Can a Bank Auction Be Stopped After Rejection of Your Settlement Request?

You have done everything you can. The bank turns down your settlement offer. Now what? Where do you go from here? Especially when the bank has already scheduled an auction date for your property. You’ve already spent weeks negotiating with branch officers, sending in an OTS application, crunching numbers and just praying that the bank would consider allowing you more time to settle. Yet, all you receive in response is a short and sweet letter from the bank. Settlement rejected. Auction to take place.

Game changer.

Just because your bank rejected your request for settlement, does not automatically mean that a bank auction is FINAL and that you can’t dispute or stop it. Sending in another settlement offer letter will NOT automatically stay the auction either. What matters is HOW FAR ALONG SARFAESI proceedings have progressed for your case, what notices have been served, when is the auction date, what is the secured property at risk and if there exists any legal ground upon which to SEEK INTERVENTION.

Why Does a Rejected Settlement Request Matter So Much in India in 2026?

Settlement negotiation and SARFAESI enforcement are two parallel proceedings. In the absence of an agreed upon binding communication or Court order to the contrary, banks are well within their rights to pursue statutory proceedings for recovery and consider an OTS (offer to settle) on commercial grounds.

This becomes highly unfair to borrowers whose properties are located in Delhi NCR, Noida, Ghaziabad,Gurugram, Faridabad, Lucknow, Jaipur,Mumbai,Pune, Bengaluru, Hyderabad,Chennai,Kolkata, Ahmedabad or any other city which may have already been advertised for e- auction.

What Quick Facts Should You Know Before the Auction Date?

  • Briefly OTS or settlement rejection does not by itself imply automatic stay of auction.
  • Suit or application can be enforced under SARFAESI only if it is not stayed by an agreement which is binding on the parties or by a competent court/ forum.
  • Relief under Section 17 of SARFAESI Act is only against the acts carried out notified under section 13(4) and if the prescribed conditions are met.
  • Period to file application under section 17 is limited to 45 days from the date of impugned action.
  • Sale-notice timing matters in certain cases from borrowers’ standpoint.
  • Filing of suit per say does not ensure interim relief would be granted.

Can a Settlement Rejection Itself Stop the Bank Auction?

NO. The fact that your settlement request got rejected DOES NOT CONFIRM that it IS STILL a bank auction.

It is only a commercial offer to the lender to accept certain terms. Lender can ACCEPT/ COUNTER/ REJECT the offer depending upon their policies and the facts of the case.

Law comes into play only when SARFAESI has already been initiated by the lender. Only then does it become important for a borrower to know whether any action initiated by the secured creditor can be challenged before DRT.

Which SARFAESI Provisions Become Important After Settlement Rejection?

Section 13 of SARFAESI Act enables a secured creditor to enforce his security interest under the provisions of the Act. A typical SARFAESI Section 13(2) demand notice would allow 60 days to clear the liability. You cannot take action u/s 13(4) until the expiry of this notice period.

Taking action u/s 13(4) entitles the aggrieved person to make an application u/section 17 to the DRT within jurisdiction to hear the application from the date of such action. Time allowed to file the application is 45 Days.

Timing is Crucial in sale proceedings. Read Section 13(8) which when conjunctively read with Security Interest (Enforcement) Rules, is also concerned with the timeline for issuing sale notice. Once a valid sale notice is issued the legal position changes:

Who Should Seek Professional Help After an OTS Is Rejected?

How Quickly Should You Act After the Bank Fixes an Auction?

An auction matter should be researched quickly because rights/options under law change from stage to stage. Section 17 affords you 45 days with respect to the act complained of therein.

Just because you have 45 days to file under a certain section doesn't mean you can sit until day 45 to file. Ans. No it just means bank is not ready to accept your settlement offer. Its neither the last legal remedy against bank nor mean that you have no legal rights left. Whether you have any legal remedy would depend on facts/recovery stage/documents etc.
