may not be admitted because Registry notices various defects on the paper book or through electronic filing platform. Unaddressed NCDRC Registry objections can push back numbering, listing and admission of your matter. In worst case scenarios, delayed resolution can impact limitation.

Too many consumers think the act of uploading their complaint, appeal or revision petition online constitutes ‘filing.’ It doesn’t. Before your filing is admitted, it will be reviewed to ensure compliance with procedural norms and documentary requirements. If information is missing from your filing, Registry can object to incomplete memo of parties, missing affidavit, illegible annexures, improper pagination, inadequate fee, lack of authorisation, inconsistent dates or unexplained delay.

When NCDRC Registry places an objection on your filing, it is not rendering an opinion on merits. It merely means that the information before the Court does not comply with procedural laws and must be updated. Registry objections become a problem when they are unanswered or partially corrected.

Rule 9 of the Consumer Protection (Consumer Commission Procedure) Regulations, 20 20 explains a party will generally be informed of the defects in his filing and be asked to correct them within fifteen days. After said period of 15 days, the complaint will be placed before the appropriate Consumer Commission, who can pass such orders as it thinks appropriate, and reject the complaint, even if the defects are not corrected. Delayed possession from a home buyer, claim settlement from a policy holder or return of an unfavorable status quo from a business can be a lot more than a delay in paperwork. Money gets stuck. The opposite party can proceed with execution/ recovery. Statute bar dates become harder to condone.

A lawyer will tell you if the objections raised by Registry are merely technical, material, or raise issues with maintainability of the proceeding. Delayed Registry Objections: Will They Impact My Admission in 20 26?

Pending Objections can lead to non- admission of your case, delay in service of notice and opens up an admitted case for Limitation attacks. Beyond the stipulated time frame for corrections, Consumer Commission can examine your defectively-filed complaint and dispose it over instead of having it pending.

If your headquarters is anywhere in India, NCDRC follows the same protocol. Since NCDRC takes appeals from State Commissions situated in Delhi, Mumbai, Bengaluru, Hyderabad, Chennai, Kolkata et cetera filing etiquette is significant to parties from these cities and others like Noida, Gurugram, Faridabad and Ghaziabad. Electronic filing from outside Delhi is common and some petitioners believe if they can upload their papers in appellate commission’€™s portal then their case is rightly instituted. Uploading and submission are two separate procedures. One only confirms that you successfully uploaded your documents. Other ensures that all procedural discrepancies are rectified and Court has the power to entertain your petition.

Delay also takes on added risk when filing an appeal against a State Commission order. Section 53(1) of the Consumer Protection Act, 2019 allows only thirty days to file an appeal from the date of the State Commission’€™s order. Any delay must be reasonably justified. In addition, if the appellant is required to deposit an amount as directed by the State Commission, the appeal will not be admitted unless such amount has been paid.

Under Section 69, there is a limitation of two years from the date on which cause of action arises to file a consumer complaint. Further, there is a limitation period for filing appeals before the National Commission. Revision petitions have a limitation period as well. Applications also have their own limitation periods. One must take care to file the document within the period allowed under the statutes/ regulations governing each and they cannot be substituted for each other. What Is an NCDRC Registry Objection?

When there is a defect apparent on the record upon scrutiny of your complaint/ appellate/revision petition by NCDRC Registry , an objection is raised. The defect could be in respect of format/ annexures/fee/approbation to sue/ file/ territorial jurisdiction/limitation/verification etc. Objection does not mean disposal merit.

Some objections can be overcome by submitting indexed sheet with corrections/clean copy affidavit for signature. However certain objections reveal a more basic legal flaw. Execution of vakalatnamah before wrong forum/ defective approbation/unexplained delay/part settlement of impugned order cannot be rectified by filing few additional documents.

Technical defect is different from substantial defect. Missing of page numbers is not same as not including a necessary party. Instead of providing a clean copy of an annexure which got blurred,is not same as filing appeal under wrong provision. That apart altering cause title will not cure deficient pleading if appeal was filed beyond limitation.

Clients are often confused about the intention of Registry as objections sheet is curt. But one line draft by Registry can have serious consequences. For example, “ explain limitation” can entail submitting a dated chronology of events/separate condonation application/supporting documents/legal explanation connecting the dots.

1. Within how many days should defects objected by NCDRC Registry be removed?

Defects notified by NCDRC Registry shall be removed within fifteen days from the date of receipt of notice of such defects ideally as per Regulation 9 which says that the party or his authorised agent shall comply with instructions given in this regard. Please check the stand from objection notice itself as well as your case file.

2. Does NCDRC delete my matter if defects aren’€™t removed within 15 days?

No. The matter shall be placed before the appropriate Consumer Commission for orders as it thinks fit whether or not the defects complained of have been removed, If defects are not removed within fifteen days from the date of receipt of notice. Thereafter, an order adverse to your request of admission can still be passed.

3. Can I file something against objections raised by NCDRC Registry?

Yes. Regulation 9 provides that if the party or his authorised pleader objects to the validity of defect raised by Registrar then such grievance can be placed for consideration before the Consumer Commission for orders as it thinks fit.

4. Will uploading corrected documents get my complaint/application admitted?

Not sure. Though rectifying defects indicate satisfaction of requirement of scrutiny under Rule 9, admission of complaint/ application shall still be subject to scrutiny by National Commission. Rectification of documents do not decide questions as to jurisdiction, limitation, whether respondent is a consumer and maintainability of proceedings.

5. Do objections raised by NCDRC Registry affect limitation?

Yes. If substantial objections are raised by NCDRC Registry and not removed within the prescribed period, the days equivalent to the period mentioned in Rule 9 shall not be excluded in computing limitation. The impact will differ based on type of proceedings, date of filing, history etc.

6. NCDRC has sent back my filing/application multiple times. What should I do now?

Please consult with NCDRC Lawyers. If NCDRC has sent it back to you multiple times then high chances are that you either didn€™t make the corrections as asked or documents you are trying to submit now are different from the original ones you had filed. 7. Will I get my diary number after my complaint gets admitted by NCDRC?

Once documents are admitted, the order passed will clearly indicate whether your complaint/appointment has been admitted. Diary/Filing number is when your documents are accepted by the Registry/ court for institutional processing. Admission is the order that your matter has been placed before the National Consumer Disputes Redressal Commission for consideration. You can also physically check the status of your matter or check the last order passed for confirmation.

8. Can I file an appeal if I don’€™t have money for requisite pre- deposit?

If Section 51(b) under the Consumer Protection Act, 1986 applies to your case wherein the Appellant has been ordered to pay a sum of money to the opposite party and he is instructed to deposit fifty percent amount before filing the Appeal then he cannot file the appeal without making such pre deposit. No. Merely satisfying the requirements for rectifying defects, allotment of appeal numbers and filing of appeal does not automatically stay the operation of order passed by the State Commission. Request for interim relief/stay has to be made separately and is totally at the discretion of NCDRC.
