How Can MSMEs Legally Recover Delayed Payments from Buyers in India?

Sections 15 to 24 of MSMED Act enunciates the delayed-payment mechanism available to eligible micro and small supplier. Dispute with respect to such amount could be referred to Micro and Small Enterprises Facilitation Council ("Council") established under Section 18.

Yes. Remedies under the MSMED Act are available to a qualifying micro or small supplier where the buyer is privately owned business (subject to the relevant facts satisfying the statutory criteria).

2. How long can a private company take to pay MSME invoices?

Agreed payment terms would apply. If agreed in writing under Section 15 of the MSMED Act the period shall not exceed 45 days from the date of acceptance or deemed acceptance.

3. Can MSMEs charge interest on late payments?

Section 16 provides for statutory compound interest with monthly rests at a rate of three times the bank rate notified by RBI to be payable where its conditions are satisfied.

9. As a medium business, can I use the MSEFC delayed payment relief scheme?

Chapter V of the MSMED Act applies specifically to micro and small enterprise suppliers. A medium business will likely not be able to make use of this mechanism. Other means may need to be considered to recover the payment.
